    Business Response

    Date: 06/12/2022

I was asked to visit the home of ****** ** to go over completing the home build ** *** ******* ***** ******* **.  It was clear that the house was at approx. 90% completed and ****** said he fired his builder and wanted someone to complete the job and document everything in great detail as he will be suing the original builder. I provided a fixed price contract for $124,260.36. Draws on the contracted amount were clearly explained and Mr. ** submitted those draws as agreed. After drywall we started to hook up the heat pumps in the home and soon discovered issues with the mechanical which we had already dealt with. I had electrician and plumber meet me on site and it was then that I was informed of the pump relocation approved by the homeowner and the plumber. This relocation caused electrical to be short and the walls would have to be opened again. The plumber quickly said the customer approved the relocation and did not inform the contractor (us) of this change approved months earlier by Mr. **. About 4-5 days after this Mr. ** fired our company from the contract and said he was taking the month of December off to complete his home himself. Jason and Tony packed up all equipment and left the site.

Mr. ** had injected himself into the project many times including the concrete cancelling the trucks the day of the pour and adding a drain to the concrete instead of the 3" hole drain that was not hooked up to any plumbing , just a hole in the concrete that was 5" deep. Concrete contractor called me on this and i told them to fulfill their contract with me as directed and any extras would be at the expense of the client.

By text I encouraged ****** ** to allow us to complete the job and that request was denied immediately.

There is currently 90,000.00 lien on Mr. ** home from the original builder, fired by Mr. ** at the 90% completion stage. We have fulfilled our commitment to Mr. ** and have paid everyone that has worked or supplied materials to this project. There is no refund for services rendered to the stage of being dismissed, we have a recorded call between Mr. ** and Jason confirming our position. I have also been in contact with the original builder who shared his experiences with us that mirror our difficulties on this project and dealing with this client.
