    Proliant is a ***************** and Payroll processing company. We signed an agreement to have them prepare our quarterly employee payroll reports. Every single quarter in 2022, our Worker's Comp reports have been wrong and amendments have needed to be filed. We are still waiting for an amendment of the third quarter of 2022 that we informed them off before the report was due to the *************************** of ******************* It goes further, in December 2021, we informed them we needed to setup the ******************** for employees. We filed all necessary paperwork and sent it through their desired channels. After the first quarter reporting period was completed, we received a refund saying they did not have the information to remit payroll taxes to the state even though we asked them to update. All of these on going issues and lack of customer service drove us to look for another payroll company. We found one after they informed us they STILL hadn't amended the third quarter. We were told by our Account Specialized we would not be charged and Early Termination Fee and guess what we received today, and Early Termination Fee with only a 50% discount. At this point, we want them to finish filing all the reports we asked of them for the fourth quarter, year end reports, and file the amendments needed.

    Thanks.  The below addresses each of their issues:
     
    ** Tax ** Application:
    We did apply for the MS ************ ** but the agency sends the ** directly to the client.  We have no way to obtain that information other than from the client.  The client was billed for the process upon completion of the application.  During the period where we were not in receipt of the tax identification number we refunded the taxes we had collected to the client since we were unable to file or remit without the identification number.  There are warnings that present during the payroll verification process to remind the client of the missing identification numbers.  We also made requests for the number from the client.  Pursuant to our contract, it is the clients responsibility to provide us with the identification numbers.  For the MS withholding missing tax identification number, we could not complete the application without a completed Form CP575.  We notified the client of the need for the form, but never received it from the client.  The client completed the registration themselves and never submitted the tax identification number to us.  The client was never billed for the application since we did not complete it.  The tax payments for MS withholding were remitted to the tax agency under applied for status.
     
    WA ******* (Workers Comp):
    The amended return for **************************** ******* has been filed and a refund of the $17.61 overpayment has been requested to be sent to the taxpayer.
     
    Termination Fees:
    Termination fees were charged pursuant to our contract terms for failure to provide the contractually agreed upon notice of termination.

    I am rejecting this response because Proliant setup an online account with the ******************** for SUI on behalf of *******************.  This is where the tax identification number was sent to but because we did not receive the login, we could not retrieve the tax identification number for SUI until we asked Proliant for the login.  Once they provided the login, we were able to provide after the second quarter return was due.  We are still having issues with MS ****************** I would assume the same process that an online account with the Mississippi DOR was setup on behalf of *******************. but we have yet to be provided the login information.  We have tried to setup an account ourselves through the Mississippi DOR website but when we enter our EIN, it says we are already registered.  We did not register for an online account.  We have contacted the ******************** and we have told them documents we have available and have been told they would accept them, the articles of incorporation and the acceptance of the application to be treated as an S Corporation from the IRS.  These same documents were provided to Proliant but we still do not have resolution on the *********** Withholding.

    We have not been provided a copy of the amended Q3 ********************************* return.  I contacted ************************* yesterday and her response was she still had not heard from the tax team.  Additionally, at the beginning of 2022, on our first payroll, the experience rates were never updated and completely fell off our payroll, with no warnings, and our company had to pay the Employee L&I responsibility.  When they prepared the Q1 2022 return, they prepared it WITHOUT the first payroll hours and the first quarter had to be amended as well.  

    Further more, our fourth quarter Washington SUI return is incorrect.  We have had repeated issues with our officers not being listed on the quarterly reports.  Not listing the officers resulted in notices from **************** SUI that Proliant never did resolve and we ended up paying the interest and penalties to stop the accrual of additional penalties.

    We were assured by *************************, due to our ongoing issues, we would not be subject to the termination fees and that we would have access to Proliant until the end of January.  We are not being subject to a reactivation fee for their Time and Attendance system and were charged the termination fees to regain access to their system.
