      In 2019 we built our home in **************. We opted to install a pool, during negotiations in terms of screen enclosure my wife opted for an upgraded screen by Myrick vs the screen provided by the builder. Selling point was two fold, stronger construction and enhanced warranty of 10 years. During last few windstorms a small tear appeared. Called the installer, ****** Screen, and was told the claim needed to proceed through Myrick. I have paperwork that states Myrick was to install the screen however no paperwork from manufacturer about the warranty was included. Called Myrick and was told this screen was covered for only one year despite being told otherwise at the time of sale. I was also told I had to deal with the manufacturer of the screen. When I asked for the contact information for the screen manufacturer the Myrick *** was not forthcoming leaving me hanging. The person hung up on me. I had many issues with this contractor during the entire build.

      The customers pool and screen enclosure were covered by several different warranties, limited lifetime structural warranty from the manufacturer, a one year limited from Myrick Pools on equipment and material installation and the 10 Yr. Limited Warranty from the Manufacturer on your UltraScreen which is the MegaView portion of your pool. 

      Per the picture he sent to ****** Screen the damage to his screen is the corner just above the roof line. This portion of the screen is not the UltraScreen as that screening is only used on the front wall for your MegavView (as noted on page 2 of the contract). All other screening panels,  including the roof, are regular standard screening. Therefore the 10-yr limited warranty is not even applicable for this issue.

      Even with that being said, in his compliant to the BBB he states that the damage is due to "the last few windstorms", which means neither warranties are applicable for weather related issues (aka act of God) as spelled out in both the contract he signed with Myrick Pools (see attachment, section 7.B. Highlighted), or in the ************************;Warranty from the Manufacturer (see attachment, last page). 

      I would also like to address the disparaging comments he made to both ****** Screen and to the BBB...The fact my office was not forth coming with the contact information or that we hung up on you. That is simply not true, **** was trying to locate the phone number when he hung up on her. We have never had to provide this information to a customer before, so she did not have the number handy and was looking it up online. 

      I would ask or this case to be closed and I am also forwarding this information to our **** and he is filing a compliant that is a lie.

      I have tried to submit a response with attachments of his contract and the warranty, along with a picture. The system will not allow me to submit these items even through there are only 3 of them and under the 5MB size requirement. How can I get them to you?

      The issue of whether or not the pool finish was defective at closing 9/21/2022 or a result of scaling due to chemical inbalance. **** Pools who did the finish came and inspected the pool, they did not put a finger in the pool. When I received notification from Myrick that the issue was my fault I followed up with the inspector from **** Pools, he indicated that he did not tell Myrick that the pool had scaling. Myrick refused to fix the issue under warranty unless I paid them $1100 additiona. I contacted another reputable pool builder who inspected the pool and said there was no scaling, my pool cleaning services owner also confirmed no scaling on the pool. I had **** ********* Pools of ******* drain and acid wash the pool to get the finish to an even finish. they charged $1400 plus I will have an water bill fro mFGUA for the 11500 gallons of water to refill. Myrick installs equipment and then requires owners to deal directly with the equipment manufacturers. Their warranty service is almost non existent. I had also compalined about a potential leak in the pool. To date no action has been taken by them. At this point Im done with dealing with them as they have been impossible from the outset of the design(which they were incapable of doing - I had a client and prominent poolbuilder in Texas do the design and send to Myrick). A nightmare. *** ***** will not allow any other pool builders on new homes. They will do nothing to assist.
