On October 9, 2024, the business entered into a Consent Order with the Minnesota Department of Labor and Industry (DLI). The Consent Order settles allegations that the business violated Minn. Stat. 326B.082, subd. 11(b)(5)(8)(9); 326B.84 (2)(5)(12)(15) (2022) and Minn. Rule 2891.0040, subp. 1D (2021). Under terms of the Order, the business agreed to be prohibited from: filing building permits unless the business is contractually obligated to perform the work and allowing any individuals or entities from using their license. The business also agreed to Mr. Belting to physically view the property before a building permit is cancelled to be sure no work has been performed. The business also agreed to not provide consumer's anything of value to offset an insurance deductible or offering to compensate a consumer in any way in exchange for their services and to fully comply with Minnesota Statutes requiring the business to provide a good faith estimate when completing insurance-funded work before executing a contract. The business will ensure that all representatives comply with all statutes, rules and orders for residential building contractors and all local solicitation requirements. In addition, the business agreed that all contracts and change orders will be in writing, all required permits will be obtained before beginning work and all required inspections will be completed. Lastly, the business agreed that they will not seek nor accept final payment from Minnesota consumers until all work has been completed and passed local permit inspections.
The business will also pay $7,000.00 of a $10,000.00 fine, with the balance stayed on the condition that they fully comply with the terms of the Order and have no future violations of any laws, rules or orders under DLI authority.
