The company called demanding to speak with me about a attorney-client representation relationship. I was not aware she was misconducting herself at my first initial conversation with her attorneys but when I realized she was seeking a court ordered Lien against my assets in federal court my heart failed. I believe she planned to harass the community until she we had a *** lien relationship for her last chance to collect on a fraudulent debt with **.Business Response

I believe this to be either an erroneous complaint or a case of mistaken identity with regards to my firm. In order to assist further to investigate this matter I would require further details as to who contacted them, when it occurred and with regards to what business is this *** lien related.

*** contacted me regarding a UCC lien and refused to answer questions, began yelling and calling me a criminal. I've also received emails stating that he contacted my landlord and I was unable to get any information through the yells and insults. Thank you for giving me the opportunity to respond to the concerns of ****************. From my review she seems to be a very nice young lady running a small business that unfortunately is the point of concern. Our client who is a secured creditor of the business wants their rights under the *** lien protected and wants the immediate surrender of the secured collateral at the business known as BF Designs. Unfortunately **************** has chosen not to cooperate with her obligation in the voluntary surrender of the business as was agreed per the terms of the security agreement. We have tried several times to work with **************** to no avail. While we have offered **************** several *** Lien buyout options she has declined them all so far. Our client only wants what is due them under the *** Lien and security agreement and nothing more. I will reach out to **************** personally in hopes that we can find a solution that is reasonable and would work to meet her obligations. I want nothing but the best possible outcome for **************** given the difficulty of the circumstances and will work diligently to achieve that if possible.Customer Answer

This is very fictional. I have personally been called a criminal and thief by *** and have asked to speak to another representative. I have responded to all emails and even explains my concerns even as late as yesterday. My default on a loan does not constitute slander nor verbal abuse. If calls are monitored then should review ***'s calls with me. Yesterday **** called and I spoke to him for nearly a hour during which I also complained about *** where I was informed he was just "passionate". His behavior isn't passionate and will not ****** good results. He is a representative of the company and for that reason this company has failed.Initial Complaint

Thank you for brining this matter to our attention. The phone number in question was provided on formal documentation and also confirms via ******* records and other public searches as being absolutely accurate for the party we were attempting to reach in the normal course of business. ************ claims that the number does not belong to the party we were reaching out to but we have yet to see or be provided with any documentation to the contrary. We only reached out and left a couple of normal messages asking for a callback only from the party we were reaching out to. At no point was ************ or anyone else involved or requested to be involved in anyway shape or form. Of course in our pursuit of accuracy we are currently investigating the reason behind the discrepancy in records and no further calls will be made unless we get further confirmation that the number does in fact belong to the party we need to contact. If we do discover that the ******* and public records are simply inaccurate we will happy apologize in advance for the inconvenience ************ had in having to deal with a couple of messages. We would also implore ************ to reach out to ******* and the various public search engines that confirm the number belongs to the party we were contacting. ************************* has to be one of the most dishonest, disingenuous and unprofessional people I have had the displeasure of speaking with. Not only does she harass and stalk debtors (which is illegal in ******** where I am), I was berated after informing ******************** I was in the hospital. Then when I sent an email to her outlining how I can remedy the situation, she accused me of lying and playing games...despite an endless trail of emails proving the contrary. Last year, I had followed up with her several times and received no contact back. Then I receive an email I am copied on to an internal attorney saying to sue ********* I contacted her back, all I received was endless excuses and lies about our prior interaction. Yes, I was delinquent in taking care of this debt due to the pandemic. I am trying to resolve it now. But she insists on being condescending, arrogant, rude and accusatory with ZERO actual professionalism other than referencing people as Mr and Ms. *** actually berated me by email, sent me a follow up text AND voicemail which is not allowed in the *****************. You have to choose ONE way to communicate with folks and get permission to send emails and texts. *** did not obtain said permission.If the law firm can get back to me with another representative, I am more than happy to have this conversation and settle this debt. But being stalked, berated and spoken to like a petulant child is not going to resolve this matter.Business Response

I was recently contacted by L&M yesterday about a business line of credit I had with Kabbage. I was transferred to ******************* to discuss the line of credit.This *** is part of a criminal investigation with the **** Sheriffs, but she didn't care. I tried to explain that I did originally open this *** while at my former company, *************** But, when I left, my fmr business partner used my old email (I no longer had) and other info to go in to Kabbage and withdraw $. I know it's not fun to do collections, so I try to be nice but also explain the situation. She was excessively demeaning through the entire call, and even literally hung up on me mid-sentence. Even when I called back a minute after she hung up, she admitted to "terminating the call" if I wasn't going to pay. Call was 2:26pm ET and 2:36pm, 12-19-22.She accused me of having a fishy explanation since I had made payments on the *** before, and I explained that I had of course made payments when I was in control of the account. When I left the company, I understood there to be a $0 balance and I was not exactly expecting my former business partner to use my personal information/identity to take out money from Kabbage in my name. I have filed formal written complaints with the ***************************** OIG, and multiple other agencies, and Det. *********************** at **** ************* has the investigation. And goodness, look up court docs of my former business partner, *************************** - you'll see multiple liens against him for owing and taking money from others.If I had taken this balance out willfully from *******, I would absolutely pay it back. But I cannot in good conscience pay back something I did not even authorize.I explained I filed legal affidavits via certified mail and also included police reports to all 3 credit bureaus and ******* last year, and got no response. Back in 2016 i operated a business Allure Construction. A loan of $4500 was taken from Kabbage, shortly after this the company went under. The past month I have been getting harassed from Morgan and Lincoln via email , text and phone calls that they are placing liens against me for default. Due to covid I have not worked since and my wife just went back to working for the board of education in **, How can I stop them from this action.They offered me to pay 169 a month for ******************************************************************** to pay this. We are receiving threatening collection emails from this companies employee *****************************. We have had an attorney reach out to them/him and he gets the same treatment. We have asked for documentation pertaining to this collection and be refuses just keeps threatening us. We don't know what to do.Business Response

Thank you for bringing this matter to my attention. The situation is regarding equipment and collateral that is held under a *** lien filed with the State. Directly pertaining to the business of CW Mechanical, owned by the ************. We have politely and reasonably requested that the equipment and collateral that are secured by the *** lien be made available or surrendered voluntarily without issue. However, my understanding is that CW Mechanical refuses to comply with that legitimate request and instead has chosen to abscond with the secured collateral. All we require is the location of the collateral and we will pickup it up quickly and efficiently for everyones benefit.
