    I had gravel delivered to my house. The driver said he could drop off the gravel in the back yard through the fence. While backing the truck through the fence gate the driver run into the fence in the back yard and broke some of the pvc panels and post. The business is refusing to pay for dangers because the driver said he asked me to be his spotter. He did not ask me. I watched and tried to stop him from hitting it but I guess he did t hear me.

    Our driver was called to deliver a load of rock to this location. The lady did not order the rock. It was ordered by someone that was doing work at her property, I think maybe for a pool. When the driver arrived, the gentleman doing the work was not there. The lady came out and said that our driver could just drop the rock right inside the fence and that would be fine. Our driver told the lady that it was very tight to get in that fence but IF SHE WOULD WATCH him, he would go ahead and drop it there but only if she could spot him. She said ok, no problem. She was standing there so he assumed she was watching. He was going back very very slow and he felt the bump. The driver got out and asked the lady why she didn't stop him and she said, well by the time I realized it was too late but then the driver noticed that she was on the phone. He absolutely did not mean to hit the fence and is a very careful driver. The driver called the guy that originally ordered the rock and told him what happened and explained the situation. The guy told the driver on the phone, no problem we will take care of it. Then the driver also sent the gentleman the picture and he again said it was fine. So our thought was that he was going to fix it. Or at least attempt to fix it and let us know if there was something else we needed to do. When we called the lady ourselves and asked if the driver did in fact ask her to spot, she said yes he did and then went back and said well no, I tried to stop him but he didn't see me. 

    We are going by what our driver told us. He was trying to do what she asked by dumping inside the fence but would only have done that after being told she would for sure watch. For this reason, we did not feel like this was our fault. If our driver just made a blatant error, we would certainly understand that point.
