    We had agreed on a contract to some work in my apartment. The majority of the work a demo of kitchen and replancement of whole kitchen. Cabinets, counter tops, back splash, etc.Paid GC $10,000 up front to order cabinets and begin demo of a wall and removal of cabinets . Paid him$5,000 to continue. He never delivered cabinets and rest of work needed to install and repair rest of line items in contract.

    Hello to all,

     

    First thing is that I'm not opposed to finishing the work that all.  I was contracted for the amount of $20,000.  All the demolition of the kitchen is completed, all the drywall work throughout the house is completed, The paint is completed, Kitchen cabinets has been ordered, I also install new kitchen in the living room which was additional work.  Our agreement with the owner was that I was going to leave $5,000 for retainage which is a lot but I was okay with that.  Now in extra work the owner owes me $2,250.00. including some modification he wanted for his cabinets that was extra.  I ask the owner for the $2,250.00 and he is refusing to pay me for work that has already been completed.  I need to pay my flooring and subcontractor and a portion of the modification of the cabinets.  The owner is refusing to pay me for me to continue and finish the project.  This is very frustrating because all I want to do is finish the job and all I'm asking is for the money that the job was completed.  He has giving me $15,000 but it was used to by material and pay the guys that worked in that apartment.  He still has $7,250 that he owes me which is fine because I'm not done with job.  All I ask is for $2,250 to pay my flooring guy and pay the portion I owe on the cabinets.

    I am rejecting this response because: He's not telling the truth

    We have tried to get him to order cabinets and even to pay him for the last 6 weeks and he only gives us the run around, not answering our calls, or text messages.  All he replies is i'm sorry for not getting back to you. I have told him point blank, we'll pay you the money once cabinets are here, to provide us needed security since he has not followed thru with his promises. We have asked, him, to just give us a day, a week, or when this is going to happen, and we get NO response. This as you can see (in attachment) has been going on for close to two months now. The $15,000 we've given him was more that enough for work that he's done, including ordering the cabinets. I've told him over and over again that we will pay him the $2,250 once he installs cabinets. As you can understand , we have lost all faith in his words since he's been dragging on along for over a month. He has Not finished painting, he has not finished most of the things on the list, and we've had to order handyman in our expense to complete and payed for other things that were included in contract. 

    At this point, we are looking for $5,000 reimbursement or for him to install the cabinets and we'll pay him the $2,250 he's asking. If none of the 2 terms are met, we will move forward with the legal process with counsel we've hired.
