Arizona Attorney General’s Office v All Good Shutter and Blind, LLC and Owner, Kevin M. Cash
On September 26, 2024, All Good Shutter and Blind, LLC and Owner, Kevin M. Cash, entered into an Assurance of Discontinuance with the Arizona Attorney General’s Office. The Assurance settles allegations that the business failed to deliver and install consumers custom window treatments for several weeks or months after the window treatments were ordered. Additionally, the business also failed to resolve consumers complaints regarding delivery and installations on numerous occasions, and/or failed to provide refunds for unperformed or unsatisfactory delivery and installation services. Under terms of the Assurance, the business agreed to refrain from engaging in any conduct in violation of the Arizona Consumer Fraud Act (ACFA) as it is currently written, or as it is amended in the future, and should they start, operate, ad/or manage All Good or another business in Arizona they will comply with ACFA as it is currently written, refrain from falsely representing the goods and/or services they advertises, offer, or sell in or from Arizona will be delivered in a timely manner if such good and/or services are not available for delivery or fulfillment in a timely manner, and deliver services and/or goods they advertise or sell in or from Arizona in a timely manner and no later than actually represented to consumers. Lastly the business agreed that they are jointly and severally liable to pay the Arizona Attorney General’s Office in the amount of $62,570 in consumer restitution and are jointly and severally liable to pay the State attorney's fees and costs in the amount of $5000. The Assurance was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law.
