I received a lien from Thomas Concrete of Georgia on February 29 for the price of the concrete for replacing my driveway on November 29. I had paid the contractor on November 29. I contacted the contractor and he sent me the electronic notification that he had paid Thomas Concrete on February 10th. I was able to contact ******************************* and explained the situation. She returned my call shortly saying I would have to work with the contractor to resolve. The contractor continued to say this should not have happened and he would resolve. His explanation was that he had not placed the invoice number on the check (it was the exact amount of the lien) and assumed had been applied to another bill. I tried to verify with ************************** 4 or 5 times but she would not take or return my calls. On March 21 the contractor explained he had sent another check to Thomas concrete and they agreed it was resolved. I have since called and left messages for ************************* requesting a lien release to verify that it had been paid. I explained that we were attempting to list the house for sale and the realtor requested that I obtain a lien release document from Thomas Concrete before listing. Again, I have called twice and left messages with ************************* to send me the document. She wont take my call or return my phone call. I understand the right to a mechanics lien, but Thomas Concrete has used bad business ethics in issuing the lien without warning and refusing to communicate with the property owner during the process. Also, based on the communication from the contractor, they have used improper accounting practices by not transferring the payment to the correct account all at the disadvantage of the contractor and homeowner throughout the process.
