I hired B3 Construction to replace my pressure treated deck with composite material flooring and aluminum railing. The work was completed November 2023 and Mr. ******* did an excellent job, however, there appears to be a defect with the screws provided for the railing and they began showing up on my deck stairs (they were breaking off). I notified Mr. ******* on May 29th 2024, with photo's and he seemed at first to be helpful, stating he would reach out to the company for replacements. On June 2 2024 he stated he submitted the warranty claim through their online portal. On June 25th Mr. ******* texted me to state he received the screws and can com by that Thursday or Friday after work to install and this is where things went wrong. I stated those times would not work for me, that mornings work best. His response was "I can't do mornings. I have to work for the clients I'm scheduled with currently. I am only available at some time between 4-6pm. I will let you know later this week my upcoming availability. If that time does not work, I can definitely mail the fasteners to you for either you or someone else to install."Mr. ******* also referred me to our contract that I only had a 30 day warranty on the labor, however, my complaint is not about labor, it is about faulty materials unknowingly used. These broken screws are what hold the deck railing together and now creates a safety hazard. Furthermore, the materials used have extensive warranties and I have absolutely no clue how to file that or what business Mr. ******* got them from. When I asked what happens if I need to use that warranty, Mr. ******* told me I had to contact him and he would take care of it. I spend nearly $11,000.00 for materials that I am unable to access the warranties. I file a complaint with ************* Business Regulations end of July 2024 when Mr. ******* did not resolve this issue, however, still no resolution through that either.

    Good Afternoon Mr. ********,

Thank you for reaching out.  Mr. ******* failed to provide me the warranty information and when I inquired upon completion of the job, he stated that if I need anything fixed to contact him, therefore that is what I did.  So with that said, the complaint is twofold, faulty parts and I am being denied my right to warrantied products.  Mr. ******* also refused to tell me who his supplier is.

    I hope this helps.

    Respectfully

    Hello,

I would first like to thank you for mentioning our wonderful work in your submission, as this is what we continue to strive for with each and every client!

Unfortunately, we were unable to accommodate the times you were requesting we come to fix the issue. You were requesting a rectification to a faulty material issue over 6 months after we completed this project. We strive to keep customers happy, but we also must continue to work for our current clients, during normal business hours.

At no point did we not inform you of the material brand or our supplier. You are well aware these items were all ordered from ******* ****** in North Smithfield, as your decking was purchased from here and you were adamant that we use the same supplier for the rest of the materials, while also being physically present for the trucks arrival and throughout material drop-off, with their insignia clearly visible. Furthermore, if you so kindly refer to your screenshots, mainly IMG_3786.png, you can see that we submitted a warranty claim to *******, the manufacture of your railings. When we were unable to make a time work, we again submitted a request for replacement screws to be sent to your address. If these screws have not yet arrived, we are very sorry about this, but it is entirely out of our control. You are more than welcome to visit *******s website to request the screws be sent to you directly.

If there are any other matters that may arise that we can assist with, we kindly ask that you reach out to us via email before submitting any concerns to outside parties. Have a wonderful day!

I'm sorry, but I did not get time to respond to this until now. All I am asking for is for the repairs for faulty parts be made by the contractor who did the initial work, the issue is when that will be completed and it appeared that Mr. ******* was unreasonable with just late afternoons (this time  frame does not work for me).  I would not have cared if I was on the morning schedule a few weeks down the road. Again, it creates a safety hazard with these screws breaking on the railing system of the deck.  if it was just a matter of inserting new screws, I would not be complaining, but the issue is the screw heads have broken off.

Please continue, as previously stated, to review the signed contract in regards to this issue. This issue seems to be between you and the manufacturer, *******, as they are seemingly at fault for providing faulty materials. We aare well outside of any labor warranty period, which this issue also does not fit into, as this is a materials issue. B3 Construction is closing this case in our systems.

    Complaint: ********

I am rejecting this response because: I notified the business as soon as I realized the problem, again this is an issue of the contractor not resolving the the faulty materials issue and I have no proof of purchasing materials (no itemized materials receipt was ever provided to me), I have no warranty information for said materials, therefore, how am I able to file a warranty claim with no proof of purchase.

    Sincerely,

    Complaint: ********

I am rejecting this response because: B3 owes me a detailed materials list of items purchased for the job in the contract, that I paid $15134.90 to B3. Only my deck boards were purchased through ******* ******, therefore, I have no proof of materials purchased for this railing system to exercise my warranty now or in the future.

    Sincerely,
