On August 15, 2024 I found out that the attorney assigned to my case did not submit the correct documents to the ******************* and thus my appeal was denied. I initially submitted a grievance asking Allsups manager to please rectify this careless mistake. The manager, assigned attorney and staff ridiculed and chastised me with microagressions and ableist language and no resolution. They then decided to retaliate against me for submitting a grievance and decided they did not want to assist me any longer and sent a letter stating they will not help me any further. I have now submitted a new claim with the pertinent records they mishandled. I believe their assistance with the new claim would be the right thing to do since they were careless.Business Response

I used Allsup to help me with my Social Security disability claim. I won the claim and in my contract they were only allowed to take $6000 as payment. Social Security overpaid them by $1200. And for almost a year, Allsup has come up with excuse after excuse after excuse on where my refund of the $1200 is, they refuse to send me the check. They claim that they have sent it to Social Security however, the people that I have spoke to at Social Security said that there has not been a check sent to them. I called again today and they acknowledge the fact again that they owe me the $1200 but again refused to send me the check for the money and claim that it has to go to Social Security. I know there is not the case because multiple people at Social Security had told me on multiple occasions that they need to directly cut me the check.Business Response

I have reviewed the business' response and am rejecting it because:
allsup tells you one thing and then the government tells you another. Its a never ending cycle of me not getting the money that is owed to me. All they need to do is cut the check to me instead of saying we sent it to social security who then tells me they dont have it. None of their checks have been received or cashed by social security. They need to make this right and pay me what they owe me.

For further clarification on the issue at hand, please refer to the following link: SSA Guidelines on Excess Fee Payments. The specific section to be highlighted is section C and states:
When SSA WILL Pursue Recovery of an Excess Fee Payment
Request that the representative refund the excess fee payment to SSA. The excess fee payment is a debt the representative owes to SSA, not to the claimant.
This section outlines the protocol for handling situations where an excess fee has been paid, which may be relevant to the matter at hand. In addition, we have attached a copy of the cashed check to help the claimant follow up on this matter.
Thank you for your understanding and cooperation.

I am very upset with how my case is being handled. Back in March/April when I was looking for an advocacy group to assist me with the filing Id my SSDI, the first question I asked them, before I even gave them my name was, do you work with ********, they are covering my fees for you to file my disability and their response was absolutely, we are partnered with ******** so we will get a referral from them, and they will pay your fees. I asked a second time when I had to esign my paperwork, and when I had to sign and agree to their fees, I asked why I had to sign this if ******** is paying them. They said This is customary, this is the fee that we charge, but in your case this is going to be ********* fee. I was then scheduled for a phone interview with my claims rep to go over my case and how she will be my go-to person for everything about my SSDI case. At this time I asked her also, and she also confirmed Allsup works with ********. This past Friday I was contacted by ******** saying that they still havent heard from Allsup And to contact them. Today I contacted them and got a call back stating that they now DONT work with ********. I wouldve never started this process with Allsup if I knew that they didnt partner with ******** to pay my fees. Now that I have been working with Allsup since March, I know its going to be difficult to just separate from then because I have gotten so far with them now. This is a text book definition for bait-and-switch. And the even more upsetting part is I referred my mom to you to help her with her disability case. What cant be done about this?Business Response
