    We had an agreed upon contracted price for them to replace our roof after storm damage with a signed contract. Without our knowledge or approval, they submitted another supplemental claim with our insurance company for approximately $4500.00 more. Per the contract, no supplemental work could be performed without approval from the insurance adjuster, however they didnt even file this supplement until a month after the project was completed. The insurance adjuster only approved less than half of the additional charges because he said there were multiple duplicate charges that had already been approved in the original claim. Of the approximately $4500, he only approved approximately $2100. **** Davis never even let us know there was additional damage or that a supplement had been filed until after the job was completed, and has now sent us to collections and is trying to make us pay the additional $2400 from the unapproved and unauthorized supplement.

    Ms. ******** We apologize for the inconvenience and misunderstandings on the supplement on this job.  I can see how this can be upsetting.  We are currently reaching out to the adjuster to get clarification on the difference in our amount and the amount approved by him and paid to you by Indiana Farm Bureau for the supplement. We will not hold you responsible for work that was not approved, but we need clarification from IFB. If an adjustment is needed, we will do so. As your signed contract states, "Owner agrees that the total cost of the work will be in accordance with the original estimate and any supplement estimates prepared by the Contractor and approved by the adjuster on behalf of the homeowner's insurance."  The supplement was needed to fix additional damage found when opening the roof.  It is common for this type of work to be completed and submitted after the fact for approval from the adjuster.  We did previously communicate information regarding the supplement in which you responded to our Project Manager and our Job Coordinator prior to submitting it to the adjuster. We will be in touch as soon as we hear from the Adjuster and make any necessary adjustments.

     I am rejecting this response because: In your contract with the estimate, it states that any significant change in the scope of work or cost must be documented in a written change order prior to completing. This was never done. I was aware that they would need to file a supplement for part of the guttering that they missed adding to the original estimate, but not for all the additional work to the roof. I never received any verbal or written notice of the extra roof work. And the supplement was not submitted to my insurance until after the entire project was completed, not prior to performing the work as stated in your contract. This work was not authorized by myself or my insurance adjuster prior to performing it.

    Good afternoon.  We have completed more research and this is what we have found.  Ms ******** purchased an Actual Cash Value policy.  What this means is when a loss happens the insurance carrier is bound to pay only the actual cash value of the reconstruction and not the actual replacement cost.  **** Davis attempted to reach out to the adjuster again,  and as he would not return our phone calls we reached out to his supervisor who looked at the file and told us that the difference between what was paid out and the sale amount was the difference between the actual cash value (***) and replacement cost (RCV).  When a customer signs an *** policy, the pay off for the customer is the policy premiums are less than an RCV policy.  But when a loss happens, the difference from the *** and RCV are the customers expense.  Again this is not a change order, this is part of the insurance policy payout.  As such we also acknowledge that the adjuster stated something was in the estimate duplicated, we can't find that item, we reached out to the adjuster - no response, we asked his supervisor who told us the difference was because of the *** policy.  Because we can't get a clear answer on the supposed duplicate line item and because we understand this is confusing and causing Ms ******** an unexpected expense we are willing to split the remaining balance and accept $1200 as paid in full if paid within 10 days.  ************** is not accepting of this, we have already filed legal action which will remain in effect and we will have this same discussion with the judge.  But because of added expenses to collect we will not offer the $1200 in court and we will expect payment in full plus legal fees and court costs per the contract terms.

    I hire the company in March 2024 to restore my house after a fire. I paid about ***** for a down payment. The company was to return my home to its previous condition how ever they did not perform indented job to the same way my house was. **** Davis had to redo insulation four times because it was not to code per building inspector it was the wrong insulation. Also they had started work before I signed a work order which was not signed at all. The biggest thing is my tile floor was ripped out before I got a quote and when I got the quote it was not in my budget. The whole house needed recleaned as there was visible smoke damage covering most of the home. I had to fire them and rehire another company to do the job. Most of the work had to be redone and I need my insurance money back to pay the new company. They tried to give back a small amount of money which is no where close to what I need and they offered a bit more however its not enough to cover the bill.     Attached is a summary of the information regarding this job.  It answers all the points of her complaint.  The fact is we have paid her every dollar that the insurance paid us for items we did not complete. We are holding no more money for **************.  If she is feeling she doesn't have enough money to cover the floor she wanted then she should speak with her current contractor.  We had arranged to give her credits for some items that she could either do herself or decide she didn't want completed.  We planned on using those monies towards the flooring that wasn't included in the insurance settlement.  If her current contractor didn't have that agreement with her its likely she didn't have the monies she was hoping for, however since we were not at all involved in those decisions we don't have answers for her regarding money.  We have given her every credit she was owed from us. We do absolutely deny that we started work without a signed agreement as we have a work authorization signed.  The work authorization was signed via electronic signature on Feb 13, 2024.  I thought it best not to attach to this file as it contains private information of ************* including address and insurance information.  As stated to her this was round one of cleaning and is not intended to look clean, but to remove large amounts of soot. More cleaning would have come from **** Davis.  However we should be paid for the structure cleaning that we completed so no credit will be given for that.  The insulation error was a vendor error who did not deliver the insulation that was ordered.  It was corrected and at zero cost to **************, so there are no funds there to repay ************* either.  While it is always our hope to satisfy all our customers in this case she did not let us complete the job which makes it difficult to completely satisfy.  Had we finished the job per the change orders written, it is likely she would not have needed extra funds.
