I am filing a complaint against Citizens Disability because they are saying that my sister reached out to them for assistance in filing a disability claim. They are alleging that she reached out to them and requested assistance and that she signed a contract that they sent to her via email. I did all the work on her claim. I completed the application online and provided documents requested. My sister don't check her email because she don't know how. I actually set up and check all of her emails so I know for a fact that she did not sign any documents asking them to represent her. My sister may have spoken with them and thought they were with SSA but she did not sign anything from them. We did not know that *** had a representative down for her until her award letter was sent. We called SSA and they gave us a name. We had to do some research just to find out who this was. We reached out to Citizens and they said that she hired them and signed a contract. We have not seen said contract. We need to know how they got her information and why do they need to be paid for representing her if they didn't do anything. I did all of her follow-up calls and provided information to ***. They told me that I have to reach out to *** because there was nothing they could do. I told them they can let SSA know that they were not legally her representative and they said NO they can't. They said that I will have to reach out to them. Infact, SSA told us who they were and said that we would have to reach out to Citizens to get it resolved. I think this is just how they work the system and try to take advantage of unsuspecting people that is trying to get disability and take their money. There are alot of companies that prey on unsuspecting older people that are not able to defend themselves. This is one of those companies. Citizens couldn't even tell us what they did to assist my sister with her claim. We never received any correspondence from them and now they are wanting to be paid.

On ~09-27-23, I contacted Citizen's Disability (AKA CD) via internet advertisement. I was contacted by CD to gather information on my disabilities. During the call, CD informed me that they would reach out to the 3 ***'s that I had offered up as having information on me. CD also informed me that they would file my claim and would perform and follow-up on ALL of required documents/tasks required for my claim from beginning to end.In 10/23, a CD representative called and informed me that I had not signed the contract; a contract would be sent to me. I did not sign a contract for their services. I received ZERO contact from CD until 08/24 from a person named *****. He asked me if I had any more services provided from any of the 3 ***'s that I had provided. Again, I hadn't been contacted by CD since 10/23. I told him that I had required services due my disabilities. He requested that I send the information to him so that he could add it to my claim. I asked him to send ALL documents related to my claim. ~10 days later I received a packet with information about my claim from CD. After reviewing my information, I found that only one *** had responded to the medical records request. CD has not been following up on my!08/29/24, I personally requested medical records from my Primary *** for my medical records; I signed a release, from my primary *** requesting my medical records from the specialist *** ~10/18/23, 01/17/24, 03/13/24, 07/17/24, I required services related to my disabilities. 09/03/24, my primary *** provided services for one of my disabilities. While at my primary ***, I did receive my medical records from my primary and specialist ***I have provided ~90% of the medical information that will help my case. CD has not followed up with any of the ***'s that I had listed. As "promised" CD has not followed through on the claim and capture of required documents.

I am the caregiver, social security representative ***** and power of attorney for my sister who is severely cognitively impaired. She resides in an assisted living facility. A Social Security Disability application was completed on her behalf by Advantage 2000 Consultants in September ******************************************************* October 2022 I received a "welcome package" from Citizens Disability stating they have been authorized by my sister to represent her for her disability claim. NO such authorization was ever provided nor does my sister have the ability and/or understanding to do so. I contacted Citizens Disability and after getting the run-around they finally relented their unauthorized representation and sent me a letter and a copy of their "Notice of Withdrawal of Appearance and Waiver of Right to Fees" addressed to Social Security. The notice states that ******************************** is removing himself "as payee for any fees paid on this claim" and that he waives "any and all rights or claims to a fee relative to the pending disability claim." My sister's disability claim was paid summer *************************** ******************************** of Citizens Disability was paid $7,200 in November 2023. HE and his company PERFORMED NO WORK ON THIS CLAIM. It makes no sense why we would allegedly hire him AFTER the claim was prepared and filed by another company at no cost . It was only uncovered that my sister's claim was reduced to pay ******************** when we received a 7/1/24 letter from social security about another person from Citizens Disability attempting to appoint themselves to represent my sister when no such authorization was given. ******************** and Citizens Disability were never hired to represent my sister and accepting payment from Social Security for her claim is fraud.

Saying they have no account is nonsense. They must have had something on file to cash a check that they waived the right too. Also, the attachments to my complaint listed my sisters name.  Notwithstanding and further to citizen disabilitys request, I emailed ******************************* her name and phone number info. Be advised, if the funds are not returned, I will be pursuing legal action.

The problem is that I don't know how or where this company got my personal information or how they claim i ever entered into a contract with them for services when i have never contacted these people for anything. They claim I have even electronically signed this said contract. Yet they can't provide me a copy of it. When I asked them to provide me the contact info they have for me they gave me a phone number which I have never had. When I talk to them on the phone and tell them that I never hired them. They tell me "ok well we can resolve this, you will just have to fire us and say you no longer need our services, then it will go to our firing **** for review and if it's excepted we will send the form to SSI and they will then be able to release your money." When I tell them no I will not do that because that would be saying that I hired them in the first place. They just simply say I'm sorry sir. I tell them that I want to speak to someone in the (firing) **** they tell me sorry sir I cannot do that. I ask to speak to a supervisor, cant do that either. It ask them to provide me a copy of the contract, nope can't. This is starting to sound more and more like a scam of inner corporate proportions to me. I am honestly starting to think that they are working partnered with SSI. That is how they get people's information and also how they know when you have applied for benefits and that is why they protect each other so diligently. They claim to have been hired by me to help me get disability in 2023. Well I was denied my disability. I was never told by anyone that I was denied back then. It wasn't untill now when my wife reapplied for me that i learned that and that was after my WIFE had done all the foot work, doctors names, numbers, medical records, treatments, diagnosis, meds, everything SSI office requested. If citizens disability did this for me why did my wife have to do it. They told me that I was released from contract with them.Today i was informed they got paid.

On June 27, 2023 I entered into a fee agreement with Citizens disability for their help in representing me for a social security disability claim. This initial correspondence and agreement was entered into under severe financial duress in my life due to recently becoming unable to work due to my disability. Citizens Disability was unclear in their explanation of their services as well as what kind of fee they would collect and how that would be collected. I felt taken advantage of in my great time of need, disability, and severe personal and financial distress. Throughout our correspondence, they have been unhelpful, unclear on my claim progress, and hard to contact. I was never sent any sort of rights and responsibilities document despite requesting this numerous times. They continue to refuse to acknowledge any wrongdoing or even what their responsibilities to me were per our contract. On May 22, 2024 upon my request, they sent a letter of withdrawal to the ******************************* however they did NOT waive their right to collect their fee. We discussed my request that they do so when I requested they withdraw from representing me.Given that nothing more has been done other than filing my original application, and that no determination has yet to be made on my social security claim, I would simply like for Citizens Disability to waive their right to collect a fee from my disability benefits should they be paid to me.

Dear Ms. ******- We have looked into your claim. We have filed your application and we have uploaded medical records on your behalf. Unfortunately we have no control over when SSA will look at your claim as it is 7-12 months from start of claim. Based on the work we have done we are not waiving fees. If you do not agree you can contact Social Security to dispute.

This response is not satisfactory to me.  Citizens did not even attempt to address my concerns regarding their unclear expectations and lack of communication.  I understand that the social security application process takes a lot of time; that is not my concern, nor did I even mention that in my complaint.  Citizens had been uncommunicative.  They did not clearly explain their fees and how they would be charged to me when entering into a business relationship with them.  They continue to refuse to provide me with any documentation explaining their rights and responsibilities to me as my representative.  They Engage in predatory practices and take advantage of those unable to advocate for themselves while in great times of need, and The ****************************** is well aware of this.

Further, simply submitting an initial application on my behalf in no way meets a standard of billable time that even comes close to the percentage they are retaining the right to collect.  they have done nothing for me other than submitting an initial application; no hearings, no appeals, no legal work, nothing. Simply waiving the right to collect a large percentage fee from a retroactive Disability check is a very small lift considering all that was done on my behalf was an initial application.
