I hired Proof Marketing to assist me with improving sales for my business. We had a contract that strictly stated what I was requesting and what they agreed to provide. This included using a specific platform to upgrade my website. When I found that they had published a broken, unfinished, unworking website without notifying me and without granting a preview as the contract guaranteed, they admitted that they did not know how to use the ********** platform, despite that also being a condition of our contract. They lied about being qualified to do the work I was promised, but took my money anyway. They also attempted to change the contract after the fact to allow them to escape culpability and also refused to answer or acknowledge emails regarding voice conversations in which they made unkept promises. But I have a recording of our verbal conversations and copies of the paperwork they tried to change. I have uploaded a detailed summary with dates, times, and dollar amounts. Proof Marketing is currently trying to extort more money despite what was promised during our (recorded) conversations.

      Business Response

Proof Marketing created a website wireframe (homepage), as promised for the client. The clients website was never broken. It is important to note that all links, buttons, pages, and forms were functioning as should be at all times, including during the 24 hours in which website edits were made. Our designer is proficient in Wordpress, the platform the clients website is on. The day our designer was building the site, we realized there was no way to show the client the design she created without it being live, due to Wordpress restrictions and the template the client had. Our developer confirmed this. Our designer made the design changes and the client was informed to look at the changes to approve or request changes. When the client viewed the changes, she didnt approve so we immediately reverted the site back. The changes were live for only approximately 1 hour but still full functioning. Once the client told us the website changes were not approved, our designers started to build two additional website wireframes (homepages), free of charge, that, once completed, were extremely professional and aesthetically pleasing.

Soon after the dilemma, our team had a call with the client after the client voiced concerns. The client was appreciative, mentioned our exemplary customer service, and gave us permission to move forward with the two additional wireframe designs. After the weekend, the client received these deliverables in PDF format, which is our method of designing and gaining approval of wireframe drafts. The client denied approval of all designs and sought to seek contract termination.

However, per our shared contract, under the Style Release section, it clearly states, Dissatisfaction with Proof Marketings independent judgment or creative style are not valid reasons for termination of this Agreement or request of any monies returned. There are no promises to the Client concerning the results of any project. The Client acknowledges that it is impossible to predict the outcome of any marketing services. The Client agrees to hold Proof Marketing harmless should the desired results not occur.

It is important to also note that the client was extremely pleased with our services prior to the website changes. We have a trail of many email interactions with the client, who was extremely happy with the work that had been done to that point. The client communicated to us that she hired another company to manage her social media, and she wanted to work with them instead of us.

Finally, no contracts or other paperwork were changed or edited after the Client signing. We are happy to provide receipts of contracts and email correspondence upon request but will not be uploading them at this moment to uphold our Client Confidentiality clause. Proof Marketing is not attempting to extort any additional funds other than what was agreed upon in the shared contract signed by both parties.

I also forgot to mention that I researched the individual members of Proof Marketing on social media.  It appears they are a group of friends with limited to no marketing experience, who launched a marketing firm after taking a $275 online class from StoryBrand.com. They then copied the StoryBrand website to market themselves, and started charging customers $9,000 for them to use a free on-line website generator that requires no training to produce generic websites.  Their professional photographer is an opera singer with no formal photography or editing training.  Their lead graphic designer is a painter who has no formal website design experience listed on her LinkedIn or social media profile.  And they take turns acting as COO of the company; first it was ***********************, then ****** husband, and now it is the opera singer/photographer.  And while I have received impressive services from self-trained graphic designers and marketing consultants in the past, they never misled me to believe that they were something they weren't.  Proof has been misleading.
