    Pavers installment at my home with improper hardening in multitudes of random areas of polymeric sand and other random shoddy workmanship especially around edges Manufacturers representative of sand product made an in person visit along with Exotic Pavers and he advised redoing affected areas followed up by sealing.Exotic Pavers verbally agreed to such recommendations and to cover all costs of such to make job right with the manufacturers representative and myself as witnesses to this verbal guarantee and promise.Paver sealant company owner also advised same with in person visit and was also witness to Exotic Pavers verbal guarantee and promise to correct issues. Furthermore, I retain a 5 year warranty which is not being honored as I have placed Numerous phone calls texts and photos sent to Exotic Pavers with no response.I am seeking recommended repairs and paver sealant as promised and guaranteed by warranty.

    We installed your driveway to code and passed Final Inspection. We have Not expressed or implied a 5 year warranty since our contract states 1 year. You are not having any warranty issues after having Polymeric Sand which is Not covered under any warranty. The Representative for South Florida Gator Maxx  confirmed the polymeric sand was done perfectly. We recommended a Sealer Contact for you, but you sent him away. We do not seal and that is stated on our contract. You have made many erronious statements in your complaint and we always choose the high road at Exotic Pavers in doing right for our customers.

    I am rejecting this response because:

    I am attaching all proof below and therefore
    request my case/ complaint be reopened. These include
    my 5 year warranty not one year warranty and written proof that repairs were to be made.
    Furthermore, the manufacturer representative did not state the polymeric sand was done perfectly.
    He stated it needed to be reinstalled in affected areas and then sealed.
    Exotic Pavers did nothing but to offer total deflection to you regarding the  principal issue/Breach of Contract *All Labor
    5 year warranty not 1 year warranty on *All Labor
    and provided me in writing their agreement and confirmation of repairs to be made
    Furthermore ********************* never stated polymeric sand was done perfectly
    To the contrary he as well as **** stated all affected areas needed to be reinstalled and all pavers sealed
    This agreement/verbal contract to such was agreed to and made by Exotic Pavers at their expense with ********************* and **** being witnesses thereof.
    5 year warranty given due to Breach of Contract
    1. Entire walkway installed with incorrect material concrete not polymeric sand as per contract
    Entire walkway required removal and reinstallation
    2.Driveway dug to incorrect depth and filled with incorrect materials as per contract
    Driveway required re digging and refilling.

    We had previously sent **** who is an independent contractor and does NOT work for Exotic Pavers to do small Repair for you. He showed up at your house to do small repair in polymeric sand at Driveway which customer was notified prior to him arriving the day before, but she tuned him away the day he was there. Also we would like to note that customers awning was causing damage but we still agreed to take care of 2 small spots in driveway. We had agreed to pay **** to do small repair of 2 small spots in driveway and the customer sent him away. We have NEVER agreed to Pay for Pressure Wash & Seal which is another false accusation. The Polymeric Sand rep stated and I will repeat this again "The Job was done Perfectly" end quote. 

    We will send **** one more time to do 2 small spots in driveway with Customers Approval, but it is on customer to pay 100% if customer wants Pressure Wash & Seal of any and all areas. Your entire Walkway along with Driveway was installed to Code per ************************. and the Permit was APPROVED and closed out. 

    We are NOT looking to drag this out back and forth, and we have more than tried to satisfy you from the beginning like we do with ALL our customers.

    I am rejecting this response because:

    **** has never physically been to my property before during or after the work performed. Therefore, all his statements herein are heresay which by its very definition means information received by other people that one cannot adequately substantiate. Furthermore, the photographic evidence  I have presented in and of itself is substantiated and further shows that Marcs statements are incorrect as follows:

    1. **** stated there is a 1 year warranty when in fact I retain a 5 year warranty, a copy of which was sent to the BBB.

    2.The warranty statesAll Work is covered another misstatement by him.

    3. Written confirmation repairs were to be made and done so long before **** was involved. This confirmation was sent to the BBB.

    4. I retain a verbal contract between myself and *********************** wife witnessed by both **** and ********************* on two separate occasions. This contract was to re sand and apply sealer as both **** and ********************* recommended to make the job right.

    5. **** is incorrect regarding ****. **** was sent here as myself ****** and **** agreed that he do a test area only, as a preliminary to the full sealing. There was no appointment made another misstatement and **** arrived when no one was home. I can attach the text message I made to ****** regarding this test if necessary.

    6. **** is incorrect as to the necessary repairs. There are many more than 2 spots as he stated. There are a dozen cavernous trip hazards in the driveway alone; 3 of which are under the awning. There are also a multitude of areas throughout the remainder of the property along the walkways and the rear patio area all requiring repair. Photographic evidence submitted substantiates this and

    was texted both to ****** and *********************** son as well as to the BBB.

    7.Marcs statement regarding the manufacturer representative is false. ********************* never stated the sand was done perfectly and on the contrary recommended it be redone and sealed. And as I stated, both ********************* and **** were witnesses to ****** verbally accepting and agreeing to these recommendations covering the expense of such.
