On 12/30/23, I received a withdraw rejection of $1068.37 from Pocket7Games application by AviaGames. My username is KelBel0320. Note an additional ~$300 remained in my account. The rejection stated the reason was "The account is banned." I contacted support and upon review of my inquiry I was told that my behavior violated the AviaGames Terms of Service. After getting additional clarification, I was pointed to a section of the terms and was told "Your account was banned because you have potentially inappropriate behavior..." and that I will not receive the remaining payments. At this point I was not provided further details because of "specific risk control rules". I've heard stories within the player's community of this company scamming other players, so I made sure to protect myself by recording all of my game sessions specifically for 21 Gold which I play most competitively. I appealed my account ban and explained how I have evidence to support I played fairly. Addition to my recorded game sessions, I compiled stats of outcomes and found irregularities with their matchmaking system proving it unfairly and consistently paired me up against bots or fake (not live players) based on the outcome of my match. Nonetheless, I'm primarily seeking to get my funds returned/available for withdraw and be able to continue playing on my account. After ******************** was made aware of the evidence Ive collected to defend my case, only then they decided to conduct an additional review which concluded by saying "Abnormalities are found in your game account by the anti-cheating system." My last communication explained how the game consistently gave me repeated "high scoring decks very frequently so of course I will be scoring higher than usual and could be the reason for their "anti-cheating system". Regardless, I have records to defend my case that I did not violate the terms of service. Not sure how AviaGames can completely ignore my defense with all the evidence and data.Business Response

I am rejecting this response because:Hi,
The section of the terms of service you provided in your response applies only if I conducted an act which altered my chances of winning or whether fraud was found and for this case and neither of those are true. You are only going off "detection of irregularities" with no validation to support. It appears you didn't acknowledge any of my complaint information. I have evidence to support I played fairly as I have recorded all of my game sessions. However, because your "anti-cheating system" detected irregularities on my account, you simply just assume I was cheating and don't consider any flaws from your end. I literally have everything to defend myself from being a victim but yet I find myself in this situation. I even offered an explanation of why your system may have detected "irregularities", but you have not acknowledged any of it. Your matchmaking is obviously flawed (likely intentionally to ensure profitability of your company) and the way I was matched for games, it was clear that I was given an advantage most games by your own matching algorithm. For whichever reason I would keep getting repeated decks to play or decks that were always tied to high scoring (guaranteed combo setups). These decks were, therefore, much easier to play and also repeated so I already had previous knowledge how to play it. I literally have records I can refer back to that showing how often decks were repeated and what dates they were used. After playing some so many times, I would get extremely high scores, with little to no possible way I could lose and yet I'd find at completion of the match, a score higher than mine... (no replay to review the play of course). I analyzed tons of data around this, and the stats don't lie. The frequency was more than just a coincidence.
I'd appreciate if my complaint can be taken more seriously, and my case be reviewed properly. I did not violate any terms of service by cheating or anything like that. I have evidence to defend my case and I don't understand how you can completely ignore that or even offer to go through a more thorough review. Any advantage I may have had was completely out of my control and in no way should I be penalized because of it. The alternative would be for me to intentionally play poorly when I receive a repeated deck which I understand is a direct violation of the terms of service so obviously I just played normally.

I am rejecting this response because:Please note that I first contacted Player Support on 12/30/23. I have exchanged several emails back and forth from then up to the last message I received from Player Support on 1/7/23. The last message I received from Player Support I was just told that abnormalities were found by the anti-cheating system. No validation or evidence was provided regarding this claim. If Player Support was actually helpful and didnt go radio silent once I started provided evidence of my appeal, I wouldnt be here submitting this complaint.
I had responded to Player Support explaining my hypothesis of why the system may have made this detection (as outlined in my previous communication for this complaint) and how I have evidence to PROVE I did not violate any terms of service. I dont understand how under this circumstance, I am still being ignored and dont have any indication that my case will properly be reviewed. If Im unable to resolve my issue with clear evidence to back it up, I dont understand how it would be possible for anyone to dispute wrongdoings by AviaGames.
Id appreciate if you would escalate this case further so it can be properly reviewed. I would be more than happy to provide any further details to support this review. Once again, *** recorded all of my game sessions because Ive heard so many stories of people being scammed playing on this platform. As part of my data collection process, I did come across evidence that your matching algorithm is unfair and either has bots or non-live players (e.g. scores assigned to me by the platform based on my final score and not based on a recent match from a player of similar skill) which I suppose would favor the platform if there are not enough actual players available to match. I have plenty of data to support these claims as well. I touched on this topic with Player Support which may have been the reason they were scared off from replying back. Id also be more than happy to go into further detail of this.

Was playing a game and thought I won money and sent it to my cash app and a total of $13.00 was taken out of a linked account which belongs to my husband. AviaGames advertises an $18 credit for users of their Solitaire Clash game (on Apple iOS devices) as part of a promotion designed to get users to link their bank account and/or PayPal, or in my case, VENMO account. They then mislead the user by directing them to a "Deposit Tab" with various options to select, whereupon I clicked on Venmo. Then, instead of AviaGames depositing the $18 into my Venmo account as advertised, a fee of $10 was withdrawn from my Venmo account.To resolve this matter, I called Venmo but they had no way to help resolve the matter without suspending my Venmo account to prevent any further fraudulent transactions. So, I reached out to AviaGames customer service who said it was my fault for selecting Deposit. They also said I already played games with the funds, but this is part of the trick - the user now thinks they are playing with the $18 promised by AviaGames, only to find out later that AviaGames TOOK the users money rather than gave them money to play with!!!!!! When attempting to discussing this further, the AviaGames chat agent logged off and I could not get any further support. This is further evidence that the company purposely engages in this fraudulent practice as a way to increase their revenues, as well as to show further bank account linking growth from their user base. This deceitful method of bating users with a cash promise, only to then take their funds, is an unfair "bait and switch" practice. I would not be surprised if there is already a related class action suit in process.To resolve this matter, AviaGames must:1. Refund my $10 - to my PayPal since my venmo has been closed (thanks to AviaGames fraudulent practices).2. I noticed on 01/06/24 charges to come through on my bank statement for avia games **** So I looked the contact information up online and sent customer support a message. They responded back that same day asking how they could help. I explained I had charges on my account that were not mine. They had me fill out a form and send it back. On 01/13/24 they responded with based on the information provided they could not approve the refund. So I asked them if I should contact my bank and they said I'm sorry that we could not approved your request based on the current information. And we highly recommend that you prioritize your device and payment method security to avoid this situation in the future as there is no way for us to know someone other than yourself is using your account. Exactly what information was used along with my card? And if it was my daughter doing this she did not have my authorization and they're under 18. Did it have this email attached to it? No... Just because a card authorization goes through that does NOT mean the person who owns the card authorized it. I did an experiment and I downloaded the app and went through the process of making a deposit and the only thing it does is ask for a date of birth and the next step you enter the card information. Anyone could use this app even underage children.

I was lead to believe that I could make money on this game by an add on instagram. Once I signed up it kept trying to get me to pay money to play it. I paid like $10.00 before I realized that it wasnt normal bingo it was some sort of gambling thing. It said that I had like $16 in the account. Bingo Tour is advertised as a fair game. They claim that youre playing against real people with a similar skill level. Clearly, that is not the case. I knew there was something fishy about the matches. I will get the highest score, then all of a sudden I would lose. The in-game items, diamonds and Gs, also did not seem consistent and fair. I then knew it was rigged I wanted to see if others thought the same way. I found out that they did. They have a current lawsuit against them claiming plagiarism and fraud with the use of bots. I decided to see for myself if the claims were meaningful. I decided to play a few more games and pay more attention to the players. I quickly realized that near all of my opponents had numbers after their name. Given that you can change your username to something unique, it is proof that they are using bots. I doubt everyone chose to put random numbers after their username. I attached some examples after I realized that I wanted to file a complaint. Each time I contacted them, they claimed that the game was fair. I am impulsive, so they duped me out of lots of money. However, Im glad to find out about their lawsuit and may justice be served. I would like some monetary compensation. Ill will admit that the game was fun, so I should not receive all the money that I had put into the game.Business Response

I am rejecting this response because:I do not believe you are telling the truth.
I almost always get in lower position after it is searching for 2 or 3 people. That is almost statistically impossible if it is a fair game.
After taking a closer look, I realized that the money entry games have the player usernames with numbers after it. The gem entry games have usernames that are more expected if actual humans were playing. Again, that pattern is statistically impossible.
That means other factors are at play besides simply being matched with players of similar skill.
I also find it suspicious that you do not want people to join the class action lawsuit. You either force people to opt out or to delete their account. Like almost everyone else, I agree to the terms without reading. If I was aware, I would have stopped playing. Everyone is innocent until proven guilty. However, forcing people into an ultimatum is always a cause for concern.
I simply do not believe you. I want some of my money back. Hopefully, law enforcement will look into your business practices in order to get the truth.

After downloading an app named Solitaire Clash by Avia Games **** i had opened a new account and had deposited $20 using my credit card. Then, I could not log into the account anymore and was told by customer service when contacted through email, was told Sorry, according to our policy, we can't disclose more details, please refer to the Terms of Service. Thank you for your understanding. I did not get any reply from chat support as attached and no resolution Nevertheless, no refund was provided and my credit card was charged. They have stolen tens of thousands of dollars. There algorithms are horrible. They let cheaters win. I had multiple people lose on purpose in low cost games and you can clearly see it on the replay. They do nothing about it. I was kidding 16 to 18 games out of 20. Every time I put in money, I won for 2 or 3 games thats it. They had the computer playing against me several times. I could never win. If I did, I lost my money quickly. I have been playing for over 2 years, which for 8 months I didnt play and my son who is 16 used my account after 6 months and they kept my credit cards on file and didnt ask for any notification that he was the correct one using it. However, if you suspect that your opponent has cheated in a match, we encourage you to report the Match ID to our Player Support team, who will investigate the matter promptly. We have a zero-tolerance policy for cheating, and any player found cheating will be banned from Avia apps.
To clarify, our algorithms attempt to match you with opponents of similar skill levels. And you play under the same game setup parameters as every other player in the same match.
