    Unpursuable:
BBB is unable to locate the business.
    - The date the transaction took place from March 10,2023 - June 19, 2023.
    - The amount of money was $16,388
    - The business committed to provide a remodeled handicapped accessible bathroom.
    - The nature of the dispute is that initially the mirror fell off the wall and cracked the tile, sink and put a hole in the door. Mike came out to replace the mirror but did not fix sink or floor and did a patchwork job on the door. You can also see a gap between the wall and the mirror and it’s a different mirror from the previous one installed. The molding around the ceiling and floor are discolored. The vent/exhaust is blowing stuff around The pipes and electrical was to be replaced and now when you flush the toilet it is going all over the basement floor and now we have to get a plumber to fix what he should have fixed. When taking a shower the water goes all over the floor and it’s slippery. Also, the bathroom is not handicapped accessible no wheel chair or walker can fit through the door.
    - I have called multiple times left messages and texts but no more communication has taken place after the initial replacement of the mirror, on his end.

    Business Response

    Date: 12/17/2023

Level Head Carpentry, llc was contracted to provide a bathroom addressing the existing bathroom's inadequate showering system. The bathtub made bathing difficult.  We installed a curbless shower for this purpose.  I should also make mention that the client selected all of the materials.

Direct to the complaint:  First, Ms. ***** violated the terms of our contract by not paying her final invoice for a month and a half after delivery of the project, despite several contacts, about a month and a half after delivery of her bathroom. Immediately after receiving the final payment and threatening a lien, the bathroom mirror, after months of hanging in the same place, suddenly "fell" off the wall. it was obvious that the mirror was pulled off the wall as significant effort is required for it to fall. An apparent attempt to sabotage this project. Regardless, in good faith, I replaced the mirror at my cost, repaired a ding in the back of the closet door and epoxy'd the small scratch in the tile and counter. The discoloration of the grout and paint comes from dust and dirt.  The entire house is in disrepair, the basement floods every time it rains, soaking the carpets that never dry and harbor active and visual mold.  Because the client chose a polished tile, we added vinyl, nonslip appliques to the floor.  the cleaning products and grime caused them to discolor. I also returned to the residence  2 more times, to address the "dust coming out of the ceiling" and the "water on the floor" to find that her concerns were not valid and again, a complete waste time.

Level Head Carpentry prides ourselves on providing quality projects consisting of superb craftmanship. If there was an installation issue, or if we had damaged anything, we gladly stand by our warranty. It became apparent by the numerous unfinished projects, the disrepair of the home and constant water in the basement that this complaint is merely a way protect her state assistance.and get someone to pay for the mold remediation that will be required in her home.

    Complaint: ********

I am rejecting this response because:  DDS, the state agency in charge of releasing funds, released the money at the time that they released funds and I immediately gave funds in a bank check to Mr. S*********.  There were no communications from Mr. S********* regarding late/delayed funds.  I have saved all communications from Mr. S********* and I am not sure who he spoke to but it was not me.

In regards, to the mirror falling that Mr. S********* is eluding that we pulled off the wall after months of it hanging:  We have pictures of the cords behind the mirror that was holding it up and we have a witness, one of the ******* ********** workers was at our home to pick up my client and can attest that the mirror fell on its own.  After my client finished using the bathroom she was leaving the bathroom and the sound of something crashing to the floor was heard and when we opened the door the glass was everywhere and there was a crack in the tiles, sink (sink and tiles were not fixed) and the door (which he put putty on).  If my client had still been in the bathroom when it happened she could have been seriously injured.  No one pulled the mirror off of the wall in order to sabotage this project.  Mr. S********* did put putty on the cracks in the door however you can see the cracks.

The discoloration of the grout and paint is not from dust or dirt and cleaning products should not discolor the grout and appliqués, we believe this is due to Mr. S********* using old paint and grout to finish the job, as I believe if the grout and paint were the same then it would all be discolored.

In regards to my home being in disrepair, Mr. S********* was in charge of doing the bathroom not my basement (which is already being taken care of by a different contractor), which was none of his concern.

As previously stated cleaning products should not discolor non-slip appliqués.  The dust from the exhaust vent coming from the ceiling is due to Mr. S********* not replacing the vent properly.  The water on the floor is due to the fact that there is no stop on the floor to stop the water from going all over the bathroom floor when anyone takes a shower.  This is why I originally asked for glass shower doors.  The water comes out even while using the shower curtains.

Mr. S********* reports that we wasted his time in coming out to fix these issues.  These things would not be an issue if they were fixed properly the first time, so Mr. S********* wasted his own time.  When we tried to reach out to him to fix the work that we were still having issues with:  he would make appointments and not show up then eventually he stopped answering my communications to him all together.

Furthermore, Mr. S********* wrote a letter that serves as a warranty for the work he completed for one year on labor to continue through June 19, 2024.  This same letter also shows that he received final payment and “that this project is paid in full.  All liens are satisfied and released”  On the original contract, a pocket door for wheelchair access was supposed to be done, however it was not done and therefore the bathroom is not wheelchair accessible which was the reason we were upgrading the bathroom from the beginning.

    Sincerely,
