Business put a lien on my boat because they said the did not know whos boat it is. My boat has been in storage for over 3 and a half years and in the water for 7 years. A new managment took over and they said they could not find the paperwork on my boat in storage and put out a news letter to find out who it was. My boat is California registered so they could of looked that up. This boat area has a club and I asked the memebers if they saw any news letter and no one has seen it. I sold the boat and now there is a lien on it from this business. I have always made my payments for storage and I have proof of all payments. When contacting the new managers they stated that since they did not know whos boat it was they had to put a lien on it. Now the new owner cant register the boat because of this lien. The company is refusing to remove the lien from my boat even though I made all my payments on time and never had a missed payment. Complaint taken in dictation by BBB rep **

Subject: Response to Recent Inquiry Regarding Vessel Ownership Matter

    Dear ******,

Thank you for reaching out and expressing your concerns regarding the recent issue with vessel ownership. I appreciate another opportunity to provide clarification and address the points raised in your communication.

As stated in my email on Wednesday, allow me once again to present the facts of what transpired:

    1. Fact: Due to previous mismanagement, identifying the owner of the vessel proved challenging for our team.

    2. Fact: We diligently pursued all available avenues, including sending multiple emails directly to tenants and posting notices on dock and bathroom doors, in an effort to locate the owner.

    3. Fact: Acting in accordance with legal protocols and in good faith, we proceeded to place a lien on the vessel that we had reasonable grounds to believe was abandoned.

    4. Fact: The owner, identified as yourself, came forward subsequent to the completion of the lien process.

    5. Fact: Upon verification of all payments being made on time and current, albeit not properly indicated in our system by previous staff, we  initiated the process of rescinding the lien by sending a notification through our processor to the appropriate authorities. There has never been in any form a denial or refusal to decline the lien on your vessel.

    6. Fact: While we understand the frustration regarding processing times, it's important to note that we do not have control over the speed at which the ********** of ***** Vehicles (DMV) processes such matters.

Furthermore, I want to emphasize that at no point did we approach you for any form of payment or request any additional actions from your end to release the lien. Our primary objective throughout this process has been to ensure compliance with legal requirements and to resolve the matter swiftly and fairly.

I apologize for any miscommunication or misunderstanding that *** have occurred, and I remain committed to addressing your concerns and resolving this issue to your satisfaction so long as that resolution is in my power to provide. Should you have any further questions or require additional information, please do not hesitate to contact me directly.

    Sincerely,

    ********
