      **** ** DBA Fireside ** was managing the rental of my **. They were responsible for the maintenance and upkeep of the **.They decided it was no longer in good enough shape to rent out so they returned the **.The ** was in terrible shape for example 1. The driver side front tire was bald as they failed to keep the ** maintained.2. There is missing items such as a window blind, the crank to raise the TV antenna, and TV remotes.3. They tore the dashboard up and plugged some random wire into the backup camera display. They plugged it into the power supply of the backup camera which is a Bluetooth system and they have ruined the system.4. The front cab security curtain is missing. It was a nice cloth curtain that could be velcroid to the drivers door, the windshield, and passenger door for privacy and to keep the sun off the dash. They replaced it with some cheap blind that doesn't even fit.5. The leveling system doesn't work even though they had charged me to repair it in the past.There are numerous other issues with the condition of the camper. I'm estimating it will take at least $2,000 or more to get the ** back in usable condition (which is what they were being paid to do, keep the ** clean and mechanically safe.

      It is unfortunate that Mr ***** feels as he does about how his vehicle was consigned overall.
      Mr ***** started his relationship consigning his vehicle with the previous owner of this Fireside Franchise. ***** and I purchased the franchise from the previous owner which whom provided additional services to Mr *****. Some of which we could not. Namely free storage of the *** The previous owner is an employee of the storage complex where the franchise is run out of and he could provide free storage there. We do not work for or with the storage complex and thus can not provide free storage. However, when told that this arrangement could no longer be held up Mr ***** was unwilling to discuss other options which our new ownership could assist with.
      However, in an attempt to keep the relationship copesetic we chose to foot the bill for storage. We chose this path forward because in receiving the franchise **** and the previous owner had let the ** get into very bad shape. Drawers broken and hanging, shower door broken, fabric torn, very dirty, sink leaky, stove top malfunctions and not safe to rent, tires bald, etc... By still renting and paying for storage we hoped to bring the unit in to more rentable repair. Out of our own pockets we fixed the drawers, etc... and hoped to recoup the costs through the rentals there after.
      The owner has a responsibility to assist in the maintenance of the ** and do regular inspections. We made phone calls which **** refused to answer for, emails which were not returned in order to request his normal visitation of the vehicle. 
      We have attached some of the parts, cost of tire replacements, etc... to the this complaint as well.
      Please note, in early April of 2024 a renter damaged the body of the ** which we field an insurance claim for repairs. The unit had become too much of a cost to keep up given we were now looking at a long delay between the damage and when the repair center could fix the unit. During peak season (spring through fall) ** repairs are months to schedule. This meant we could not rent the unit. With ****** refusal to take his ** off the lot, and refusal to pay for storage, he put us in a position of loss again.
      As the agreement states the franchise is not responsible for the losses, and the owner of the vehicle hold some responsibility as well in helping to resolve issues that occur during rental of their vehicle. **** never helped, even to alleviate his own concerns, like how long it takes to get body repair, by calling body shops that could take the unit sooner.
      As such he chose to complain about the time it takes to repair his ** and make threats. He could have helped by taking the unit to his own home, or storage until the repairs could be completed but he refused to provide any assistance, as agreed upon in the agreement he signed.
      Never the less, we continued to take the unnecessary costs upon ourselves in the meantime to remain as professional as possible with Mr *****.
      Items like the backup camera, etc... all were unworking when the unit was handed over to us in the beginning. His issues with the care of the unit are really with the previous owner. However Mr. ***** refuses to work to resolve that. He refused to inspect his vehicle in the beginning of our relationship with him, and has shown no desire to help with the costs for normal wear and tear. Please know, normal wear and tear is in the consignment agreement and specifically calls out fabric as an example which the owner understands will be their responsibility to care for when torn or replace when beyond repair.

      We ensured all bumper, side, etc.. body repair was completed. We fixed the drawers and a whole litany of interior issues which were all there prior to our taking over of the franchise, with no assistance from the owner, Mr *****.

      In spite of his unwillingness to hold up his side of the consignment agreement, we did not pursue him for the costs and time to resolve them. However, due to Mr ***** unresponsive and unwilling behavior to uphold his side of the agreement, and the ever climbing costs of his ** due to age, we chose to retire the unit from our consignment fleet.
      When we did so, due to Mr ***** refusal to pick up his own vehicle, we delivered it to his doorstep and gave him the keys, even then not producing a bill for his responsibility.
      It is unfortunate that given all of the evidence and conversation we had near the end of the relationship what he felt it necessary to complain to the BBB as he has done. I hope nothing but good for Mr ***** in his future. But want nothing to do with renting his ** any longer.
      We have great relationships with our other consigners and have many who are working on their 4th year with us complaint free. Those who have had issue with something that has occurred worked with us to resolve those issues amicably. As such we continue to have a fruitful relationship with them.

      I've asked for receipts but they were never sent.  They just **** **/Fireside said repair costs were being deducted from rentals but yet they claim to have paid out of their own pockets.   All I know is the condition it was in when I contacted with Fireside RV was listed as excellent.

      **** fakes was provided receipts for repairs that were deducted from his rentals, and those receipt copies were included in our initial response to this claim and I have attached them again here. The two above were provided to him via email on 6/4/24

      There were many repairs that we made at our on cost that we did not deduct from rents, therefore since they were not charged to ****, receipts were not provided as we had no intention to charge him for those items. As our initial response stated when we took over the management of his RV it was already in a state of disrepair, which **** was aware of as documented in the attached email communication.  I did meet with **** to discuss the repairs, as a result of that meeting I was provided with the new shower skylight which we installed.  I was assured he spoke with the previous owner regarding his other concerns regarding tires and hubcaps and that they had come to an agreement.  

      We did all we could to work with **** and address all of his concerns.  We put time and effort into making his RV a great rental.

      I am rejecting this response because:

      I was not told that my ** was in anything but excellent condition when ***** **** of **** **/Fireside RV Rental.  I wasn't even told that they had taken over the responsibility of renting out my ** until a friend of mine contacted Fireside to see about them renting her ** out.

       

      The receipt ***** attached was for an outside light and she has it valued at $25.99 which I paid for.

       

      The receipt ***** **** attached for $450 from ************** doesn't list what it was for.  As far as her statement of not giving me receipts, I paid for every repair that I was made aware of and I'm not sure why they aren't addressing the following facts:

      The backup camera is broken.  I believe ******* husband took the dash board apart and plugged some wires into a Bluetooth camera display instead of pairing it up.  The camera display power supply is missing and I've tried to talk to **** ** about getting the camera repaired but they continued to ignore my texts and phone calls.

      There are missing blinds in the dining area.

      ***** claims to have met with me and she was provided a new shower skylight.  I never provided this skylight so I'm not sure what she is talking about.

      As far as the previous "owner" that she refers to, that must be the previous Fireside ** manager (****) and I was under the impression **** ** was working with **** to address any issues.

      Also, the front drivers side tire is thread bare on the inside due to **** **/Fireside ** failing to maintain the condition of the ** which they were paid to do as part of the agreement.

      There are numerous other issues that ***** refuses to address and I had tried to meet with them before I took possession of the ** but they refused to meet with me.

       I'd like to know what ***** plans to resolve this issue.

      As indicated in the email communication from you, (attached again) which was our first communication with each other, you indicate that you thought your ** was in bad shape, I mention that having just taken over I needed more information because it condition was exactly how we received it.  The email chain even mentions you talking with the preivous owner.  That is the shape that we received it in from the previous owner of the Fireside Aurora location.  To imply that you thought it was in excellent condition while it was under our management is simply a lie, you were aware as proven by the attached communication.


      Here is a list of the repair items we noted when we took possession of the rental management;
      The backup camera was broken, it never functioned during the time we rented the ***  At no time did any partner or employee of Fireside Aurora take apart the dashboard or even attempt to fix the backup camera or its connections.  The previous owner of the Fireside location indicated that it had never worked and you were fully aware of that.
      The interior bathroom skylight was cracked.
      There were several drawers off hinges and with broken hinges
      The pots and pans and other owner required stock items dirty and broken. 
      The TV mount did not function to secure the TV while in motion. 
      There was a missing window shade above the dinette
      There was a missing privacy shade
      The fabric for the overcab bed was ripped and coming apart. 
      The drivers side mirror was not secure and prone to falling off while being driven. 
      The generator needed service.


      We did work with the previous owner who indicated you were aware of all the items in disrepair.  He provided us with the replacement skylight for the bathroom, and at no labor cost to you, we replaced the skylight.  However that is the only item we received from him for any repairs. 
      The agreement, signed by you, (attached here) states:


      Repairs related to normal wear and tear conducted by the FRANCHISEE or an authorized facility will be deducted from OWNER payouts.


      It also states the OWNER will reimburse FRANCHISEE for vehicle maintenance expenses, which may include but are not limited to oil changes,tire replacement, generator servicing, roof and window sealing and other routine keep up.

      It also state the The OWNER fully releases FRANCHISEE and its agents from any claims, liabilities, or causes of action related to the management, operation or rental of the **

      The last being a part of the contract you are in violation of simply by making this claim.

      The agreement also states that either party may terminate this Agreement at any time upon written notice. This notice was given to you in writing on 7/8/2024.

      The back tires were replaced under our management and I acknowledge that the front tires may need to be replaced, however that cost is your responsibility even if it was still an active rental with us as per the ** Rental Management agreement.

      We did not ignore any communication from you and found it difficult to even get a hold of you.  We have completed all repairs and routine maintenance for items or damages that occurred while we managed the unit.  We have terminated the rental contract per the guideline set forth in the ** Rental Managment Agreement.

      If you look at the contract I signed, my ** was in excellent condition.

      As far as the previous owner, I have owned this ** for the entire time **** **/Fireside managed the rental of it.  

      I trusted that if there were issues with the ** you would have let me know as that is how it has worked the entire time your company leased out the **.  I feel like you scavenged parts from the ** and reused them.
