    Minnesota Dept. of Commerce Consent Order

    On August 30, 2022, the business entered into a Consent Order with the Minnesota Department of Commerce. The Consent Order settles allegations that the business failed to accurately report: the characteristics of comparable properties, a violation of USPAP Standards Rule 1-4 (a); 2-1 (a) (2018) and Minn. Stat. 82B.195 Subd. 3(1)(l) and 82B.20 Subd. 2 (6)(13) (2020); and to adjust comparable sales when the market indicated, a violation of USPAP SR 1-1 (b) (2018) and Minn. Stat. 82B.195 Subd. 3 (1)(vi) and 82B.20 subd. 2 (6)(13) (2020). The Order further settles allegations that the business failed to provide sufficient information to show they complied with Standard 1, a violation of USPAP SR 2-2 (a)(viii) (2018) and Minn. Stat. 82B.20 Subd. 2 (5)(13) (2020) and failed to maintain a work file supporting the opinions and conclusions with the appraisal report, a violation of USPAP Record Keeping Rule (2018) and Minn. Stat. 82B.071 (2) (2020).  Under terms of the Consent Order, the business agreed to pay $1000.00 of a $2000.00 penalty, with the balance stayed; complete corrective education courses within 90 days and cease and desist from violating any laws, rules or orders relating to Minnesota Dept. of Commerce responsibilities and pay investigative costs of $360.00. The Consent Order was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law. For more details go to the below link.
