    The second week of January 2024 Pauley Construction was installing fiber cable on power poles adjacent to my property for Century Link/Quantum Fiber. There is a ten foot easement for them to use but their workers were very careless and damaged one plant on my property and destroy another to the extent that it has died. I have contacted them, submitted photos of the damage and proof of the cost of the damage that they incurred. I have spoken numerous times and met with *************************, who was supervising the installation operations in my neighborhood, and walked the damaged on my property, discussing the damage and was told that their company takes these events seriously and will make it right. He also agreed that I was requesting a fair settlement. They keep kicking the can down the road and have not made it right. The following is copied from their website - "Integrity: We hold ourselves accountable to one another and treat others with respect. We are honest, forthright, and ethical in the work we perform and deliver every day." I have requested a $400 payment for the cost of the damage to my property which *** and I agreed that it was a fair and reasonable amount but have not received it.

    We have issued a check for the requested amount and will hand deliver it to the clamant today or tomorrow at the latest.

    Pauley Construction is the contractor hired by century link under a residential fiber optic upgrade contract with the **********************. The contractor has informed me of the work times permitted by the the ********************** to be between 5am and 10pm. If this work time schedule is in fact accurate, my complaint would also include the ********************** depth of permits as well. This work involves heavy, loud equipment that is very disruptive to all the residents and homeowners in my subdivision. Allowing this type of work to be conducted between these extremely early then extremely late times of day takes into account none of the rights of the homeowners nor does it abide by the work time guidelines set forth by the *** regarding noise and nuisance of construction equipment. Both the contractor and the ********************** should simply know better. When completing this work, homeowners need to be informed of what is involved. included and what to expect during this disruption period. Both the contractor and the ********************** have made little, if any effort to be as unintrusive as possible to the residents in this neighborhood. I will be gathering signatures from residents for a petition to amend this work time period with the ********************** and will be sending copies to the chairperson of ******* FRms ***.

    What the permit allows and what we would be doing are different. We will not be drilling and/or excavating as early as 5 am or after 7 pm. We will on occasion have fiber splicing work going on into the evening, this work is performed in an enclosed van or trailer with very minimal noise if any to the outside.

    We normally do not start a project before 7 am (potentially 6 am in the summer hours) and do not work later than 7 pm with the larger equipment. To minimize noise by our construction equipment to the **** we will not start prior to 7 am.

    Lument hired a contractor to perform boring and install fiber for utilities. amongst the project my yard was severly damaged including my sprinkler system. I filed a claim with century links insurance company, ********, who contracted pauley construction (**************) to fix my property. (i attached the claim with the number to pauley which i called numerous times and never got a call back... on this 800 number i reached ****)Someone showed up to schedule an appointment to assess damages and take photos. two weeks later i received a call that this person had been fired and i needed to schedule an appointment to do it again. I set the appointment and we met and they took photos. Then i didnt hear back as promised for the scheduled work completion to be set. I contacted them and they said someone would call me. Someone else gabby ************ calls me saying she is the owner of the business who did the utility construction and damage and needs photos of the damage and to know what materials they needed to fix my yard, also explaining she is going through a divorce with the man doing the work and on medical leave and shouldnt be working. She tried to intimidate me by saying my claim wasnt true and damage wasnt right. i was just confused at this point. i thought her company coming to assess damages was enough and the claim i wasnt sure what this call was all about but it was unprofessional and confusing. I called pauleys corporate office and left a message and have not heard back.

    Claimant was contacted and a meeting was set for September 30, 2023 to address landscape, fence and sprinkler lines. Dry utility work was being performed in the easement. Issues were addressed and as far as we knew resolved.
    Claimant has been met several times since then as she still feels there are issues, but nothing that was caused by our easement work. We have resolved the issues that resulted from our work in the easement and closed this complaint on our end.
