      We entered into a contract with *****************, Preferred Excavation on 5/22/22 for improvements to be done on our lot in *****************. *** sent ** an itemized bid including all work to be done and dollar amounts associated with each line item. We paid *** in 3 installments. The first two checks were paid to him after his services were completed. When we met on 10/9/22 we paid him for the remaining portions of the agreed upon work upfront before services were completed as requested by *** and he informed us he would complete the work once we got through the winter. We gave *** a check for $35,000. Check #**** dated 10.9.2022. The agreed upon work to still be completed based on the emailed and agreed upon bid from *** was: * Install septic system as it appears on permit - $15,000. (There is no septic system installed on our lot) * Provide culvert 16 inch in circumference 20 feet long - this was a portion of a line item totaling $5,000. We estimated completion and installation of culvert to be $2,500. (There is no new culvert in our driveway). * Excavate for foundation and install footing drain. Includes drain rock. 4 inch perforated pipe and geo fabric over footing drain to keep silt out of drain system. $8,750 (There is no foundation on our lot so this work could not have been completed). We met *** on May 20th at the lot to review condition post the winter. Agreed he is to prioritize the work that we've already paid for. Spoke on the phone May 30th again he confirmed he is good. Text on May 31st asking for his updated business license to provide to our lender, *** replied on 6.1 saying will be done today. Text *** on June 7th asking how its going - he responded saying 'I thought I told you to find someone else. I'll refund you any money I owe you'. Attempted multiple calls, text and emailed *** itemized work not done and refund he owes us. *** will not answer any outreach at this time. Everything documented via text and email.
