    I am the Board President of Landmark Lofts, Vine is currently our Property Manager. For various reasons, we are not renewing our contract with them in 2023. Because of this, they have retaliated against our community. Freezing funds and not providing invoices for payments we have been asking for. Our legal counsel has sent numerous letters to them to rectify this situation, to no avail. We believe they have misused several thousand dollars of our association funds and have to date not provided invoices or financials .

    As we appreciate you and your business we are providing this factual response to your largely fabricated BBB complaint.

    The complaint written by ******************** is bold lies structured to solely cause harm to our firm. 

    1. Please indicate the type or systemic retaliatory conduct on our behalf in which you have complained about. Your statement is vague and unsubstantiated. We consider this issue moot.

     2. We are not your banking institution with the ability to freeze any funds as so falsely stated in your fabricated complaint. If you are experiencing banking issues, we suggest you reach out the the banking firm that the association has engaged to bank with. We consider this issue moot.

     3. All invoices have been provided to the client as required by our management agreement. We consider this issue moot.

     4. Vine has not misused any association funds as we are legally obligated to act as fiduciaries for the best interest of the association. If you have any evidence to the contrary please provide it. We consider this issue moot.

     5. ******************** is the newly appointed board president and now disagrees with the prior boards votes and actions. The association duly requested services above and beyond the scope of the management agreement requiring additional billing for the additional services rendered to the association which have been. The new disgruntled board member requests services by Vine to be performed for the association for FREE. Unfortunately our services are not free and are required to be paid for. We consider this issue moot.

    6. In regards to the scope of the contract we are not able to comment on current pending legal disputes in which the complainant duly noted this was a legal issue now and took this unprofessional step to include the BBB in a legal matter showing his childish, retaliatory unprofessionalism. T We consider these unsubstantiated complaints moot.

    I am rejecting this response because: **** has not acted in the best interest of our association. To date, we have not received any detailed invoices from Vine on the litigation charges, our association is funding. If **** hasn't misused our funds, what are they hiding? ****'s response to this complaint is based on their narrative and not any facts. ****'s overall actions have been negiligent as they continue to retaliate by cutting off access to our financials 11/2 we were advised that monthly financials would be emailed. To date, we have not received any updates. Vine claims they are a fiduciary adviser for our association, yet they will not provide a breakdown of charges, but will make sure they withdraw their payment.
