  Estimate given in August 26, 2021. This was for water features with grado and walk behind including stain and sealer. The stairs were requested not to be seen from front not done. There was no design given for sunken bar and I sent a picture of how I wanted water feature to look like. I frequently asked for a design of sunken bar. ***** stated all will fit that I wanted and that it was custom. He sent pictures of other bars and water features he had done but never provided me with his custom design for mine. All I had in any design was the placement of hole and size outlined. I removed the privacy wall, landscaping, patio cover, and one fire bowl. A revised price was sent to me with my signature copied and pasted from original contract. The fire bowls were to have columns with stone and glass not done. they had one firebowl placed in waterfall feature using the concrete of water feature. The cost should have been reduced to $79000.
  The original and second estimate quoted a concrete bar top including fireplace, pizza oven and BBQ island. The fire place I understood would be in the BBQ island. This was placed in the outer counter and the island ***** stated was the swim up bar. I disagreed due to it stated on contract the bar top being the swim up bar, was a separate item on estimate not the island. On the second contract my signature was copied to he added a charge $3900 for sand fill to trenches, this is a required procedure to pass inspection should have been included in original cost. Also verbally told this would be done when originally contracted with company.
  A final bill was created August 11, 2022 a month after completion and final inspection of pool. Prices were changed and items were added. The drains flow to corner in backyard not to front area intended. The water feature was to have a fire bowl with column, stone and glass not done. The stairs to slide were to be behind water feature. The sunken pit never had a design. This contractor was over paid.

  She refuse to pay a balance on her request due to the fact she doesn’t have the funds to pay DG Construction. All she is requesting should be paid foe in full plus interest. There a active civil lawsuit so I can’t comment any further. Attached to this email are signatures of approval by ***** ****** . Nothing else to discuss, self explanatory.

   I am rejecting this response because: there was no Design submitted for the sunken bar. I had to already fix the slide and waterfall that cost $2600 incorrect drainage, and cracks throughout slide. The stairs to the sunken are not code. They are inconsistent they are 7 to 9 inches in code is 11. I have had to injuries my brother, and then myself now from those stairs. I would gladly pay if the job was done, correct and as I requested. I was told this would be fixed after August 14, 2022. After that day, I did not get anything fixed and just a demand for the final payment. I paid a majority to have this job done. Never had a design ask for a design given designs, and none of them is what was done. The only design close to my suck sunken bar. It has two islands, I have no island. None of what was done was agreed upon in design, except the waterfall, and even that failed to meet my request of the stairs going behind.
