On 10 July 2023,I purchased a house, at the address below, to move into. After finding Jays Home Improvement through a ****** search, I had him (***************************, manager of Jays Home Improvement) provide me various quotes for work.On 29 Sept, I agreed to ****** 26 September 2023 quote, which was to remodel the house. In ****** quote to me,I was to pay half of the job upfront and as work continued, Id pay down the other half. To begin work,on 29 Sept, I paid the owner of Jays Home Improvement (*********************************) $42,735.25, which was half the 26 Sept 2023 quoted dollar amount.On 12 Oct 2023, I found out that ***** did not have a general contractors license; hence, could not pull a building permit. Jays Home Improvement only has a license for flooring, painting and drywall work (HSV license #********. On ** Oct 2023, Jays Home Improvement, or an accomplice, forged my name on a fake, cost plus contract, with a house builder friend of ******. Jays Home Improvement, or the accomplice, provided that fake contract to the City of Huntsville so this builder (XXXX) could take on the work of a general contractor, with **** Home Improvement acting as a subcontractor.I have never had contact with XXXX builder nor have I ever signed a contract with them. On 18 Oct 2023, I was contacted by the City of ********** to verify that I had contract this XXXX builders.I informed them there existed no contract between me XXXX and me and I had the building permit stopped from moving forward. On 20 Oct 2023, through email, I wrote to ***** & stated that he misrepresented himself as a general contractor; hence,our business relationship was not legal and I formally request he return the $42,735.25, less the work ($5,431) that has already been performed.On 25 Nov 2023, ***** returned $5000 back to me. After multiple requests to be paid back the remainder, not a cent more has been returned to me. Jays Home Improvement still owes me $32,304.25. ***********************************Business Response

Good afternoon, ************** Contacted us to perform work on a property, and we did in fact notify ************** that we work with Builders, and attempted to pull the permit before he asked that the work be stopped. Our teams worked on this project for 2 full weeks lifting floors, framing ceilings, installing exterior electrical outlets, HVAC work was completed, a driveway was poured, and a add-on bathroom was framed and ready for drywall. According to The Alabama ************************* the only discrepancy Jay's Home Improvement made was starting work before the permit was cleared. Our company was fined, and we won't make that mistake again. A deposit is required on jobs over $500 to purchase materials and to cover the labor of the men working with us. Our work was quality, and those men were paid. $5000 was remaining and we sent that amount to **************.

I am rejecting this response because it is unsatisfactory and incongruent to what actually occurred. In Jay's Home Improvements (JHI) 24 Sept 2023 proposal, no statement of working with "Builders" was made. Just for the sake of argument, if he ever did mention that JHI works with "builders," that would have no relevance. I paid JHI $42,735.25 for the work proposed on the 24 Sept 2023 proposal and the funds were withdrawn from my account by *********************************, doing business as JHI, on 29 Sept 2023. Other than flooring, painting or drywall work, JHI does not have a license to perform house framing work, perform HVAC work, perform any electrical work, or install driveways. What's more, since JHI is not a general contractor, JHI CANNOT SUBCONTRACT WORK OUT TO ANY OTHER COMPANY OR PERSON. The contract (proposal and acceptance) between JHI and me was fraudulent from the moment JHI sent me JHIs first proposal on 7 July 2023 since he has no license as a general contractor and JHI did not have a license to perform all the necessary work.
There are two relevant State of Alabama rulings that provide answers to my complaint against JHI: (1.) ***** v. **************** 36 So.3d 542 (Ala. Civ. App. 2008), which states that if any person performs work within the statutory definition of general contractor and fails to obtain a general contractor's license, the contract must be declared null, void, and unenforceable. The aggrieved party would be able to collect the full amount of the fraudulent contract regardless of the work and materials already spent. (2.) Architectural Graphics and ****** Services, **** ****************, 417 So.2d 574 (Ala.1982), which denies legal status to contracts by unlicensed general contractors
In addition, the City of ********** (HSV) stopped the work since there was no permit on file with the city for work being done. Shortly after, on 12 October 2023, ******************** came by the house, saw the posted stop work notice posted on the front door and asked his subcontractors to continue working. I told the subcontractors and ******************** to leave my house since the city posted the stop work order. I asked ******************** to continue the work after JHI pulls a permit from the city. ******************** said he would, but until now JHI has not pulled any permit. On 16 Oct 2023 ************************* *********** Department Deputy Director) from the City of HSV contacted me about a contractor*, with whom I have no connection to, trying to pull a permit on my house using a fake contract. I went to the City of HSVs ********************* and saw this contract with my forged signature and made copies for evidence. I then contacted the **************************** and they are currently investigating this fraudulent action.
In conclusion, to resolve this issue I expect JHI to refund me the remaining $32,304.25 that it collected from me. If I receive these funds, I will withdraw my BBB complaint about JHI and even ask the City of **************************** to stop its investigation into the forged contract so that I can put this situation behind me.
*For the time being, I am withholding this accomplice contractors business name.

We are positive that no laws were broken and we've settled this matter through The Alabama ************************** The men who poured your driveway, performed demolition, framing, electrical, and hvac in your house deserved payment for their work under the 13th Amendment of the U.S. Constitution. Complaint: 21580263JHI does not address the core of my complaint; JHI acted as a general contractor and collected money from me without a City of **********, ******* general contractors license. I want to emphasis that I never contracted with the people, or businesses, that were to perform work on my house. I contracted with JHI. My compliant remains unresolved.
JHI needs to address the following:
1. Does JHI have a general contractor license from the City of **********?
2. Did JHI collect money from me, acting as a general contractor, for work JHI is not licensed to perform?
Additionally, JHI may have settled something with the Alabama Home ********************** (AHBLB), but whatever may have been settled is distinct separate from my complaint. AHBLB does not represent me.For the BBBs knowledge, the 13th Amendment of the U.S. Constitution forever abolished slavery as an institution in all U.S. states and territories. In addition to banning slavery, the amendment outlawed the practice of involuntary servitude and peonage. Involuntary servitude or peonage occurs when a person is coerced to work in order to pay off debts. Likewise, the 13th Amendment has nothing to do with my complaint.

Jay**;s Home H**37343434363231H has been paid in full $3500. He did very tacky job. He added a pergola on to my patio deck, the top of it needs to be fixed. There are holes in the top and water is going everywhere. Nails are coming threw the top of it. Also, he installed siding on the front of my house and its coming off. I tried calling and texting him, he never came back. I have all the photos. He did other small repairs but didn**;t finish.Business Response

******************* has attempted contacting our ******* by calling several times during the day when they are working so they never answer the phones for safety reasons. ******************* was directed to call our office, or to see someone in our office to address any concerns she may have. She's done neither. Friday our office called ******************* to schedule a date, and a time to come look, or address her issues, she has yet to call our office back. Per contract a walk through inspection is performed the with home owner, and ******* together before any payments are made upon completion of every job that we do. Payment is only received after customer satisfaction. In the event we have to return to tend to small tasks one must call into the office, and schedule a date, and a time to address issues.

I am rejecting this response because: I tried reaching out to the jayz home improvement about fixing everything. I didnt receive a call from them .I have all pictures and text messages. This is the only way I feel I can get them to take care of this issue.exspecially when the truth is not being told.i just want my pergola done like it should be. And siding other issues taken care of.**** husband asked me to only contact him not her any longer when he started the job.

Good afternoon, after the initial complaint was made we contacted *******************. She had a punch list that she wanted us to complete, and we completed that punch list. ******************* addressed trim around Siding, and caulking in other places. We took care of that. ******************* didn't like the overhang of the metal roofing so we purchased new roof panels and did the entire roof over. When we left ******************* was happy. We strive to give our customers the best Contractor experience. When doing exterior work we use water proof screws and the best materials to prevent callbacks. We also give a one year warranty on all of our work excluding repairs.

I am rejecting this response because: I have text messages and pictures of what he didn't repair over the garage and around my home where as the siding was coming off over the garage and in front of the house.this had been since last yr.spoked him several times.
about it kept saying he was coming by .so I hope he is going to take Care of this matter. that was mention I have proof .way before a yr.i know that's what he was waiting on.to try and get out of it.this company has a long history of beating people out of their money.

Good morning, ma'am the allegations *********************** is making against our company is slander and lies. We've been to her home 3 times in 2023. Each time we completed a punch list of small things she said she was unhappy with and we didn't leave until we completed the task. Per our contracts 50% deposits are due to schedule a job. We don't get anymore money until a project is complete after a final walkthrough with client. We've done 4 walkthroughs at this house. We're not sure how to resolve this for *******************. It's been 2 years now. In conclusion, we've never beat anyone out of any money and our company doesn't have that kind of reputation. We are in fact licensed and Insured up to $2 million, and in 4 years operating we have never had a claim. We have over 50 5 star reviews on ****** and one bad review.
