On 8/20/2024 I was set to have my ***************** Ga. I had signed a contract for 50k. I did everything they told me to do and showed up on time. I had a fever blister on my lip and they saw it but still got me ready for surgery. IV was in and they were getting ready to sedate when they called it off for reschedule. I freaked out. They said that my herpes could spread to other patients. I have tried to cancel my surgery. They refuse to cancel my contract. They have been nothing but off putting. I have tried numerous routes but they will not listen or refund my money. The down payment is a wash but I want out of this contract before it comes due. August 30 is my first payment and I want out. I need help. As a patient do we not have rights?Business Response

Hello,
As it was explained to ********************* it can take up to 30 days to process a cancellation and refund. We follow a process here which requires the doctors to reach out to the patients before they can approve the cancellation process to start. The doctor was able to speak with ********************* today and express her concerns that she was not following through with the treatment. Now that it has been confirmed and signed off by the doctor the consultant for ********************* can start the cancellation and refund process. However, ********************* will not be receiving a full refund as some charges have already been accrued as she cancelled her procedure after the surgery was supposed to be completed. CRNA charges for the day of the surgery as well as lab charges for the fabrication of the temporary teeth molds that would have been completed on the day of the surgery. I have attached an account statement showing the accrued charges as well as the statement at the bottom of the account statement which states there would be non refundable charges.

They refused to do surgery that day. We did no labs. Everyone saw I had a cold sore from the moment we walked through the door and they still let me get hooked up to an iv. They said that I would spread herpes to other patients. I think that would b their job to make sure I didnt. Also they made me come off my mental meds for three weeks before surgery. I cant get my head wrapped around this again to go through what they put me thru. I talked to the ** and she said there were no expenses and I could have a full refund.

As I, your consultant, and a couple of the doctors explained over the phone to you, after further research on your condition it was in the best interest of you to not go through with the surgery that day. This had nothing to do with other patients. You and your husband both agreed it would be best to wait as well which is why the doctor sent in an RX to clear up the sore on your lip so that you could then return to complete a surgery that you are in need of. The lab work that was done was for the fabrication of your new teeth, since you are the one deciding to cancel your procedure after the teeth have been fabricated you have incurred these charges, along with your initial exam, charges for the **** that was brought in to complete your surgery and our surgeons cancellation fee. Your partial refund has been submitted and it can take up to 30 days for the lender to receive the funds and put them toward your balance. You are still responsible to making any payments to the lender until the loan is paid off. The doctor never told you that you would get all of your money back. We hope you get the treatment you need and we are here to complete it for you when you are ready. The funds we are keeping would be applied to any future treatment since we already did your exam and had your teeth fabricated.

I am rejecting this response because:
I know of a prescription. That is a lie. We were not given an option for surgery or not. My husband didnt agree to anything. After speaking directly to the surgeon last week who told me there are no teeth made I think I am not paying for non existent teeth. As for the other patients I was told in the chair by the surgeon that the cancellation was for me and the benefit of others so they would not get herpes. Direct quote. At no time has anyone said anything about prescription n this last week of contact of trying to reason with these horrible people. I will not be saddled with any debt. The surgeons cancelled. Not me nor my husband.

Clear choice could not perform the service I paid for. They promiissed to refund my money within 24 hours. Hello,
I am sorry this patient is experiencing issues with our company. Unfortunately a refund is not guaranteed within 24 hours because we can't process them at the center level, it has to go to our companies refund team. Our refund process can take up to 21 business days from time of notification that a patient has decided to cancel treatment. We also do not guarantee that they will receive their deposit of $1000 back, if they completed the initial exam which this patient did then the $1000.00 in non-refundable, but can be used to put toward future treatment should they ever need it. I have attached the account statement showing the exam was completed, please make note that at the bottom of the statement to does state that it is non-refundable.

Due to her making this a huge issue even though services were performed we have refunded her the $1000.00 which was done back on 8/22/2024. I paid over ****** dollars for implants, my tooth broke, while brushing my teeth, my wife implants does not fit, she is unhappy, we are in our first stage and they keep trying to get us to go to our final implant stage before they make corrections, we want them to correct our first stage before we go to our final stage dental implants. Patient was seen today 1/4/2024 for a repair and has another appointment schedule in 2 weeks. During the month of December we were out of the office due to a fire in our office building and for the holiday season. We were unable to see patients during that time. We just returned to the office on 1/3/24. This is the first time I am seeing this complaint come across my email or I would have responded earlier but as I said we were out of the office. We are getting patients in for repairs and appointments as fast as we can since our return to the office yesterday 1/3/24. This patient and his wife have always gotten in for appointments when we are available to do so. A fire in our office building is an unfortunate situation that was out of our control. As for his wife when she last had a visit she stated that overall she has had a good experience and had only one concern, she felt like too much gums were showing on her upper teeth. She was informed by the doctor at that visit that they would make those changes at her 4 month appt and took new impressions. She is schedule for that appointment in March.
