I hired this company to have an estate auction after the passing of both my parents. My Auction was held on 4/22/25 and I verbally received what my auction sold but never received payment. I attempted several times to contact the owner ******* ****** and he would say that he would bring by payment but then not show up. I offered to pick up the check myself but when I tried to schedule a time, he wouldn’t tell me a time. I was told that my Auction generated 6700 I sales and per his contract, I should receive 70% of that which is 4690. Now the owner is not responding to email correspondence, phone calls or texts.,Customer Answer

The Business finally settled with me last night. He wrote me a check that I will deposit promptly this morning. I am hoping that the funds are sufficient. I still don’t agree how the individual runs his business but at least he finally paid me.

We purchased a car hauler trailer on August 23, 2024 from ******* ******, the auctioneer and owner of Legacy Auction Group at one of his auctions and he said that the seller had a title coming, and it would be there in a week. My husband asked again before bidding if ******* would guarantee that we would get a title and ******* said yes. We paid $2,000 plus $100 buyers premium. We have the auction bill of sale showing what we paid. We contacted ******* multiple times through text, phone and facebook and finally, we were given the phone number of the seller on October 8, 2024. The person ******* sold it for informed us that he had the title, but it had an $8,000 lien on it. That person offered to take it back and give us the money back. We made arrangements to meet, and then he stopped responding. We met ******* in person on October 8, 2024 to let him know what happened, and to ask for him to resolve it and he said he would take care of it.. We have a small, veteran owned family farm and with the drought we needed a trailer to haul big bales of hay. I explained to ******* that the trailer had the VIN plate removed and we didn’t want to get into trouble for driving it, in case it was stolen. We didn’t realize when we drove it home that it was missing, as it was getting dark. After waiting another week, I asked ******* to come get the trailer and refund us what we paid. He stopped responding until I posted on his Google reviews and then texted me to tell me he never said he would get us a title and offered a $500 credit because he already settled with the seller. We’re still not able to register it and were told by Highways Patrol to file a petition with our local courthouse in Cass County to ask the judge for a declaratory judgment so we can file for a new VIN. We would have never purchased it if we thought there would be any issues with getting a title because we don’t want to get into legal trouble for not registering it.Customer Answer

On July 1, the company held the auction. They sold things that weren't to be sold. I was told to separate these items.
We took the dining room chairs out of the dining room and placed them in the office. They sold them.
They sold my Treepod and he said he would replace it.
They removed plants out of a planter and sold them.
They sold a hanging fern at the front door.
They sold a metal flamingo from the front yard.
They sold a metal wind art from the front yard.
They sold a birdhouse feeder attached on the side of the garage where one had to go through the bushes to get to.
They sold an attached extension cord with reel from inside the garage. When doing this they broke the reel and left the remnants on the wall.
Original text from owner was $1700 before commission. Check was sent for $888.88, stating the sale brought in $1367.50 before commission; big difference.Business Response

Dear *** *******,
My staff member that was in charge of the set-up of this auction stated that you had not separated anything as instructed. Items should have been removed or tagged “Not For Sale.” Our job is to make the most revenue possible for our clients and if we have not been told not to sell items or they are not removed or tagged, it is beyond our control. We did offer to replace your “Tree Pod” but not at a cost of $2,500.00 as that is completely insane. Comparable units can be purchased online for several hundred dollars. We did not remove plants from your planters and sell them. We did not break your extension cord reel and leave the remnants remaining affixed to the wall. We stated that your auction brought approximately $1,700.00 before commission. There is accounting that needs to be addressed before the final amount is established. Your settlement statement provided you with all of the records of the items sold at your auction. Let us know if we can be of any additional assistance. Thank you for your business.

Good afternoon,
The customer has been paid in full for their proceeds less our contracted commission rate. Again, any items that were not supposed to be sold should have been marked "Not For Sale" or removed all together from the property, as was instructed to this client numerous times. We are not responsible for any accidents, injuries or losses that may occur. This information is published numerous places online, in the auction contract that this customer signed, printed on our buyer's cards, and stated verbally during the auction. We offered to replace the TreePod for this client but he would not cooperate at the time. We do not have anything more to discuss.

I am rejecting this response because:So originally, Brad took some responsibility, knowing they incorrectly sold my TreePod. Although I stated a wrong price, he now takes zero responsibility for that even after stating the correct price. He continues bringing up the first price I mentioned, even when I told him the correct price later.
In a text, I have in my possession, ******* quoted a larger amount made at the auction. He sent a check, after their fee, for a much lower amount. Why would a company text an amount, not knowing the actual amount? Obviously they should have said, Once tallied, we will let you know. But no, he supplied an amount.
Multiple items were not to be sold. ******* did not say place signs on items that weren’t to be sold, but separate them. We did this with our dining room chairs. We placed them in the office, away from the dining room. One would think if we were selling them they would be in the dining room.
We had a discussion with his employee, *****, before the auction began should she have any questions about items to be sold or not sold. At this point, again before the auction began, she texted, “This is *****”. Why else would she send us her number before the auction began?
They sold multiple items that weren’t inside the house, that were not for sale. All items sold were either in the garage, in the house, in the shed, or on the decks (excluding the TreePod). These items include yard art flamingo, hanging fern, yard art wind spinner, bird house/feeder (this was actually attached to the outside wall of the garage where someone had to go through the bushes to get to it.
In addition to those items, during his company’s management of the auction, an extension cord and reel was snapped off the inside of the garage, plants were taken out of our planters leading into the garage. He states these things weren’t sold, yet it was during his time managing the event when he was there.
I have time-stamped pictures of these items, including purchasing new plants that were missing during his management of the auction. These photos were taken immediately following the auction.
In a previous email, I have sent pictures and amounts for him and his company to pay to make it whole. I can send these again, if requested.
Sincerely,
******* *******Initial Complaint

On August .13, 2023 I purchased two jewelry items at a Legacy Auction Group auction totaling $1,655 plus $165 in buyers premium.
One item was a pendant tagged as being 18K gold with an aquamarine and diamonds and the other was a bracelet tagged 18K gold. When the pendant was held up, the auctioneer described it as 18K gold with an aquamarine and almost a carat of diamonds and the bracelet as 18K gold. I bid and won these items in good faith that they were as described.
When I took the bracelet to a jeweler for repair, he said he did not think it was 18K gold. On or about August 15, after taking the items to the first jeweler, I contacted the auctioneer and explained that the items did not test to be 18K. He stated that he had tested them and thought they were. I stated that I would take them to two more jewelers and would contact him with their findings. The jewelers (**** *** ***** ******** *** ***** ** ***** *** ******* *** *** ******** **** *** ******** *** ****** **) were all in agreement that the items were not 18K and the stones were not genuine.
Since that one conversation, I have made repeated phone calls, left voicemail and a message on the auction website but have had no response.
Since the items were misrepresented, I would like to return them for a full
refund.Customer Answer
