      Found an ad on Craiglist for store fixtures. Entered into a contract with ******** *********** and *********** Liquidation Group to deliver store fixtures to us in Nevada. The product arrived damaged and incomplete. In addition we received part of another customers order and that customer received part of ours. Mr. *********** refuses to refund us for the items not received. We also need to get rid of the other customers items that we received in error. Mr. *********** refuses to refund us or come up with an acceptable solution. Its all everyone's else's fault but his.

      We did not receive enough parts for two 4 foot sections ($200 each section) or for the 6 end caps ($200 each).  It is going to cost us a minimum of $500 to haul away and dump the extra shelves in the piles.  Since they refuse to send us what we are missing and pick up the extra shelves, we believe that we are owed $2,100.00.  ******** just ignores us, blames everyone else and refuses to discuss options to resolve this issue.

      We had received an order from **** from ********* ********** for store shelving to deliver to their store location. The order was sent complete to their location and because we work third party freight companies, we must clear the Bill of Lading upon delivery. I was not aware of any issues with the delivery(damaged goods) until three weeks after the delivery date, at which point we had given a clean BoL to the freight company. They had mentioned to me that two of the bases were bent which can be easily fixed and on top of that they had extra bases to use. Reached out to the freight company and they said there is nothing they can do and everything has been delivered to them. Our client had mentioned that they did not receive parts for the end caps, which is completely false. I, personally had seen they put the endcaps all together. They are referring to the bases on the endcaps, which hanging end caps do not have. They keep persisting that the hanging end caps come with bases, which is incorrect. I have also attached a picture here from the internet to show. Had the client contacted us within a day or two, we would have no problem working things out with the freight company but because it was 3 weeks later, they were not willing to do anything about the case. I have also offered to work things out with ********* ********** personally, but they first wanted $500, then changed their mind to $1600 and are now asking for $2,100, which shows us they are not serious. All the shelves there that are extra have been used by them and the rest of them are sold as scrap.

       

      We are still willing to work with FPC because we take great pride in customer satisfaction  but the response from them has to be reasonable.

       I am rejecting this response because: We did not receive what we had paid for.  This is not the trucking companies fault.  It is sole the fault of ******** ********** of ********** Liquidation Group LLC aka Wholesale Fixtures.  We received part of another one of their customers order and they received part of ours.  This was because the pallets were not properly packaged and they avalanched in the truck.  I did indicate on the BOL the problems we had with the delivery.  I have requested a copy of the BOL from ********** that he received and he has refused to provide it to me.  Also, it is customary for BOL's to be signed at the time of delivery noting issues with the delivery.  Once the order has been verified, then sellers are contacted for any missing and/or damaged items.  ******** ********** was notified within a reasonable period of time of the missing and damaged items.  ******** ********** promised he would reship the items, yet never did.

      The issues are as follows:

      1.  We ordered 12 aisle Gondola's at $200 each.  We only received enough parts to partially set up 10.  We do not have the top plates for 4.  We do not have parts to set up the remaining two.  We paid $200 for each 4 ft section for a total of $2,400.00.  We are missing two 4 foot section for a total of $400.00.  ******** can either ship us the parts for the two four foot sections, plus the additional top plates we do not have or refund us the $400 for the items not received.  ******** refuses to do either.

      2.  We ordered 6 end caps at $200 each.  We did not receive the parts to put up the any of the 6 end caps completely together.  ******** ********** states that he sent us parts for "hanging" end caps.  Not only do we not have parts for whatever "hanging" end caps are, in my 30 plus years of dealing with this shelving I have NEVER heard of hanging end caps.  On the Fixtures Wholesale website, they do not have a picture of any "hanging" end caps.  Only the pictures of the end caps that we ordered and did not receive.  See attached picture from the Wholesale Fixtures website showing the end caps they sell.  Again, ******** ********** can issue a refund for the missing end caps of $1,200.00 or he can reship complete end caps, with bases, to us.  ******** ********** refuses to do either.

      3.  We received 50 plus extra shelves that were not ours.  See attached picture.  This is going to cost us at least $500 to have taken to the dump.  ******** ********** has the choice to come pick up these extra shelves or pay us to dispose of them.

      We paid ******** ********** of ********** Liquidation Group aka Fixtures Wholesale $4,400.00 per the invoice.  I believe that ******** ********** intentionally and deliberately intends to deprive us of the items we purchased through his company.  I do believe that we are not the only ones that he has done this too.  ******** ********** only accepts checks emailed him for payment of the products he sells.  I am sure he does this so that the customer does not have the normal recourse through their credit card company when ******** ********** fails to provide the products ordered therefore breaching the contract.  We are out of state and I believe that ******** ********** thinks he can get away with his deceitful business practice due to the challenges we will have in collecting what is due to us. 

      ******** ********** continues to blame everyone else and refuses to take responsibility for his part in this.  We paid him for items that we did not receive.  It is Mohammed's responsibility by law to either provide with the items we purchased or issue us a refund.  ******** ********* refuses to do either or even discuss it with us.
