    The company that I am a small minority partner in (DCB Performance Boats - ********, **) has used this company - Compensation Consultants - for many years as they handle (handled) our 401K plan as the **** My company (DCB Performance Boats - ********, **) sold to a new majority partner in June of 2023, and we moved our facility from ********, ** to *******, **, and the new company is named **********************. Apparently there was an outstanding invoice the the old company (DCB - ********) owed Compensation Consultants, that I was unaware of. And they did not inform me of, or contact me, until November of 2023 (5 months after) the change in ownership, about a past due invoice in the amount of $2,373. While I am trying to work out the legal logistics of paying a past due amount that was not represented during the sale of the company, I have not been in a position to pay this outstanding invoice. And unfortunately, the previous owner of DCB (********) was killed in a helicopter accident three weeks ago. So I have no short term avenues to try and get the $2,373 funds from his widow and/or their estate. Just for your validation concerns, please ****** "********** helicopter crash killed *****************" and you will see that I am quoted in the second paragraph. I attempted to explain to *************************** - owner of Compensation Consultants - the fact that (A) we received his invoice not only 11 months past the annual calendar year that the services were actually rendered, and that (B) it was five months after the official sale and relocation of the company, and (C) any discretionary funds to resolve this were now tied up due to the unexpected death of my previous business partner. *************************** told me, "I don't care what the excuse is, it's past due, and I am sending your name and SS to collections." I am writing/filing this, because I don't feel his position is ethical, given the circumstances, and want it documented under the BBB.

    Dear ****** at the BBB:
    In response to the complaint from Mr. *********************** about our services:
    We have been their Plan administrators (TPAs) performing the necessary services for ****'s Custom Boats, since before 2007 for their Retirement Plan.
    The company has been bought and sold several times over the years and again it was sold last year to DCB *******************
    **** in July informed us that he had sold the company over a month ago and apologized that he did not tell us. He requested that we complete the 2022 administration services for his Plan. We completed the required tax forms and supporting data for the filing of the 2022 Plan Year in October of 2023. An invoice for our services was mailed in November ************************** ********, as we unaware that the company moved to *******. When the invoice became past due, I called **** to see if there was a problem and resent the invoice to ******* as he said that he never received it. He said that it would be paid.
    In his email to our office, in December 2023 he said Yes, the new majority owners of DCB have put a new 401K plan into place, and will be handling everything.   So you are correct, we are terminating the old plan,and will no longer need your services for next year.   But THANK YOU for your tremendous help and customer service over the last few years!

    We sent a certified letter in December confirming our termination of services and requested again to be paid.
    A couple of weeks passed and in January **** I called **** about the payment to see if the check got lost in the mail and **** said that it was not going to get paid.  He wanted to give us another excuse. This is when I told him that I was going to turn it over to our collection people. He jokingly suggested that I send the invoice to his dead partner who passed away a few weeks ago, to which I replied that our engagement agreement was with him and his company.
    When I emailed him about his obligations and that this matter was going to collections, I got a response from his company that a check would be sent *** to us.
    I immediately canceled the collections service, waived the late fees and the account has now been paid in full. No further actions are warranted.
