On 4/24/24, I contacted Court Mediation & Negotiations after receiving a mailer from them. I was listed as Defendant in a case from a debtor for an amount of $615.75. I paid $325.00 on 4/24 to Court Mediation to negotiate a settlement on my behalf . ************************* told me that as soon as we hung up he would be contacting the Plaintiff to advise that the case was in mediation and assured me that I did not have to be in court on 4/25 for the case. Upon checking my mail today I received notice that an Affidavit Judgment was issued against me for $615.75 + $79 in fees. I have reached out to ************************* at Court Mediation multiple times, to no avail. I will not have to file a Motion to Vacate judgement my own behalf for a service I never received from this company. I have all documents I have signed and returned to them.

Now comes Court Mediation & Negotiations to answer a false claim filed with the BBB.

Please be advised that ********************************* has misled the BBB in her complaint.

We engaged with ****************** to help her with her case that was in the District Court of ********. She contacted our firm less than 18 hours before her case which was before the Judge for money, she owed on a debt she did not pay. As required by law we sent her mediation documents to sign which she has never returned. She also makes reference that she has called our offices several times which is not true. We have only spoke with her once when we opened the mediation case to help her. She has never called us other than for us to open the mediation case for her, as we call logs. Within the time she called us, and the complaint filed with the BBB it has been only 8 business days. ****************** did not pay her bill for more than a year and then she files a complaint on Court Mediation when we are trying to help her. As you can see after 43 years in business and hundreds of thousands of mediation cases. we have 0 complaints other than this ridiculous and unfounded complaint. I have instructed our accounting offices to refund her $325.00 for the mediation of her case. I have contacted the attorney suing her to advise we are no longer involved in her case as we have terminated her and will never do business with her again.

My documents were mailed back to Court Mediation & Negotiations on 5/2/24. I explained to ************************* when I contracted the company that I had only just received notice from his company on 4/24 of the service they could provide. If they were unable to provide such a service the day before I was due to be in court, then a fee should not have been taken and I would have represented myself in court as planned on 4/25/24.

On 5/7/24, ************************* left me a long-winded voicemail wherein he calls my claim to the BBB ridiculous and is now threatening me with a suit for slander (all of my claims are factual) and promises me that this is not over. Voicemail attached. I am simply looking for a refund for services not rendered.

Transcriptions of voicemails rcv'd from ************************* on 4/24 & 5/6. Unable to upload audio file. Screenshots clearly show calls coming from business phone number as listed on paperwork received from and returned to business. Additional files to follow.

IMG_036 contains transcript of ************ threatening a retaliatory lawsuit against me for filing a claim with the BBB despite admitting that he reached out to the attorney from Unifund upon receiving my BBB complaint and, per ************, they (the plaintiffs lawyer) have been put on notice. This seems like a clear admission of services not rendered to me.

I have audio files from 4/24/24 & 5/6/24, but I am unable to upload them through this platform.

      Customer Answer

      Date: 05/13/2024

To date I have submitted multiple screenshots of voicemail transcripts left by ************************* dated 4/24 & 5/6/24. The first is ************ asking me to call him so he can discuss taking on my case, which I did and authorized payment to him for $325.00. On 5/6/24, ************ called and left me a voicemail after learning about my complaint to the BBB and threatened to file suit against me for slander. In the message he also stated that I would be receiving a refund within 3-5 days from the accounting department. To date, no refund has been issued. He also threatened that this is not over and that my claim for services not rendered is ridiculous. I still have the original voicemail files. I will continue to attempt to upload all supporting documents to the BBB, as I have done multiple times since last week.

I am rejecting this response because:

To date I have not received the refund I am requesting and was told I would be issued via voicemail by ************************* on 5/6/24 as submitted to the BBB. I have also been threatened by ************** via voicemail who assured me of retaliation as a result of my complaint to the BBB. Transcripts forwarded to BBB of original call from ************** offering his service the day before I was due in court (on 4/24/24) as well as on 5/6/24 when he learned of my filed complaint to the BBB. Original voicemail audio files available.

      Sincerely,

      *****************************

The refund was made by our accounting department. Sometimes it take 3 to 5 days for it to post to her account. Ms. ******* written response that she was threatened has no merit. The statement was made to her that she contacted the BBB without ever contact this office to discuss her issues. We stand by our original answer to the complaint. We also have ample documents and phone records to support our position. It appears that ****************** may have other issues that has nothing to do with this firm Her case is closed with this office, and she has been refund her $325.00. She has wasted our time. We will not respond any further to her issues, The court records speak for themselves. As stated before 43 years in business with 0 complaints.

I am rejecting this response because:

I have never filed a BBB complaint in my life. That this busines continues to hurl insults while stating that it is their choice to never do business with *me again is ***** and delusional; the feeling is more than mutual. Tip: You may want to think about matching your business address (the one listed on company letterhead) to the business address on listed on ****** Maps on ***************** in *******, MD, which has a mediocre-at-best 3-star review. For a company with such an impeccable record, you are nowhere to be found. To be certain, that no one has ever issued a complaint against this company does NOT make it the ratings powerhouse that is implied. It only means that no one else has bothered.

      Sincerely,
