    To Whom It May ********** needed chimney caps put on our chimneys as the house did not have any when we purchased our home. *****************************, MJ Masonry & Chimney gave us a fair quote to perform the necessary work which is listed out in the attached copy of the signed contract. ******* then took a check for the total amount of $2200.00 agreed upon total to complete the tasks in the signed contract. We signed the contract on September 20, 2023 and made out a check in the amount of $1100.00 to *****************************. ******* cashed the check on the next day, September 21, 2023 (as noted in the attached screenshot from our banking institution).We have pursued ****************** for when the work would be completed numerous times via telephone, text message and email. ****************** called back 2 weeks later to inform us that he had an accident and the work would need to be pushed back. I informed him that I needed full transparency on a timeline, as we needed the work completed and he had taken our money by cashing the check. We reached several more times over the next few months with no response from ******************************We reached out again to ***************************** to inform him that we were going to file a formal complaint to get our down payment back. Letting him know that we would accept ***** as an easy way to pay us back the money we are owed for the breach of contract. ****************** informed me via text message that he would not be paying us back because, his wife totaled their car.The rest of the text exchange is also documented in the attached screen shot PDF. We want our down payment of $1100.00 paid back to us and our contract terminated with MJ Masonry & Chimney. We feel that we are helpless from ***************************** stealing our $1100.00.     I contracted **** after he did an exceptional job replacing my chimney I also gave him almost $5000 deposit at that time It has been well over a year and **** has not completed the job and has not refunded the deposit. While I understand that he has suffered injury and has health issues so I was understanding and was willing to work with him.However he has still not started the work or refunded the deposit and has now stopped returning calls - Again I am willing to work around his personal situation however the lack of response makes me not trust him

    We contracted with MJ Masonry to reline our chimney on 3/16/2023.The initial work was done on 3/23/2023 and ******* said he would come back the following week to complete the work by replacing the chimney cap that he had removed to install the lining. The contract said he would come back on 3/27/2023. This return visit has still not happened.The amount of the contract was $2,900.00, which has been fully paid.

    I have not heard from the business in response to my complaint, despite regularly calling them via their two phone numbers and also emailing them.
