Federal Trade Commission v Sunil Kanda and Quynh Tran

On July 17, 2023, Sunil Kanda and Quynh Tran entered into a Stipulated Order for Civil Penalty Judgment, Permanent Injunction, and Other Relief with the Federal Trade Commission. The order settles allegations that the defendants participated in deceptive acts or practices in violation of the FTC Act and the Telemarketing Sales Rule, in connection with acquiring consumer data using websites purportedly offering consumers job or education opportunities and then selling the consumer data to third parties. Under terms of the order, the defendants are permanently restrained and enjoined from initiating, causing others to initiate or assisting others in initiating any outbound Telephone Call that plays or delivers a prerecorded message. The defendants are permanently restrained and enjoined from collecting and selling, transferring any consumer's covered information without clearly and conspicuously disclosing to the consumer. The defendants are mandated to provide disclosures on their employment sites. The defendants must pay a judgment in the amount of $913,696.
