    I have contacted the above HOA in writing multiple times by email and provided photos over the last year to no avail. Homeowner in the community tenants are using front porch and adjoining side yard for storage some items being stored and used are potential fire hazards. A few examples are (6ft outdoor space heater, fire pit) other improperly stored items include (child car seat, boxes, coolers, riding toys, basketball hoop, etc) the back gate is propped closed by large piece of plywood. The majority of the shrubs in the front are dead the home is unsightly and the homeowners/tenants are in violation the clutter continues to accumulate and nothing is being done.

    Dear ********************,

    As an acknowledgement, we have received numerous complaints from *******************. For clarification, a great deal of Ms. ***** concerns are personal opinion and not direct violation(s) of the Associations governing documents.  We would also like to clarify some details on the process all ******** Homeowner Associations must follow per ******** State Law and best practices the ************* Homeowner Associations abides by. Per the ******** State Law, owners must be notified in writing and sent certified mail providing an extensive duration for each violation to be rectified. In certain circumstances, owners may request a longer time frame to rectify violations which is at the discretion of the Association to allow or deny. The Association may also place fines, per violation, on the owners account due immediately.Should an owner not bring those violations into compliance by the rectify by date, those certified letters outlining the violations will be provided to the Associations legal counsel to take legal action.

    Certified mail letters have already been sent to the owner for those valid violations that were reported or observed by *******************. The Association has also been in contact with the owner and the owner has been responsive to the violation notices as some violations at this address have already been brought into compliance. The cooler placed on the front porch (used for dairy deliveries) and the propane heater unit are not in violation (nor is the heater a fire hazard-so long as it does not emit embers/spark,similar to the grill that is on the property). The plywood being placed at the fence line was the owners attempt to block the trash cans from street view. In this situation, an ARC request to install a trash screen/enclosure is necessary, per the covenants, which the owner has already submitted and is out for review by the committee. In the situation the enclosure/screening request is approved, the owner will have 30 days from the date of approval to install the fixture.

    It is totally inaccurate to imply that no action has been taken, as the Association has followed ******** State Law and the owner has been responsive and has provided pictures of the progress made to the Association.  Should any additional clarification be needed, the covenants are available for reference.

    Better Business Bureau:

    I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me. Within the last few days, the homeowner's tenants have removed most of the items listed from sight. Going forward, please ensure that the homeowner and/or their tenants continue to maintain the property's appearance and no longer improperly use the front porch or side yard for storage. And that they remove the plywood from the yard and that the trash/recycle bins are enclosed in a trash storage unit. Additionally, please make sure that the homeowner and/or their tenants replace all dead shrubs in the spring.
