    HOA ***** * filed a lien on my properties to collect money for a non existent home owners association
    This is a **** developed with the involvement of a lot of people in Wayne County Ky
    There is no public records of this company or website, and the so called President wants me to send money to his home address in order to release the liens in my properties that he has hostage

    My name is **** ********* newly elected to a voluntary position of President of Sandstone Point HOA.  To give some background ***** ***** purchased two lots around 2008 at which time our HOA was already filed with Wayne County Deed Book 310, Page 664, File Cabinet B slides 103 and 140.  This spells out assessments for each lot owner.  Each lot has an annual HOA fee of $200 which is collected from all 140 lots each year.  Funds are used for current and future road maintenance, security gate maintenance, and some grass maintenance in the summer in and around the gate area.  I would estimate there to be roughly 3 miles of road inside the gates of Sandstone.  I have been a homeowner since 2021 and have paid my HOA fees like the rest.

     

    My understanding from ** ***** is that he made an ill timed purchase of his lots around the time that the original developer went bankrupt.  This was around the time when the US was in the midst of the mortgage crisis, causing values to decrease across the country.  My three conversations with ** ***** had the HOA set up as some sort of conspiracy or ****.  Though I am not privy what happened around the time the developer went bankrupt, I would assume unsold lots needed to be liquidated, and I am guessing less than what ** ***** paid for his. 

     

    None of this precludes ** ***** from making the HOA payment of $200 a year for each lot.  Certainly if this was a conspiracy we would have raised that figure over the years.  My position like the other four members on our board who are serving as volunteers is simply trying to follow the rules of the HOA as they were filed.  Just for instance since I was elected last Fall I have had to deal with damaged roads by builders, upgrading the security gate, installing additional security camera at the entrance, along with approving building plans.

    I am rejecting this because ********** desperate attempt to swindle money is almost laughable. He indicates he is 
    following the rules as a homeowner since 2021. A homeowner where? In Sandstone Point KY ? 
    The address you want the money sent to I was told is your home address in Ohio! You are 
    talking in circles. And if you did have a home in Sandstone it is 1 of 4 built there in 19 
    years! HOA = Home Owners Association. How much money did you need to maintain 4 homes? He 
    couldn't even look up to see how long I have owned the properties! (2005) because he does 
    not even have any records. No website, nothing. He just knows he needs money sent! To his
    home address! This guy needs to be jailed! 
     He says he understands I may have paid more for my lot than I paid to the developer before
    they went bankrupt shortly after the realtor ****? Really? Actually I paid 10 X more! I paid
    $136000 for 2 parcels that are now worth $20000 Maybe  And ******** thinks their entitled to
    $8600 of that! ******** indicated he is just 1 of 4 volunteers to run their "association" 
    What happened to the other 6? Their were 10 "officers" on that board at one time. See attached list. 10 officers
    for what? to collect money to pay for the property management of 4 homes? in 19 years? And why
    was 1 of the officers a bankruptcy lawyer? As you can see none of this adds up! 
     Again how can you have an organization that collects money for profit with 10 board members and
    not have bank records available, record of minutes to the board meetings etc. When I questioned 
    Harrison about this he visibly agitated cutting our conversation short and referred me to their 
    "lawyer"  What a joke! Is he on their "board of directors" also?
     Again I am asking nicely please remove this lien and let me try and sell my 2 properties to
    recover what little I can from this ****!

    Ok let's try this again.  I have attached the following information.  Email from our HOA attorney ** ***** who attended our annual HOA meeting on October 28,2023.  It was held at the ******** ********* and anyone was invited to physically attend or participate by Zoom.  Attached is the email from the past President ***** ********* who included the agenda.  Also attached is the notes from the meeting from ** *****.  The annual meeting was attended by about 15 people.  An additional dozen or so participated by Zoom.  Also attached is just one of several bills we received and paid for.  Also attached is verification that my primary home is in ***** *****  Also included is verification that I own a vacation home at Sandstone which I purchased 12/6/21.  ***** ********* the past President sold his home at Sandstone last Fall, and I volunteered to take over the position.  This is strictly a voluntary position, as it has always been.  Though we have other delinquent lot owners at Sandstone we are now to the point of filing liens on the worst offenders (there are only a handful)..   I cannot speak of things that happened in the market 15 years ago when ** ***** purchased, but the annual fee to the HOA is a totally separate matter.  At this point I am not going to engage ** ***** if he is going to continue to portray me as a **** artist.  If ** ***** does not want to pay the amount owed now we can discuss the balance when he ever goes to sell

    I am rejecting this response because:

    So ******** got together with his “volunteers”, don’t forget HOA s by law are all “volunteers” to figure out between them how to keep “it” going I won’t use the word **** but we all know what this is! To take care of roads and grass cutting to maintain 4 homes built in 18 years, I’m guessing the only grass need cut be the weeds growing in the cracks of the road lack of use! Also books need be open to residents public where money went, spent etc for last 18 years. I need ******** to show me where I joined this so called HOA in writing. 
     In conclusion I am asking once more to please do the right thing and release  lien so I may try and recoup knot even a tenth of the money I was taken for over the years

    I am done here.  81 other lot owners pay their $200 a year per lot without complaint.  ** ***** believes that since he made a remorseful purchase that he should be excluded..  The BBB is really not the best arbiter for something like this.  If he would like to make this a legal matter he can contact our attorney.  I have provided sufficient information for the BBB.

    I am rejecting this response because:
      Me ******** is “done here” How very nice and convenient when you are directly involved in the **** . He refers me to their “lawyer” who passed the buck and sends me back him ***********  I’ve since spoke to an attorney involved in writing up the original contracts and also dissolving selling the large remainder of the unsold lots when the development went bankrupt belly up.  Said he was shocked and  couldn’t believe there would still be any type of continuing hoa if in fact there was 1 to begin with!   
    Again an “organization” that somehow seemed to keep itself afloat with no open financial records and only 4 homes built in 19 years with 10 board members including a lawyer “partner” and a councilman and auctioneer overseeing this “project” is beyond suspicious??What was the lawyer (partner) all about? Partner in what? It’s supposed to be “volunteer”
