The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.
On June 27, 2024, the business entities Detroit Nursing Center, LLC; Moroun Nursing Center of Detroit, LLC; Father Murray Nursing and Rehabilitation Centre, LLC; Park Nursing Center of Taylor, LLC; Colonial Health Care Center, LLC; and Westland Nursing and Rehabilitation Centre, LLC, along with their parent companies Villa Financial Services LLC and Villa Olympia Investment LLC, entered a settlement and Corporate Integrity Agreement (CIA) with the U.S. Department of Health and Human Services.
The action alleges that from at least January 2013 to the present, the entities systematically failed to provide and/or provided materially and grossly substandard services to nursing home residents. Specifically, it is alleged the nursing facilities operated with severely insufficient staffing, resulting in residents being deprived of basic care such as regular repositioning, toileting, nutrition and hydration, bathing, treatment for bedsores, and oral hygiene, despite submitting claims to Medicare and Michigan Medicaid for these nursing home services, which were either grossly substandard or not provided at all.
The United States also alleged that the facilities failed to take adequate measures to prevent, control, and provide care related to infections, and to take adequate measures to prevent and follow appropriate protocols related to resident falls.
Under the terms of the settlement, Villa will pay $3,418,633 to the United States and $1,081,367 to the State of Michigan. Villa will also enter into a five-year quality-of-care Corporate Integrity Agreement (CIA) with the U.S. Department of Health and Human Services - Office of Inspector General. The CIA requires companies to retain an independent quality monitor to review the companies’ delivery of care and evaluate their ability to prevent, detect, and respond to patient care problems.
