    I planned to enroll my child to Encinitas shining star for this year and paid over $2000 including the first month's tuition, annual material fee and first-time enrollment fee last year because I was told that I need to pay ahead of time to get on the waiting list. I was told by the director that the first month tuition is refundable, but the annual material fee and first-time enrollment fee are non-refundable. I accepted that. This week, I emailed the daycare and told them that I decided not to send my kid to the daycare and would like to get the money back. Surprisingly, they told me that all the money is non-refundable! I feel like this is a scam. The contract I signed only said all fees are non-refundable but the first month tuition is listed separately not under the fee. I even had a phone conversation last year with the director about the fee and she said that the first month tuition is refundable. Now they changed their position and insist that the entire amount is non-refundable. I wanted to get the first month tuition back.

    We reserved a spot for our daughter in this daycare in Dec ************************ Spring 2022. We paid $1200 deposit plus pre-paid $1200 for the first month of tuition . Each month you pay the tuition for the following month (pre-pay). When we gave your 60 days notice of leaving (due to military orders) , the school is supposed to apply your pre-pay and deposit to the last months of care per contract, "One Month tuition deposit that is applied to the last month at school with a 60 day notice" is what the contract states We gave the school a 60 day notice of moving. The deposit was never applied to my daughter's last month of care, and we also were charged all the way until she left in July 2023. So since we pre-pay, the July 2023 payment was for August 2023 (even though her last day was at the end of July). Therefore Encinitas Shining Stars needs to reimburse us $2400. The contract also stated "Any adjustments to your accounting will be applied within 45 days of the departure from school)". After multiple attempts to receive our deposit and tuition reimbursement we kept getting excuses from the owner. Within the time that my daughter was enrolled, the school changed ownership. So the new owner states the previous owners should have the funds and continues to state "We are pursuing the matter as fast and best as we can." It has been over 5 months since my daughter was enrolled at this school. We are requesting we receive the reimbursement and the previous owner and current owner can resolve their issue on their own.
