      I am seek your assistance in resolving a situation between myself and Calco Fence. In 9/22, I hired Calco to construct a fence on my property. I have discovered potential defects in the materials used and/or poor craftsmanship, leading to significant structural issues with the fence.Approximately 6 out of 27 posts, accounting for around 22% of the total, are experiencing significant structural problems. Almost all of the posts show some level of decay, which I believe is not typical wear and tear due to age, considering the fence is less than 1 year old. As a result, some of the fence runners have detached from the posts, and the double gate is noticeably sagging, rendering it inoperable. Despite Calco's attempts to repair the gate 4 times, I recently informed them on June 5 that the gate requires attention once again.Calco Fence claims that these problems are rare but considers them to be a normal part of the aging process for fences. They argue that the risks associated with these issues were clearly outlined in the contract I signed, and they further assert that we are now beyond the 90-day warranty period. In addition, they consider my warranty void since the Calco marketing signs are not visible. I believe there could be a case made for the contract language regarding the warranty to be unclear. There is a sentence under the contractors limited warranty and production information section that reads, "There is a one-year warranty on materials and labor."I initially raised concerns about the fence's structural integrity during the 90-day warranty period by emailing *******************, Calco's operation manager, on 9/13/22. These concerns arose from a conversation I had with the lead foreman, ******, who assured me that the concrete would harden after rain, preventing any movement of the posts.**** maintained that the fence had been constructed properly but agreed to inspect it. During his on-site inspection, he reassured my wife that there was nothing wrong with the fence and that slight flexibility is common in all fences. The recurring issues with the gate persisted, prompting me to notify Calco about them on 10/21/22, and 11/ 9/22. On each occasion, **** sent ****** to fix the gate, assuring me that further problems would not arise. The gate was 1st fixed proactively by Calco after their final inspection in Sept of 2022.The gate became inoperable due to sagging for the 4th time in February 2023. Surprisingly, on 2/13/23, Calco informed me that they would not honor the warranty for my gate, which is typically covered for one year. Their justification was that the warranty became void because the Calco market signs on my fence were no longer visible.After unsuccessful attempts to resolve the matter with ****, I contacted ***********************, the owner of Calco Fence, on 2/13/23. **** inspected my fence 36 days later, on 3/22/23. Following the inspection, **** claimed that the problems with the fence and gate are typical and part of the normal aging process, although not ideal. He also mentioned that their usual cost for replacing a post ranges from $500 to $600. In response, I informed **** of my intention to file a complaint against Calco, as I believe the issues go beyond what is expected in the aging process. Subsequently, **** offered to do the repairs at a reduced cost and reluctantly agreed to have ****** adjust the gate for a fourth time free of additional charge, which he did in late April 2023.As it became clear that Calco would not take responsibility to make the necessary repairs needed to restore the structural integrity of my fence, I contacted the ************* County Office of Consumer Protection on 5/8/2, providing my complaint with the case number 23-OC-088665.It is worth mentioning that my neighbor also had a fence installed by Calco Fence during the same 2-week period as myself, and their fence is experiencing the exact same issues as mine. Calco utilized the same crew and batch of wood for both fences.
