    Date of Transaction: October 5, 2023 and November 2, 2023.Amount of Transaction: $4,800 On October 5, 2023 my husband and I entered into a verbal contract with ************************* and ********************************* of Windridge Farm LLC. The contract stated we would pay $4,800 (12% of the lease price of $40,000) upon completion of locating a horse for our daughter. This amount was paid on November 6, 2023 in full to Windridge Farm LLC. Unfortunately, the horse located was sent back to the the owner and trainer in December 2023 for non-performance. We respectfully requested via a demand letter $2,400 be refunded as the contract was not perfected in full. We were told "we are working on it." We have not heard from Windridge Farm LLC, *************************, ********************************* or their affiliates since and therefore I am requesting the BBB step in to assist us in retrieving the remaining commissions due to us.

    Windridge Farm LLC commission policy states that a 12% commission shall be paid on the purchase or lease of a new horse.  The Butlers received the written commission policy as part of the board agreement and fee schedule upon their arrival at Windridge Farm.  The Butlers acknowledged in writing the receipt of the board agreement and fee schedule.  The Butlers leased a horse for their daughter on or about 7/7/2021 and paid the commission per the agreement.  The Butlers entered into a horse new lease agreement with a third party on or about October 6, 2023 after trying the horse at a horse show and then bringing the horse to Windridge Farm for a trial period. After a full evaluation of the horse, the Butlers entered into the lease, paid the lease fee and paid the fully earned commission.  The lease provides in part "Lessee shall have the option to return the horse to Lessor prior to the end of the lease term.  . . . In no case will any fees be refunded for the unused lease time.", After two months of riding the leased horse, the Butlers returned it to the Lessor and Windridge Farm negotiated a second, replacement, horse for the Butlers at no additional cost.  The Butlers used the second horse for two additional months.  On or about February 21st, the Butlers returned the second horse and Windridge Farm helped negotiate a partial refund to the Butlers irrespective of the lease terms and at no additional cost to the ************** ************** for finding and negotiating the lease of a horse for the Butlers was fully earned and as the lease states, non-refundable.  Therefore, the request for a refund of the commission was denied in writing to the Butlers on or about 2/28/23.

    Please provide signed copies of lease from 2021, Celynos and *****. 

    The signed copy of the lease signed in 2021 doesn't apply to the two horses also listed above as these are separate contracts.
