    Company - *** Miller owner completed only ****** dollars worth of repairs, wont return our calls, refused registered mail at thr company address. Makes excuses when we did talk to him, he needed to talk with his employees. Majority of money given was for soffit replacement, he has done no work at all on our soffits. We are hurricane *** victims and had quite a bit of damage. He will not refund nor complete the work required. Name of parent business is *** and Miller contracting group LLC which did the work as Rain proofing roofing and contracting LLC.

    Signed (2) agreements, one for roof replacement, one for siding, soffit and fascia replacement on 4/20/2023 and paid 50% deposit with personal check in the amount of $30,000. *** Miller estimated one day for removal and one day for reroof, as well as a few days for the siding, soffit and fascia. Original date for start was week of 5/15 and metal roof materials were delivered by *** Miller on or about the week of 5/15. *** Miller advised that he had some small projects to complete and would then begin by end of month. Then, *** Miller advised that he had some personal problems and is wife *****, the owner of the company, left him and filed for divorce and he had to go to ********, ** but would start the job in early June. I asked for a meeting at ***** Eagle Preserve the second week of June but *** never showed up. *** said he was in ********* for work and would be back in mid June. I asked for a meeting on 6/19 or 6/20 but *** never showed up. Finally on 6/22 by phone *** assured me that his crew would start work on 6/29. I attempted to contact *** and finally spoke to with him 6/30 and he assured me that his crew had started work and he had to go to Naples to pick up materials for the work. On 6/30 he said his crew could not find the installation drawings and he would call me but did not. I called on 7/1 morning and *** promised a call after 10 am but did not. I contacted *** by phone 7/3 morning and *** admitted that his crew had not started nor performed any work at my house and could not get the installation drawing until 7/5 morning. He apologized for misleading me and promised to start the project on 7/5 and have everything completed by the end of the week. I relied on BBB rating for Rain Proof Roofing but have lost all confidence that Rain Proof Roofing will perform the work per the agreement.

    I am rejecting this response because:  Mr. ********************** promised on 7/5/23 that the work would be completed in 10 days.  On 7/11/23 he told me that the inspection by Charlotte County was scheduled for Friday 7/14/23 and job would be complete by 7/15/23 which did not happen.  On 7/18/23 he promised that the work would be complete by today.  I have attempted to contact Mr. ********************** by phone and text message but cannot get any response.  In addition to the roof replacement, the signed contracts also include complete soffit and fascia replacement and repairs to vinyl siding none of which have been started nor has Mr. ********************** provided any information regarding its status or completion.  It is unfortunate that Mr. ********************** has had personal problems, but Rain Proof Roofing needs to meet their contractual obligations and provide goods and services for which they have received payment.

    **************** is correct that Rain Proof Roofing has a contractual obligation to its customers even in the event of unfortunate circumstances. The roof requires 2 additional metal pieces that were subject to ordering at the supply house.  With reference to the inspections, an engineers letter will be submitted to Charlotte County once roof is completed.  Mr. ********************** will contact ****************.

    I am rejecting this response because:  The excuse that they are awaiting 2 pieces of metal was originally provided to me by Mr ********************** on 7/26/23 via text message and is their same response on 8/9/23.  The original delivery of metal roof materials occurred the week of 5/15/23 which was about 3-1/2 weeks after the contract date so the 2 pieces needed should have been delivered by now.  Also, I have not been contacted by Mr **********************, as promised in their response, nor has anyone from Rain Proof Roofing (***) contacted me.  I have made repeated phone calls and sent multiple text messages seeking completion of work and asking for a response but have not received any response from anyone.  A certified letter with return receipt was sent via **** making a written formal request to complete roof installation and commence with soffit, fascia and siding replacement and was delivered to *** at the ********** address on 8/12/23 but I have not received any response.  The fact that the work has not been completed and Mr ********************** and everyone else at *** continue to evade my written request, phone calls and text messages seeking progress seems to indicate that Mr ********************** and *** have abandoned the project and breached the contract.  I need the roof installation completed as well as the soffit, fascia and siding replacement commenced and completed as per the contracts, or I request a refund of the $30,000 deposit paid on 4/20/23 so I can have a reputable contractor provide the goods and services.

    I am rejecting this response because:  Repeated attempts to contact *** Miller at the number provided and he does not answer nor does he return calls or texts.  Address the problem that you accepted money and did not provide the work for which you were paid.  Provide the completed work or refund the money paid.
