      I am writing to formally lodge a complaint against Oportun **** regarding their failure to release $1273.50 owed to me despite multiple attempts on my part to recover these funds. The following outlines the issues I have encountered over the past six months:Account Closure and Inability to Update Information Electronically: My account number with ********************** **** changed, and I was unable to electronically update this information due to limitations within their system. As a result, I needed to shut down my account.Repeated Failures to Send Checks: I initially requested that Oportun **** send me a check for the funds owed, which they confirmed was processed. However, the check never arrived. Upon following up, I was informed that there was a "block" on the account, even though they had previously confirmed the check was sent.I went through the process a second time, ordering another check, but again, it never arrived.A third time, I was told I needed to provide additional documentation to receive the checks. After doing so, the checks still never arrived.Inadequate **************** and Refusal to Escalate: When I attempted to escalate the matter by requesting to speak with a supervisor, my request was ignored. Additionally, after multiple failed attempts to receive my funds, I was told that the checks had a stop payment placed on them and I needed to reorder them. However, because my account is now closed, the provided link to reorder the checks goes ********** has now been over six months since I initially ordered the first check.I request the BBBs assistance in ensuring Oportun **** takes immediate action to release the funds owed to me. I also request an investigation into whether this practice of blocking accounts, failing to deliver checks, and ignoring customer requests is systemic within their company.       Ive used Oportun in the past with no issue when it was Digit. A month ago I decided to get back on to save money for medical and rainy day issues. Ive added $1000 and have an emergency situation currently. Ive attempted to withdraw my own money straight to my bank and for the past 24 hours have had error issues gaining access to my money. I reached out to the email on the app and the person said they just couldnt see any issues. I mentioned this was an emergency situation and its been hours since Ive heard anything and no resolution or explanation as to why I cant access my own money. I found out that this has happened to others and just want to get my money out of this app.

      Over the past two and a half years, I have been trying to reconcile an unlawful and inaccurate account reported by ********************** *********************.       Reasons for Rejecting Oportuns Response:
      Failure to Address the Substance of My Dispute (FCRA Violation)
      I disputed Oportuns ongoing reporting of a charged-off account that is falsely represented as active on my credit report. Under the Fair Credit Reporting Act (FCRA), specifically 15 U.S.C. 1681i, creditors and consumer reporting agencies must conduct a reasonable investigation when a consumer disputes the accuracy of reported information. Instead of taking action, Oportun provided a superficial response without addressing the core issue, failing to meet their legal obligations under the *****
      Continued Reporting of a Charged-Off Debt as Active Debt

      According to federal tax regulations, specifically 26 CFR 6050P, forgiven or canceled debts must be reported to the *** as taxable income via Form 1099-C, which I have not received despite this debt being charged off in 2022. By continuing to report this debt as active without issuing the required tax documentation, Oportun is misleadingly representing the debt, violating both tax laws and federal guidelines for fair credit reporting.

      Breach of Privacy Under the *****-*****-****** Act (GBLA)
      Oportun has failed to provide the legally required opt-out notice, as mandated by the *****-*****-****** Act (GBLA). This act requires financial institutions to inform consumers of their right to opt out of third-party data sharing. Oportuns lack of compliance with this privacy mandate further demonstrates their disregard for consumer rights.

      Passive Debt Collection Practices Violation of the FDCPA
      By continuing to report a debt that I dispute as active, Oportun applies indirect pressure on me to resolve a debt that is no longer valid. Under the Fair Debt Collection Practices Act (FDCPA), 15 U.S.C. 1692a(6), passive debt collection practices are unlawful. Oportuns actions violate my rights by using coercive reporting practices to press for payment on an inaccurately reported debt.
      Requested Resolution:

      In light of Oportuns refusal to provide a meaningful response, as well as the multiple federal violations involved, I respectfully request that the BBB take action to ensure the deletion of this disputed account from my credit report.       I am rejecting this response because:

      I am formally rejecting the response provided by Oportun *********************, attached as Exhibit B, regarding their unauthorized reporting of my account information. *********************** response fails to address the core issue: the reporting of my information to consumer reporting agencies, commonly but incorrectly referred to as credit bureaus in their response, represents an unauthorized disclosure that violates our contract. This letter addresses the inaccuracies and contract breaches demonstrated by Oportun and reiterates my request for both deletion of the account information, full redaction of my information from consumer reporting agencies, and a settlement proposal to remedy the damage caused.

      1.Unauthorized Reporting to *************************** Breach of Contract. The contract Oportun and I signed states only that they may report information about [my] account to credit bureaus. However, the term credit bureau is not legally synonymous with consumer reporting agency (***) under the Fair Credit Reporting Act. CRAs, such as Experian, Equifax, and **********, are legally defined under federal law and are distinct from credit bureaus, a term with no recognized legal standing. In their final response, Oportun repeatedly refers to Experian and Equifax as credit bureaus, further highlighting that they lack explicit contractual authority to report my information to ****. This misuse of terms demonstrates Oportuns fundamental misunderstanding or disregard of the legal distinctions that govern consumer reporting and reinforces my argument that their reporting actions are unauthorized and in breach of our agreement.

      2.Privacy Violations Under the *****-*****-****** Act. The *****-*****-****** Act requires financial institutions to disclose and offer opt-out options before sharing a customers nonpublic personal information with third parties. Oportuns contract does not provide a clear or specific disclosure of intent to share my information with consumer reporting agencies, nor does it offer an opt-out option. The unauthorized dissemination of my nonpublic personal information to **** without my informed consent is a serious violation of my privacy rights under the GLBA.

      3.Failure to Honor the Arbitration Clause Before Adverse Actions. The contract also includes a binding arbitration clause that requires any disputes to be resolved through arbitration before adverse actions are taken. Rather than following this agreed process, Oportun prematurely reported adverse information to consumer reporting agencies, thereby disregarding our contractual terms and effectively punishing me without the required due process. Bypassing arbitration in favor of punitive reporting not only violates our agreement but also indicates a lack of good faith.

      4.Harm to My Creditworthiness and Financial Reputation Due to Unauthorized Reporting. Oportuns unauthorized reporting has directly harmed my creditworthiness and financial standing. Negative information on my credit report has limited my access to credit and impacted my financial reputation. The damage caused by this unauthorized reporting is both significant and lasting. This harm further demonstrates why both corrective action and compensation are warranted.


      Given these documented violations, I am formally requesting the following actions from Oportun:


      a. Immediate Deletion and Redaction of All Information from ***************************. I request that Oportun immediately instruct Experian, Equifax, **********, and any other consumer reporting agency to completely delete and redact all information related to my account. The contracts language does not authorize reporting to ****, making this disclosure a clear breach of contract and a violation of my rights.


      b. Settlement Proposal for Damages. I am requesting that Oportun proposes a settlement amount to compensate for the harm caused by their unauthorized reporting and the resulting damage to my creditworthiness. This settlement offer is contingent upon the deletion and redaction of all adverse information related to my account from all consumer reporting agencies and serves as an opportunity for Oportun to resolve this matter amicably and avoid future litigation.


      c. Written Confirmation of Compliance with Contractual and Legal Standards. I request that Oportun provide written confirmation of its compliance with federal privacy and consumer protection standards in future actions, including the Fair Credit Reporting Act and *****-*****-****** Act.


      The attached Exhibit B, Oportuns final response, underscores their reliance on the term credit bureaus to describe consumer reporting agencies. This repeated use of incorrect terminology weakens their claim of compliance and reflects an inaccurate application of our contract terms. I trust the BBB will recognize the serious nature of these violations and support my request for a fair and just resolution that includes deletion of unauthorized information, full redaction, and appropriate compensation.
