On August 30, 2022, the business entered into a Consent Order with the Minnesota Department of Commerce. The Consent Order settles allegations that the business failed to accurately report: the characteristics of comparable properties, a violation of USPAP Standards Rule 1-4 (a); 2-1 (a) (2018) and Minn. Stat. 82B.195 Subd. 3(1)(l) and 82B.20 Subd. 2 (6)(13) (2020); and to adjust comparable sales when the market indicated, a violation of USPAP SR 1-1 (b) (2018) and Minn. Stat. 82B.195 Subd. 3 (1)(vi) and 82B.20 subd. 2 (6)(13) (2020). The Order further settles allegations that the business failed to provide sufficient information to show they complied with Standard 1, a violation of USPAP SR 2-2 (a)(viii) (2018) and Minn. Stat. 82B.20 Subd. 2 (5)(13) (2020) and failed to maintain a work file supporting the opinions and conclusions with the appraisal report, a violation of USPAP Record Keeping Rule (2018) and Minn. Stat. 82B.071 (2) (2020). Under terms of the Consent Order, the business agreed to pay $1000.00 of a $2000.00 penalty, with the balance stayed; complete corrective education courses within 90 days and cease and desist from violating any laws, rules or orders relating to Minnesota Dept. of Commerce responsibilities and pay investigative costs of $360.00.
