On September 18, 2023 I entered into a 12 month contract with Terraboost Media, for (2) Advertising Kiosks to be located within 2 separate grocery stores in ********, **. Terraboost has been paid in full, ($5400). The contract also is for a specific placement (location) at each store. *********** had promised that both Kiosks would be place by Nov - Dec 2023. At this time I had no issues with this, and looked forward to seeing the kiosks once they were set up - It was not after the first of the year that the kiosks were set up and since the initial placement I have been forced to monitor both stores on a regular because the kiosks continue to be either removed from the store, or moved to a less desirable location within the store; such as the exit or a corner somewhere within the store. Pleas note that I am not exaggerating, it is almost unbelievable. The customer support team does not reply to any of my emails or phone calls until after 5-7 attempts (If I am lucky). Additionally, once the kiosk is put in the correct location - (again my paid spot), typically days later it is moved again - so we are not almost into the month of May, and I have spent 5-6 months dealing with this. I would like to be left out the contract and received a partial refund - I am being generous, I just mentally can not deal with this anymore. And I don't want any other business owner to fall for this companies scam. It's really a shame - can you help?Business Response

I am rejecting this response because my ad has NOT been moved to contracted space, which the company states it has. On May 2nd I received a call from the company stating that they would be credit back $919 to me for inconvenience, and that I would receive an email recapping the detail of our conversation; the credit amount, and how we agree to move forward. Once I receive the email, and the credit which was promised I will then consider this issue as being resolved. At this time, I do not and my ad remains in the incorrect location.

My colleagues and I signed up to pay for kiosk ad space. We never got past the design phase as they did not provide any help or assistance. We gave up and consider our expense a loss and we want to move on. Now we want to make sure our account is canceled and that nothing is renewed. We have attempted to cancel online and the site is broken. Tried numerous times and received error messages and time out messages. Tried to call but when we called customer care, they transferred us to "***" and it immediately hung up. I signed up for TerraBoost in August 2023 for a 6 month campaign ($299/month plus some setup costs). With their input a great kiosk was designed and I thought this would be a great marketing move.They did not comply with their promises in the following ways...* The initial artwork was 1-2 months late (I cannot remember exactly)* When it initially went up, it was in the wrong location * Throughout the process, I didn't receive any inquiries or leads * One visit to the store, I found my kiosk moved to the wrong location and had to petition to get it moved back.* Nobody reached out to try to help me get better results. After several attempts, they did schedule me with a guy who told me this was more for branding and that if I want direct leads, I have to spend more money promoting it, which was never told me to begin with.* When I joined, they assured me someone would check on my kiosk periodically (I believe, monthly) to make sure it's OK.* They only respond when I reached out first (and even then, usually after 2-3 attempts)* 2 weeks ago I visited the location again. The kiosk was again moved to the wrong location and the bottom half of my display was missing. I have no idea how long or why it had been moved again. Evidence that, Terraboost has NOT been checking on it.* Since discovering that, I have reached out three times in the last week via email. I have a checker that tracks receipt and I see that my emails have been read. Not a single response or attempt at resolving the issue with me.Note: they did ***** a 3-month extension due to the late initial artwork. But now I'm getting notices that my artwork will expire after the original 6 months of being up and that I need to pay to continue so it sounds like they're not *****ing that after all.Thank you.Business Response

I am rejecting this response because there have been too many issues.1. There is lost time where the artwork was not on full display- nobody knows how long that was
2. There is lost time where the artwork was in display at the wrong location
3. It's obvious nobody is following up and checking the artwork as was promised.
4. This is one of many other instances and complaints I have had working with this company.
5. I still have not received any communication back, after multiple attempts. Terraboost is obviously not interested in providing any kind of customer service to me.
I had previously requested a refund because of so many errors. Terraboost talked me out of that by promising to extend the agreement 3 months. I am not interested in giving Terraboost yet another chance. This has gone on too long.
My request is a refund of my investment.

I am rejecting this response because:I have received one attempt to resolve this since ordering the dispute. And while I appreciate it, the only acceptable resolution for me is a return of the investment. I'm not sure what else to do or evidence to provide. I feel that based on the evidence I've provided and the broken promises, the right thing to do would be to refund the investment and part ways.
If TerraBoost is not willing to make good on refunding my investment, please just post that response on file and we can all end the resolution there. I really don't have time for any more discussion or another "make good" offer.

Please look at all the long history of issues, problems, attempts at communication and resolution in the past. Now that the complaint has been filed, they have fixed my kiosk and responded, but how long did it go unresolved? Why didn't their "person" catch it? What kind of "make good" have they offered for the lost time and misprint, missed exposure that was promised and for the kiosk repeatedly being placed in the wrong location? The only thing I have been offered was an extension but then I was notified that my artwork would expire at the original date, so I don't think that's even being carried out.
I could go on and on but don't have the time. At this point, the only satisfactory response (and the right thing to do) is a refund of some kind, even a partial refund. Something for all the time I've spent with their mistakes, oversights, missed promises, lack of communication/service, etc.If Terraboost is unwilling to offer some kind of financial restitution, please just close this case out here because I do not wish to spend any more time with it.

I entered into an agreement with Terraboost for the placement of my advertisements on two kiosks at the entrances of QFC Grocery. Despite making an initial payment and approving the ad's proof, there was a significant communication gap following that, and the store did not receive the advertised product. Eventually, I received an apology from Terraboost's customer service for the delay, along with assurances that the product would be dispatched promptly to ensure a full year of advertisement. At this point, I informed them that I was no longer associated with the company mentioned in the original ad, and they consented to update the advertisement with my new company's details. However, after another prolonged period of silence, I received a proof that incorrectly included both my new and former companies. I immediately communicated my disapproval of this proof and demanded a correction or a complete refund. Despite this, the incorrect ad was installed, and since then, my attempts to contact anyone at Terraboost have been unsuccessful. I was contacted by ****** at Terraboost on 07/21/2023 he proceeded to sell me 3 kiosk locations for advertising. One of the units went up properly. I reached out over the course 5 months regarding my other kiosks with no response. I contacted both ****** and their portal. In December I reached out to ******, ***** and ***** ( thru research of the chain ) . 1 more Kiosk appeared next to a meat station at the back of Kroger. My contract states Entry ( they are now stating the meat door is an entry ) I have texts from ****** confirming front door placement. I paid over $7000 for front door placement at all 3 locations to run concurrently on purpose. They refused to communicate in email and then I attempted phone communication and nothing. I want a full refund. I would not have purchased 1 single location nor would I have agreed to be placed next to a meat counter in a corner where no one goes. If I didn't frequent the area and hadn't seen no kiosks they would have never even tried to drop 2 kiosks randomly. They are dishonest, misleading and fraudulent. I have attempted resolution no less than 30 times. I paid $7338 plus interest on credit cards for months for no purpose.Business Response

I entered into a contract with Terraboost Media on April 7, 2023, for marketing services, specifically the installation of marketing artwork at designated locations ( Kroger grocery store) in *******, **. Despite multiple assurances from Terraboost Media and my compliance with payment obligations, the promised services were not rendered.Key Points of the Dispute:Contract Details: The agreement was for Terraboost Media to provide installation of marketing artwork at Kroger Grocery store in *******,** but the service were not delivered as promised.Failed Deliveries: Despite initiating contact with Terraboost Media representatives, and receiving multiple assurances of imminent completion, the artwork installation was never completed. These communications occurred on several occasions, with the first being on June 19, 2023, and subsequent follow-*** that yielded no tangible progress.Evidence of Non-Compliance: Upon receiving a claim from Terraboost Media on July 12, 2023, that the artwork was installed, a personal inspection conducted on July 31, 2023, revealed no such installation. On April 10, 2023, *************************** signed an advertising agreement with Terraboost Media to advertise ************ at the Kroger store located at ******************************************************** Following artwork approval, Terraboost installed the artwork onto the kiosk in the contracted store on July 12, 2023 (see attached photo).
In early August, the customer opened a customer support ticket with us informing us that his ad artwork was missing from the kiosk.
On August 30, 2023, *************************** disputed his completed contractual payments made via credit card dated 4/10/23, 6/10/23, and 7/20/23 and blocked payments for August 2023 through October 2023.
On October 11, 2023, Terraboost reinstalled the ad artwork. We provided *************************** with a photo report confirming the installation (see attached) and added two additional months to the contract to make up for the time the artwork was missing.
In January 2024, Terraboost sent *************************** a notice that his account was being sent to collections for nonpayment.
Terraboost Media met its obligations under the contract signed with *************************** and has provided proof of installation and reinstallation after the artwork went missing.

Despite assurances received on July 12th, 2023, regarding the installation of artwork, both my personal inspection on July 30th and further verification at a Kroger store on August 1st revealed no evidence of such installation. This directly contradicts Terraboost Media's assertion that the artwork was installed on July 12th. Moreover, my credit card was charged on July 20th, adding to my concerns.
The response from Terraboost Media on August 17th, which included a photograph previously sent to me on July 12th as purported proof of installation, fails to reconcile the clear discrepancies observed during my inspection and confirmed by the store manager. This issue transcends mere delay in service delivery, indicating a significant breach of trust and a lack of accountability in handling client communications.
Given the unresolved nature of these issues and Terraboost Media's apparent disregard for factual accuracy and responsive customer service, I see no viable path forward in maintaining our business relationship. I am rejecting this response provided by Terraboost Media for several reasons:
Firstly, despite Terraboost Media's claim of having installed the advertisement on July 12, 2023, my personal inspection in early August revealed the ad artwork was missing from the kiosk. This situation raises concerns about Terraboost Media's service reliability and their oversight of installed advertisements. The absence of the advertisement, discovered through personal inspection, highlights a significant accountability issue on Terraboost Media's part.Had I not conducted a personal inspection, this issue might have remained unnoticed, questioning the efficacy and accountability of their service.
Secondly, my decision to dispute the payment on July 20, 2023, was due to the artwork's absence, directly challenging Terraboost Media's fulfillment of our agreement. The dispute was a necessary action in response to a clear breach of contract by Terraboost Media.
Terraboost Media's subsequent actions, including the reinstallation of the artwork and the provision of photographic evidence, do not address the fundamental issue of the ad's initial absence. While I acknowledge their offer of adding two additional months to the contract, it does not rectify the oversight nor compensate for the potential impact loss due to the absence of the advertisement.
Given these circumstances, and the lack of assurance in Terraboost Media's ability to reliably monitor and ensure the continuous presence of advertisements, I find it impossible to trust their services moving forward. The initial failure to notice the missing advertisement until it was brought to my attention underscores a need for significant improvement in their service delivery and customer support.
Therefore, I reject ********************'s response, not with a request for further investigation or extending or additional months to the contract but to formally state my position and decision to discontinue any future business with Terraboost Media due to the unresolved trust and service reliability issues.

In April 2023 we signed up for service with Terraboost to advertise in two locations. Shortly into the contract we had some issues and to no resolve they never called back. I have reached out on multiple locations and want out of the contract and they tell me no. Ok, I have until April 6, 2024 so I will stick it out. I went into one of our locations, that we are under contract on, and they have replaced it with another vendor. This company is now in BREACH of our cntract and they need to let us out and I want the money I paid on January back ASAP, $460 and February $460 and no further monies due.Business Response

The artwork for the kiosks was approved by the customer on May 18, 2023 and installed on the kiosks on May 23, 2023 (please see provided photos).
On January 3, 2024, a Terraboost customer success manager reached out to ******************** in response to his request to cancel the campaign. When the customer was informed that the contract he signed was not cancellable, he replied that because his advertisements werent placed at the main entrance to the Kroger stores, we would be hearing from his attorney.
Terraboost Media dutifully delivered the services as outlined in the contract with the customer. The contract clearly states that the customer was purchasing the E2/right entrances at both Kroger locations.Customer Answer

I am rejecting this response because:They are lying, the pictures I sent in were from the SAME location on S Church St. They replaced my stand with another advertiser. What they don't understand is this is my local grocery store where I live and I heard from others that it was gone. I was just on the store on Saturday and it was magically back after this complaint. This is absolutely the worst company. Yes, I did reach out stating I would reach out to my lawyer because you were in breach and useless when I reached out over and over again. I reached out to my customer rep on multiple occasions trying to discuss the placement as we were sold on a completely different location with our sales rep. Attached are the emails I sent at the very beginning of this campaign.
FYI, this contract was signed on April 12th, 2023 and I did not get a response until they got a 'new' manager in January '24. Emails are ALSO attached.
I just want out of this crappy agreement. I could never run my business this way and would never choose to.

Terraboost media solicited me for advertising in CVS. After much back and forth of editing the marketing for my real estate information with Terraboost In CVS to match my branding & comply with state laws of real estate advertising, a completely different ad was put in CVS without my knowledge. My brokerage name was not displayed, there were no fair housing or MLS logos as required by the ***********, the color posted was blue and my brand colors are gold & black. There was a small plain blue sign that said my name and phone number with nothing else. This was reported to NJDOBI by another **************** almost fined me $10,000 for improper advertising. After pleading with Terraboost to let me out of the contract and services not being properly rendered , they put my account into collections for over $3,000. This has caused my credit score to drop and has impeded with my own home purchasing. Horrible company causing much anguish.Business Response

In September 2022, our customer support team made multiple attempts via email and telephone to connect with her to get her advertising artwork process started. In November 2022, ************ had still not submitted artwork for her campaign, and our team contacted her to inform her that her payment method had failed and to review her contract and associated costs. ************ asked to update her payment method.
In January 2023, ************ told Terraboost she should not be responsible for her contract and requested that it be canceled. Terraboost created a generic ad for ************, as required by the contract, which was installed on January 19, 2023. On March 20, 2023, Terraboost Media sent ************** account to collections for nonpayment.

I am rejecting this response because:I had multiple communications via e-mail to revise the proposed designs, I was also in their portal communicating back and forth with the design team to correct my designs. It took months to get the advertisement actually running all the while I was paying for advertisement that was not running. Even after tons of communication to them about my brand colors & legalities of real estate advertising, Terraboost made a horrible ad not in alignment with anything that we discussed. I then stopped paying because of their failure to execute our contract. This company is simply a scam.
Pursuant to the contract paragraph #4, if the advertiser does not approve within time set forth (2 weeks) that TBM will use submitted proof if any as the ad publication.---- proofs vs what was advertised are 2 completely different designs. The ad put in the store was RED and advertised hand wipes. I am a real estate business & my colors are black, gold, white which is what had been proposed as a draft with a photo of my headshot.
TBM received 2 proofs that we were working on and had 2 way communication about. The advertisement was not put into the store and what you have sent as "proof" of advertisement is not nearly close to the proofs originally submitted, nor is it compliant with the real estate commission which was a lengthy discussion through TBS website where I submitted compliant proofs.
TBM should have placed my advertisement in CVS within 2 weeks PER THEIR CONTRACT. I paid for months without any advertising taking place. This was signed in September 2023.
As of april 2023 the ad was still NOT placed.
TBM is and has been in breach of their contract since at least October 12th 2023.

Terraboost Media stands by our previous response. In September 2022, our customer support team made multiple attempts via email and telephone to connect with her to get her advertising artwork process started.
She says herself in her response rejection that she stopped communicating with Terraboost about her artwork and then stopped making her payments.
In November 2022, ************ had still not approved the artwork for her campaign, and our team contacted her to inform her that her payment method had failed and to review her contract and associated costs. ************ asked that we send her a link to update her payment method. In January 2023, ************ told Terraboost support that she should not be responsible for her contract and requested that it be canceled. Since her artwork had not been approved, Terraboost created a generic ad for ************, as required by the contract, which was installed on January 19, 2023. On March 20, 2023, Terraboost Media sent ************** account to collections for nonpayment.
Again, Terraboost Media met its obligations under the contract. Had ************ continued to worked with us to get her advertising artwork ready for approval, we would not have installed the generic artwork that the contract requires.

Dear Better Business Bureau,I am writing to file a formal complaint against Teraboost regarding unauthorized charges and failure to provide promised services. Despite repeated attempts to rectify the situation, ********* has continued to charge my credit card without my approval based on on an initial contract signed and has failed to deliver the services as advertised.I initially signed up for services with Teraboost under the understanding that I would have control over the design and deployment of promotional materials. Despite my efforts to communicate with ********* about the inaccuracies in the advertised name and the absence of the promised kiosk, they have disregarded my concerns and continued to threaten collection actions.I have provided Teraboost with a video and pictures demonstrating the lack of the promised kioks in front of a Krogers entrance I thought this matter was resolved since March yet they claim that this is all my fault and printed generic prints with my legal name that should not be out there in place of my business **** name and the incorrect advertising name. Despite this evidence, they have failed to acknowledge their shortcomings and have continued to demand payment for services that have not been provided.It is unacceptable for Teraboost to continue charging for services that they have failed to deliver. This is a Scam. I would like an email from them stating that they will not attempt to charge and send this to the credit bureau. They have not reached out.Despite my attempts to communicate with Terraboost Media, in the beginning, when the self started the company has not addressed my concerns regarding unauthorized charges and the failure to deliver the promised services. That I get to approve that ad and it would be the only ad in front of ******* . We stand by our original statement regarding Terraboost Media's performance under the contract signed by **************************.
In March 2023, ************************** signed a contract with Terraboost Media for a 12-month advertising campaign. After contacting her multiple times by multiple departments during March and April 2023, the client refused to submit and approve her advertising artwork. On May 30, 2023, the client contacted Terraboost support to request cancellation and refund and was informed that her contract was not cancellable. As the signed contract requires, in August 2023 we installed generic artwork on the contracted kiosk which is scheduled to run through July 2024.
On February 8, 2024, we emailed ************************** about her past due payments from August through December 2023 and January 2024. On February 9, 2024, we provided ************************** a photo of the kiosk in the contracted Kroger store via email. Upon seeing the generic artwork, ************************** still did not provide us with corrected art, but instead falsely claimed that she had cancelled the contract, continued to refuse to make her contractual payments, and threatened legal action.
Terraboost Media performed its obligations under the contract signed by ************************** and has reached out to her multiple times to obtain her artwork. Her refusal to provide the required artwork followed by her refusal to make the contracted payments are at the root of the issues in her complaint.

However, when we spot-checked and went to one location, the advertisement was not there. This was confirmed by the store manager. Thus, Terraboost either a) sent fraudulent pictures or b) took pictures and then removed the installation giving it to another advertiser to maximize revenue.- This was brought to the attention of Sales Director, *******************, who acknowledged Terraboost was at fault and agreed to make November 21 the start date of our entire campaign and added two additional months to our overall campaign (all placements) on November 2023meaning the end date was now the end of April 2024.- In January 2024, it came to our attention that a placement (at a different location from the first incident) had been removed from the storedirectly contradicting the addendum to the contract.As a result, our campaign efforts suffered, and we're looking for a refund as the terms in the contract were broken and the addendum was also broken.Business Response

All ads weren't live until November 21 (please see attached screenshot of email from *******************).They also never provided proof that advertisements were re-installed in February. The delays and untruthfulness from Terraboost impacted our campaign negatively and free placements (which they've proven can't be trusted) are not helpful.

I am rejecting this response because: The response misrepresents the facts. Terraboost did not meet its contractual obligation to vybe because the media did not run for the correct period or duration.Terraboost did not install all 6 locations on 9/29/23, despite their team reporting they had done so. For example, on 10/23/32 we received a note from Terraboost that 2 items had just been installed, almost a month later than 9/29. In another example, a Giant store in Radnor, we informed them on 11/3/23 the advertising still had not visible. On 11/8,Terraboost said it had been installed, but on 11/11, we visited the store and spoke to the manager who said it had never been installed. For each discrepancy, we were able to visit the locations and verify our ads were missing. Terraboost was not quick to fix their mistakes, and in fact, it took multiple emails from vybe to get all our media installed. Acknowledging their error, Terraboost's sales manager offered to extend our placements to cover the missing time AND offered us 2 additional free months as a "make good". However, they removed our advertising prematurely even after making this offer, and this is when we began asking for a refund for the media that did not run for the full contract. We contacted them multiple times to find a solution, and they did not respond to messages indicating we would file this complaint.
