July 12 2021 529 thousand before scope of work. Kept using materials to pay early. My home is maybe halfway now being almost 2 years. We ************* in bear fire. They knocked on my door an promised promised promised a home in less than 9 months on contract. They told me I'm sorry I spent your money, I need time to make more to finish your home. On the 26th of June 2023 I fired ERI. They are scammers an go from disaster areas to prey on victims. There work is way below skill of any kind an no journeyman or skills. They lie over an over an next week never comes. I'm out probably 250 thousand that didn't go to my home. Not sure where it was spent. They only work a few days a month an I now how liens on my build. They claim my lumber package alone all by itself was over 400 thousand bucks!! An he didn't pay for it, they have liens an there are more so where did all those thousands of dollars go ??? I've asked for refund or finish job but after 2 years I can no longer wait as I'm living in 5th wheel going on 3 years an hardships are now a rising.Business Response

Elegant and Renovations **** started this project in 21 that is true but it took almost 6 months to get a permit issued as there were several changes. We signed the contract and engineering and the county took much longer than anticipated. Unfortunately we started this project right in the middle of COVID-19s worst, as well as in the middle of the toughest material crutch weve ever dealt with in our careers. There were several meetings made with our engineer and the Barclays, direct without our presence we had suggested possibly adding a bathroom, but never discussed price changes and of course that bathroom was added. There were also several windows added this project, of course was going right through the worst part of COVID-19 and of course through winter the town of ***** Creek unfortunately does not have very long *******, but cold snowy *******. This is our first time experiencing the weather up there. The house was **** ft. after all changes are made including a 576 square-foot garage a breezeway two covered porch is a 28 foot tall front wall with nine humongous windows needs to say the build should have been over $1 million that we try to keep within our customers budget the entire time, the amount of dirt removed pushed hauled to and from site was in the thousands of you cubic yards. The amount of concrete I believe was a truck and transfer loads possibly nine we were successful in pouring the foundation building this ******* of the house, completing all framing installing trusses sheeting walls, shearing installing roof sheathing facia boards soffits all that for windows that were back ordered or special ordered , we installed all the rough plumbing all the rough electrical approved for the **** to be installed and septic tank but over the course of several months we continue to get scrutinized, beat up and told how things were being done incorrectly by the Bartleys friends all along we knew the ultimate goal of theirs was to make us do all of the hard part and when there was just easy things left, they would take over the build to save themselves money and of course thats what we feels happened. Its unfortunate when you work with somebody that has an alternative motive the entire time we tried our hardest to work around all of their challenges and issues our last straw was nearly a year ago for $70,000. Therefore a company had worked for several months without any pay but yet being demanded that we continue doing things getting more done getting more done getting more done every day threats were made daily. He became difficult to work, however, we still remained steady to try to complete the goal. I ******** made a vast scission when we were told by them that they did not want us to finish the project. We told him an offer them we still wanted to in any way possible to complete the project, but their minds were made up. It was obvious for us. All of the hard stuff was done. It was now time to move us out of the way. We explain to them very clearly. Theyre on a custom home. This size is $100 per square foot just for the framing portion was very normal they could never get past this. They assumed that that framing shouldve been much less in cost in material, we were completely fair about this price again the structure was nearly 30 feet tall 96 feet long and over 60 feet wide. The house looks like a church were very sorry we know for a fact we dont owe any monies we just wouldve liked to of finish the project that we started and had the opportunity to do so. business collected *********************************************************** ******** ** business also talked me into a concrete slab job for a metal building at the same location home was moved to site and not permittred **************** states no permit will be issued due to the home is below their minimum square footage requirement town now is sending me citation notices and fines for work being done without permits this business has stopped responding and stole all my stated moneys leaving me with violations with the town and fines none of the work was completed nor was any moneys returnedBusiness Response

This is regarding case number ******** ***********************In response to the complaint, we just wanted to state that we took on the project first of initially just moving a small manufactured home from ********, ********** to ******** **********. not ****************** or ourselves knew that there was a square footage limitation to what size house the city of paradise would allow to be installed on a piece of property. We didnt find this information out until months after the home had already been moved when ****************** got a fine from the city, or a warning to give him a fine from the city to either move the house or have it as a second dwelling on the property during this time we not only paid for and had the small mobile home removed and prepared it for shipping by installing hitches Axles tires, removing gutters, air conditionings and putting as much supplies inside of the house and later, returning to pick up the supplies with truck and trailer and bring them to the city of Paradise home location But we also prepped the lot where the house was going to riding gravel cleared the lot did other site work as well as entering into a new contract to build a 30 x 40 shop and then doing so ****************** did give us a deposit as we already broke ground prior to monies being given. And as of right now the lot is almost prepped and ready for concrete just a little bit more work to be done. Then when we found out the city was not allowing the small mobile home to be the main dwelling, they also put a red flag and would not let us proceed on the shop or anything else Our company has felt bad about this and have a greed to pay ****************** back $20,000. ****** which he is already received in another Ten thousand dollars and H*** be receiving another $****** next week even though the work has been done were doing this as a goodwill gesture, because we do have sympathy, and feel bad for the campfire survivors that have been through enough already . ****************** has also stated to us that he will be removing his complete with the BBB. Hopefully this is good enough clarification and understanding an explanation for what is transpired. There are more details, but Id rather not for you with those. Hopefully this resolves the matter and we all can move on in a positive direction as we certainly hold zero grudges against anyone and want everybody to be OK thank you so much for reading and hopefully it wasnt too much troubles .Customer Answer

Contracted to build an in ground pool in July of 2021. Was told that it would take 6-8 weeks once permits were done. Permits approved October 2021. The company proceeded to dig a hole that remained just a hole for 6 months. Was told to pay money up front otherwise they would not finish. They came in to do trenching for plumbing and broke septic lines. They charged me 2k over the amount that the septic contractor charged. Later they told me that it would cost an extra $8800.00 to complete the pool. I paid the money because I wanted the pool to get finished. They completed the plumbing but did not pad the pipes, completed re bar but did not shape the pool how I requested, showed up with tile but not the tile that I chose, then completed gunnite. They also completed a water feature. And then we were at a stand still. Time just kept on passing and someone was always supposed to come out on "Tuesday or Wednesday" but no one ever showed up to complete the pool. ** July of 2022 they told me that they did not have a plan to complete the pool due to high prices. Told me to contact a different pool plaster person to finish the pool plaster and decking. We signed an agreement stating that he would pay me back $24,600 AND finish a pergola that was already paid for (Additional $6000.00) The new person I hired stated that the plumbing and electrical was incorrect and that the tile was not adhered correctly. When he poured the decking, tiles fell off resulting in me having to pay more to fix the tile. Additional work was supposed to be done in our yard, grading the dirt, fixing the fence, removal of rocks and debris. None of that happened. I had to hire dump trucks to bring in fill dirt, hire excavators to come move rocks and make numerous dump runs to even make our yard functional. We still do not have a started/completed pergola and I have not received a dime of the money that is supposed to be paid back to me. These guys are crooks & should not be allowed to take anymore money.Business Response

Some of what *************** saying is true we did start the project in July 2021. We had hired a subcontractor that built pools and unfortunately he went to ****** on vacation and they did not allow him to return for unknown reasons to **. We did spend several months trying to figure out how to proceed within the budget specked out for the project as the previous pool builder was going to do the entire pool for $56,000. We realized that no other pool builder was going to build it for anywhere near that amount. It was ERI. that went out and found a pool contractor we had used on a similar Project/situation and referred the pool contractor to ***************. We paid the ****** $24,000 and change and the project was completed summer of 2022. Our contract only was for the swimming pool and the Pergola. As far as dirt and rocks go we never had a design plan and we never had that as part of our estimate. As far as the septic goes, there was a septic ***** line that was not supposed to be in the area that we were building the pool, and we did not find it until we were digging the plumbing lines and ran into one of the leech lines that was the $2000 additional cost that was not our fault. It was actually not in the as builts with the city. Also as part of the agreement that ERI pay the entire cost of the additional amount of the pool build and the new pool contractor completing it. We also re stained their entire fence and fixed their fence, even though only a small section was removed by ERI. for Pool construction. We did in fact complete the Pergola and that was done. We also re-stained it two times we no longer owe any money or any work the matter is been closed and satisfied for well over 8 months. We honestly thought after completing everything she wouldve had this complaint removed. However its unfortunate because our company did go above and beyond the cost of our contract to make a client happy, and the result was this kind of a claim. I hope everyone can consider the matter closed as we have moved on and I know that they have enjoyed swimming in their new pool. Its beautiful by the way.
