I recently received a letter from ****** ********** ** **** ******* referencing Castaway Vacation Club. I received the same letter two years ago. At that time I called them. I requested they send me the contract they claim I have with them. I never received it. They are attempting to collect past dues from me of $3524. They say I signed a contract in 2007 and have not paid my dues. I do remember that years ago we purchased a plan from Discount Global Travel for $3,000. This is not this company. I do not believe there was any follow up dues required. I no longer have that contract. I knew they went out of business. Talking to Travel Department they say they bought my package from discount global The letter stated that they have had numerous phone calls with me - untrue - they also say they send me newsletters twice weekly via email. I do not delete emails. I have thousands! I did a search of my emails and have none from them. They claim they sent me one yesterday. I do not have it. I called them back to see if they have the correct email. They do. While on the phone I searched my junk file etc. no emails from them. So they propose that I pay them $398.00 to close the account and they will forgive the past dues. Sounds like a scam. I have now told them to send the contract to me through snail mail. They were pretty nasty. ******* said I must not have read my contract and that i was stupid not to read it. That conversation escalated very quickly. And I hung up after telling her off. There was no need to call me stupid. Later I spoke with Lindsey who was very
Polite and offered me to pay the $398. I spoke with a manager who was insistent this was my fault. If I wasn’t getting their emails it was my problem. Accused me of blocking their emails. I didn’t know that was possible, then claimed I was rude for interrupting her and hung up on me. I want this resolved I do not owe them anything. I have read numerous reviews online with the same complaints.

      Dispute resolution Department,

The consumer was told their membership account had been closed/cancelled on 9/21/22. Their purchase was through an Independent sales/marketing office (Discount Global) and their membership paperwork was never completed by that distributor.

******* ******* **** ****** ********* aka ****** ******; aka Funseekers was to provide several incentives items for attending a promotional presentation back in 2009 which were never given. In addition, they were to make available special travel offers.
We cancelled our membership after several months because the incentive items were never given as promised.
We advised ******* ****** that we would not continue our membership nor would we use their services which we have never used.
Our account number was ******** In the Membership Application they indicate that they would send a reminder 30 days before they would charge the annual membership fee which was at the time $199 per year. We never received any notification and if we did we would have advised them once again that we had cancelled our membership,. They would obviously know from their records that we never used their services.

It wasn't until July 2022 which was over a decade since our membership application was signed that we received a notice that our account was past due.

We would respectively request that ******* ******; aka ****** ******; aka ****** ******** send us a Mutual Settlement & Release Agreement like they did in July 2022. Please refer to the Agreement they sent in the attached file. However, in that Agreement they were requesting the sum of $398. We do not owe any amount and would request that they sign this Agreement with a sum of $.000 due. They should also state they will will not contact us or harass in any way in the future.

The ******* received free promotional gifts from the independent distributor for attending the sales meeting and had notified us of their problems in use of those free certificates and were directed back to the sales office where they were given those items. Those free gifts have nothing to do with the purchase of their ******* ****** membership package which we service and fulfill on all benefits listed in these membership membership contract paperwork. These members agreed to pay the yearly fees and were told several times that their issues with (free gifts) had nothing to do with the ******* ********** travel package and would have to work out any issues on those items with the independent distributor as previously explained. These members reasoning that because something free given to them was an issue should have in no way reflected on the services purchased in which we fully provide.

These members simply need to contact our office to either bring their membership account up to date or close it out through a fair settlement agreement as there is no record of a request to cancel by phone, email, or mail from these members. We have never stop billing, rebilling, sending letters of past due accruing balances and as a courtesy we called and emailed these members to no avail.

I am rejecting this response because:

Thanks for the reply.  As indicated in our previous message we have communicated the facts from
our perspective.  We honestly stated that
we have not received an invoice or bill for our annual fee.  We knew that we had cancelled our membership
over a decade ago.  I must ask what
prudent customers who allow themselves to be billed during the past decade for services
that we never used.  Yes, it was our decision
not to use ****** ****** and we did advise them accordingly.

We would also ask that this reply serve as another notice
that we want to close our account.  When
we talked to ******* ****** in July of this year they advised us that they would
send a copy of the Membership Application we signed in August 2009, which they
      did.

In July 2022 when we received a letter from ******* ****** advising us of a past due account we immediately called them and advised
them that we had cancelled our membership.

They also included a Mutual Settlement & Release
      Agreement Cancellation of Contract.  We
did not sign that Agreement because in the first paragraph it read as
follows:  This Mutual Release is being
made and concluded in ********** ******* ********* effective as the last date
stated below, by and between Travel Services, Inc aka Travel Center (TSI) and
****** *** ***** ***** *************, collectively “Parties.  We did not sign that Agreement because the
list of companies did not include ******* ******* the company that the
      membership application was signed with.

If ******* ****** is willing to update the first
paragraph of that Agreement and include ******* ****** in the list of other companies
indicated we would appreciate it if they would send us an updated version with
      that change.

My wife and I thought we canceled our membership in Tradewinds Vacations of ********** Illinois in 2012 and 2013 only to find that many years later they are harassing us for another $298 to cancel our membership. In March I received a letter from a business calling themselves Phoenix Vacations claiming my account was seriously overdue. Kind of surprising since I don't have an account with any company by that name. I just ignored it, but now have received a second letter stating the same and demanding I contact them to settle this past due account. I searched on the BBB website but could not find any listing for a company by that name at the address on the letter they sent. However, I did find a place in **********, ** called Funseekers with the same PO box as the outfit that contacted me. It sounds like a scam to me, and I wanted to report it and let you check into it. As I said, I am not now and, to my knowledge, never have been a member of Phoenix Vacations Travel Club or any other such organization. If you could check this company out and perhaps warn the public if it is a scam operation. Thank you for your help. ********************

We purchased a membership with SeaLand Travel Club in June of 2009 (i believe the cost was $199/year). We utilized it for a couple years and believed we had cancelled it in 2013 when we did not renew the membership and stopped paying the annual fee. We may have received a letter or two over the last 8 years asking about our membership, however we had not used it and were no longer being charged.
I received a call today stating that I owed $2,500 for dues from 2014-2022, including fees and inflationary adjustments each year. I asked to cancel it and they stated i needed a mutual release. I said at least cancel it from today going forward to stop any additional charges and they also stated they could not do that until I pay the past due fees, which seems absolutely ridiculous. I asked them to send me the signed contract proving I owe this which they have not sent (i have not searched my own documents yet to see if i have it somewhere). Instead they sent me this document attached for mutual release and requested $500 payment. It is signed by "the travel center" which is not who i contracted with the first time and the e-signature of the party is dated August 15th where they just called me and sent this to me today. I would like to have this cancelled with no amount due as I have not even contacted this company in 8 years, nor used any services.

I spoke with these members on 4/28/14 and **** ****** stated they had just had another baby and that she had gone back to school so no time to travel or money to travel with at this time. I did explain the unpaid dues accrue from year to year and those fees would have to be brought up to date. Then *** ****** spoke with another person in our office on 8/24/15 stating they were not going to be able to do anything now and he was told the same as I had relayed to Mrs. the year before. I then spoke with *** ****** on 3/18/16 and he stated not able to renew at this time and I went over the past dues and will have to pay up to current when renewing.

These members never requested to close/cancel their member at any time by phone, email or, mail. We never stop billing, rebilling, sending letter of accruing balances, and then an Audit letter all by mail. As previously stated we called and emailed the ******’s as a courtesy offering (then) current incentives to help them bring their account up to current to no avail.

The ******s need to contact our office to either bring there membership account up to current or close it out through a Mutual Release document having no further cost or obligations.

      Complaint: ********

I am rejecting this response because: We have not asked to renew and instead informed the company in 2014 that we would not be using their services and asked to cancel the membership. Rather than cancel, they simply stopped billing us and claim we owe previous years because they simply stopped billing. We have not heard from them since except for letters telling us we cannot use their services unless we bring the account current. We never utilized any services after 2014. We have asked several times to cancel and close our account which they refuse to do and state that we need to renew and bring our account active before we can cancel. We have not utilized any services and will not use services nor renew. If the Company denies our request to close the account and cease communications asking to pay for previous years “dues”, we will be forced to seek legal action.

      Sincerely,

About 11 years ago we went to a sales presentation for a vacation club that was supposed to save us thousands on vacation travel. We signed up and paid $1500. After checking about comparable vacations that we could obtain on our own, it was not a savings at all. I called to cancel, and had problems with the company, but I assumed our contract was settled. Yesterday, I received a letter stating we owed annual dues for the past 11 years amounting to over $2000. I called the company, they said our membership was never canceled, and we owed the money. I looked them up on your website, and found many complaints about this company trying to charge people for dues they didn't owe.

      Business Response

      Date: 09/01/2022

These members placed a cruise request and were quoted but then stated they were promised 50% off so then agent explained the savings can be up to 50% off on select cruises but will not be on all cruises then these members never responded back to agent on cruise quoting. The only other request was for a condo which our agent quoted then these members stated where they found pricing for less and our agent explained yes but that lower price was for a one bedroom unit and they requested a two bedroom which our agent had quoted. These members placed just these two request and made a false determination on the true benefits their membership would provide them. To compare pricing in travel it must be priced at the same time, for the exact same accommodations, and at the same location as any other price comparing would be unfair to the member, the membership benefits themselves, and to the agent doing all the work to provide the members with what they requested. We having never stop billing, rebilling sending letter of accruing past due balance, then an Audit letter all by mail. We also as a courtesy called and emailed these members offering (then) current incentives to help them bring their account up to date but they failed to respond to those attempts also. These members simply need to contact our office to either bring their membership account up to date or reach a fair settlement agreement to properly close/cancel their membership account through a Mutual Release document having no further cost or obligations!

I am rejecting this response because:

I do not wish to do business with this company any longer as they totally misrepresented their program at the presentation we attended.  As far as owing membership fees for 10 years plus interest, I have never used their service and tried to cancel several times, with no results.  We are seniors and feel they prey on people who are vulnerable.  I don' recall ever getting any bills or calls from them over the past 10 years. The initial amount we paid should have covered the cost of any quotes they made to us.  In light of all the complaints to the BBB, I can see we are not alone in our assessment of this business.

These members have only themselves to blame as they signed agreeing that they read, understood, and agreed to the terms within. These members also signed stating there was no other written or oral promises made that were contrary to what is listed in the Acknowledgement & Bylaws membership contract paperwork. Clearly when **** ***** called and told our agent that their cruises were all to be 50% off demonstrates either selective hearing or the *****'s part or they signed documents agreeing to the terms and conditions without reading and or understand the terms and conditions which again is on the purchaser to know what and how to utilize the travel membership package purchased ! These members simply need to contact our office to either bring their membership account up to date or reach a fair settlement agreement to properly close/cancel their membership account through a Mutual Release document having no further cost or obligations! WE WILL CONTINUE TO COLLECT ON THIS UNPAID PAST DUE MEMBERSHIP ACCOUNT JUST AS WE DO ON ALL MEMBERSHIP ACCOUNTS WHERE THE MEMBERS NEVER REQUESTED TO CLOSE/CANCEL THEIR MEMBERSHIP ACCOUNTS BUT SIMPLY TURNED THEIR BACK ON OUR ENDLESS ATTEPMTS TO RESOLVE THEIR OPEN ACCRUING BALANCES!

They stated they would bring their yearly fees up to date soon as they could. They have failed to respond to our endless attempts to collect on their annual fees as we billed, rebilled, sent letters of delinquency, also an Audit letter of their past due accruing balances. We called and emailed them as a courtesy we called and emailed them until they information on file became invalid and these members failed to keep their information up to date on their membership account. We will be sending a copy of the membership contract paperwork for their review but they should have retained those import binding agreement documents! my husband and went to a travel club presentation in 2010 and purchased a membership from ******* ******. I can't remember the exact cost, somewhere between $3000-$5000.. We tried to use it several times, but was unable to book any packages as they 'weren't available'...reached out to them (again in 2010) and they said to travel at a different time of the year or go to a different location. That was never mentioned in the presentation that we had to go somewhere no one else wanted to vacation! We told them we wanted to cancel our membership. At that time we also filed a complaint with the ***** ******** ********* office. After not hearing from them for 12 years, they're starting billing us in April 2022. $398 to stay a member or $398 to opt out and cancel our contract.
The 2nd notice was in May 2022, then the 3rd received in August 2022 was "Audit of your Past Due Account" stating that an audit for 2021 showed that we have a significant balance outstanding. They've claimed to have billed us 3 times by year (we have received NOTHING for 12 years). This is obviously an attempt to get money out of us. Because it's been so long ago (and we're now retired and have moved out of *****)..we don't have a copy of that original contract. I'm sure it was shredded after 7 years along with other old documents. I'm afraid if I contact them and complain, they'll attempt to collect 12 years worth of their membership fees. How do we stop this?

First, the *******'s purchased in 2009 and have never placed a request for travel with our travel office nor have they spoke with us in our endless attempts to reach out to them. We have billed, rebilled, and sent letters of past accruing fees along with a Audit letter of their membership account all by mail. Then as a courtesy we called and emailed these members offering (then) current incentives to help them bring their membership account up to date having no response from them. Again the *******'s have never requested to cancel by phone, email, or mail. These members simply need to contact our office to bring their account up to date or close it out through a fair settlement agreement by way of a Mutual Release document.

      Complaint: ********

I am rejecting this response because:

This company is not telling the truth about billing us, reaching out to us, etc. over a 12 year period. In 2010, I did place several calls trying to book a vacation and was not able to based on the availability.  in 2010, I filed a complaint with the ***** ******** ******** ****** about the company and their deceptive practices.  AT THAT TIME, I MADE A PHONE CALL TO ******* ****** AND ADVISED THAT WE WOULD NOT BE RENEWING OUR MEMBERSHIP.  I never heard from them again - no invoices, no past due notices, no phone calls.

My email address has not changed, my phone number has not changed since the late 1990's.

Even the BBB issued a statement in July 2021 warning customers to beware of their poor business practice: BBB continues to receive complaints about demand letters sent by **********, Illinois-based travel companies.

I've Googled ******* ****** and seen literally DOZENS of complaints exactly like mine from people who said they cancelled their membership and then 10+ years later have started receiving past due notices.  It's a scam and I will NOT be coerced into paying a debt that I do not owe.

Please remove me and my husband from the list of people you're trying to falsely obtain money from.

      Sincerely,

      ****** *******

As stated before to others, anyone can play follow the leader making the same kind of complaint in order to try and get out of a debt they agreed to pay and they too will have to reach a fair settlement agreement with us to close/cancel their membership. The only call to us from these members was for help with a free certificate/voucher they received from the independent sales/marketing office where the purchased the Matrix Travel Network travel package and we referred them to that office. These members did not place any travel request with our travel department so if they are confusing their attempts to try and use a free certificate from their distributor it would not have anything to do with us the travel provider/fulfillment company for what was purchased not something given to them to attend the meeting with their distributor. The was never a phone call, email, or mailing stating these members were not renewing their membership or requested to cancel, not one! These members have been billed, rebilled, and sent letters of past due accruing balances, and an Audit letter sent all by mail. We have (address services requested) on all our mail and have never received any return mail. Even if these members claimed to have never received a bill we as a courtesy had also called and emailed then. Additionally the day the signed they agreed to pay the yearly fees and this date was clearly outlined in their Membership Application paperwork in which they both signed stating the read, understood, and agreed to the term and conditions listed within. These members signed verifying that received a copy of all these documents so it was these members responsibility to know they have annual dues due each year on 11/18 as the membership paperwork contract states. These members had set their annual renewals up on a recurring electronic debit with their ******** ******* card but that card failed to process on their renewal date of 11/18/10 so we made many attempts to reach out to these members for a valid card to process the fees or have them mail a check for the renewal but again these members failed to respond. It proves nothing to re-create past billings but I can tell you we have a complete history of the dates their statements were generated then mailed as we do on all our members. Just as their paper work states, they were billed yearly 30-45 days before the yearly renewal of each year then they also received rebills when they failed to pay by their 11/18 renewal date. These complaints and been fully answered so the *******'s need to contact our office to reach a fair settlement agreement to properly close their membership account by Mutual Release having no further cost or obligations,

I am rejecting this response because:

I'm well aware of the free certificate we received from YOUR distributor.  That free trip has nothing to do with us being unable to book a vacation on the dates/locations we were seeking through ******* ******. I seriously doubt your records will show a 'no booking' call.  I made the calls personally and was advised to look at different dates and/or locations, which was never mentioned when we paid your distributor and signed up for the membership.  We were advised we could travel ANYWHERE, ANYTIME and that simply wasn't the case.

I'm sure you could fabricate records showing where you attempted to email, call and sent letters several times EACH of the PAST 12 YEARS, but that doesn't make it true.

I would like to request a copy of the Membership paperwork that you have with our signatures - all pages of the document.

      Sincerely,

      ****** *******

In December, 2013, ****** ***********, a company is ******** Florida selling memberships in a Travel Club presented us with an opportunity to join their travel club. This "club" would act as a travel agent, booking trips, vacations, holidays for us at a discounted price. Further, we would "share" in any rebates the "travel Club" would earn for the services we used. These services were to continue as long as we paid our "annual dues". In early March, 2018, we received a letter dated 03/02/2018, advising us that ****** no longer represented Island Trader and that if we wanted to continue travel concierge services we may do so by contacting Island Trader Vacations.
As we had become dissatisfied with the concierge services, we did NOT want to continue, so we did not contact them.
Their website indicates that our membership has expired.
Now Island Trader is claiming that while our access to services has expired, we are still responsible for annual dues into perpetuity unless we sell our membership to a third party!
They claim we currently owe $777.
We have not used their services in years.....they are billing us and advisiing all open unpaid balances are actively collected on.
      What recourse do we have?

      Business Response

      Date: 08/16/2022

First ****** *********** was just the Independent sales/marketing office that sold the Island Trader Vacations Travel membership package which we services. ****** was never to be the travel provider/fulfillment company as the membership contract paperwork agreement clearly states we are the fulfillment company/travel provider and the letter was stating that ****** no long sold the travel packages we services as they had business practices that were not in line with how the club provides services. The services were and are fully provided by us the fulfillment company also reminding members that the services and annual dues are strictly between the members and us not Jandar. The ******'s have 18 bookings through our Travel Center and continued to book many times after the 3/2/18 date listed in their complaint. The ******'s never requested to close/cancel their membership by phone, email, or mail. We have never stop billing, rebilling, sending letter of accruing balances, and Audit Letter requesting they contact our office to resolve their open unpaid accruing dues balances all by mail. Then as a courtesy we have called and emailed offering (then) current incentives to help them bring their membership account up to date but they failed to respond to this also! Only the services/benefits are suspended not the yearly fees when dues are unpaid. These members have an open unpaid membership account balance and simply need to contact our office to reach an agreement to either bring their membership account up to date or reach a fair settlement agreement to close/cancel through a Mutual Release document having no further cost or obligations.

These members have an open unpaid membership account balance and simply need to contact our office to reach an agreement to either bring their membership account up to date or reach a fair settlement agreement to close/cancel through a Mutual Release document having no further cost or obligations. Simply replying that they cancelled and no such record of that nor a Mutual Release document showing membership account was cancelled is a baseless statement. These members again need to contact our office!
