I purchased a boat that was stored at this marina.Seller owed money to the marina and other boat related business know by the owner, *****, of this marina that was unknown to me undisclosed by the seller. My Yacht broker personally paid this marina upon learning of the debt so as not to disrupt my hauling the vessel to ********.When picking up the boat (which had been scheduled several weeks prior), ***** refused to launch the vessel until his friends had been paid off. He stated that he would not do the work knowing this vessel was on private property and there were no other options. He also waited until the haulers arrived from ******** to refuse service to strengthen his position costing me additional money for the haulers delay and them having to spend the night.Myself and the yacht broker were forced to pay off his friends in order to haul the boat out.I am sympathetic to those the seller of this vessel owes money to, but they should have followed proper channels to collect the money, not hold the vessel hostage and strong arm the buyer for such debts.I would ask the the ***** return all the money $2040 and cover $500 for the additional expensed incurred by the delay to the boat haulers and for him and his friend follow proper channels to collect.

The buyers broker ************************* was made aware of the balances due to 2 local compnaies months prior when the broker paid the fees that were due to our marina for storage.

I told *** he was free to pick up the boat but I would not perform any work on a boat that other providers have not been paid for the work they have done on the boat.  The transport company could have manually loaded the boat but didn't want to go throught th eextra effort.

So, *** is asking that I refund money that his broker ************************* paid to other companies that were owed money?

And yes, it's called a mechanics lien.  The lien attaches to the boat - not the previous owner.  It's not our problem that your broker decided not to tell you he was aware of balances being due on the boat.

Not only did I launch the boat after the local comanies were paid, I was also forced by your broker to go down there the next morning at 7:30am and assist loading the boat since your broker refused to, both at no charge.

      Customer Answer

I am rejecting this response because: There has never been any lien evidenced to me or my broker. The proper channels have not been followed for collecting any funds. The boat was held on private property and the marina played to that fact knowing that there were no options except for the marina to do what they were previously paid for by the broker.
