On May 2, 2025, while utilizing their automated wash system, one of the rotating washing arms forcibly dislodged the right front fender camera from my 2021 Tesla ************* exiting the facility, I immediately observed the damage. Inspection revealed that the equipment had physically torn the camera housing from the fender, breaking a retaining clip.I promptly reported the incident to an on-site employee, ******************* who documented the matter using the companys standard Damage Claims Intake Form. While Mr. ****** completed the form, I reviewed and preserved onboard video footage from my vehicle, which clearly captured the camera being struck and damaged by Take 5s machinery. Mr. ****** assured me I would receive a follow-up call within 24 hours. No such contact occurred.Subsequently, ***** concluded that the entire camera assembly required replacement. The total cost of repair was $150.40.On June 4, 2025more than a month after the incidentI received an email from Take 5s claims department denying liability. Their justifications included:There was no equipment failure or employee error. The same equipment touched the entire vehicle and there is no other reported damage. Our equipment is regularly inspected and designed to avoid causing this type of damage.this factual evidence does not support a claim of damage caused by the service at Take 5 Car Wash. These statements are legally immaterial. The equipment design and absence of a broader malfunction is irrelevant and does negate the proximate cause of this damage-Take 5's equipment dislodging my camera. Take 5 has provided no "factual evidence"only generalized, conclusory statements with no factual support in bad faith that do not counter my video.Absent a prompt and satisfactory resolution, and will pursue all available legal remedies, including litigation, to recover the cost of the repair and any additional damages permitted by law.

      Business Response

      Date: 06/05/2025

After reviewing the incident, including photos of the vehicle and the part in question, it appears that the component may have already shown signs of wear and tear prior to the wash. The interior of the piece shows signs of dirt buildup and wear that suggest it may have been previously loosened or not securely fastened.

Additionally, our maintenance logs show no malfunctions or maintenance tickets on the day in question. We also did not receive any other customer complaints regarding similar issues that day or throughout the week. If a brush had made contact with the piece, it likely would have only done so if the component was already partially detached or if an interior clip was broken beforehand.

While we regret any inconvenience experienced, based on our findings, we do not believe the damage was caused by our equipment.

Starting in November 2024, I was apparently charged $22/mo for a car wash membership I did not purchase. I downloaded an app which tells you of recurrent charges and this came up, to my shock. I was charged on Nov 26 2024 all the way until last month (May 27, 2025). The total amount is $154. I do use the car wash for individual washes, of which I have had several in these months, of course no idea I had a "membership." So they have gotten quite a bit of my money. If this was accidentally purchased, no one who worked there made me aware. They would have had to given me some kind of sticker or something, right? Or a membership card? I don't even know the protocol...because I have never purchased this. I always stick around and vacuum so they could have approached me at any time after a wash. No one did. I called their customer service and they cancelled my membership but they're telling me they will only refund me $44 out of the $154 I feel that I am owed. I am told that that is their terms and conditions to only refund 2 months and that is what a supervisor approved. I didn't sign any terms and conditions though. She also admonished me for not bringing it to their attention sooner, which is outrageous. They also either want my bank account and routing info or I will get a check in 4-6 WEEKS. Which is a crazily long time.I do not know what happened here. Sometimes they have someone standing at the self serve terminal who forces you to give you their card when you could do it yourself. I am assuming that I was scammed at this point. Or I made a mistake. But if someone would have approached me when this happened, I would have cancelled it right there. I want the full amount returned and honestly, I would like to just drive over there and pick up cash or a check from the location. I have been talking to customer service for the whole org or something. The location seems to be a franchise.

Apparently, when using a debit card for a $16.00 car wash, debit card information is kept and monthly recurring charges are assessed to my account -- without my permission and without any services provided! I do consider this issue to be FRAUD and will certainly tell everyone I know about this FRAUD (in fact, I found out about this FRAUD from a friend TODAY).OF COURSE, I WILL NEVER USE THIS BUSINESS AGAIN AND WILL LET THEIR BUSINESS PRACTICES BE KNOWN TO EVERYONE I KNOW! Of course, there are no receipts...just my bank statements which I will NOT put online! (happened more than once)...JUST STOP THIS BUSINESS FROM DOING THIS! WE must get a new debit card and change the # on accounts because of their FRAUD!

Ongoing Overcharges by Take 5 Car Wash Despite Lower Membership Plan I signed up for a $27.00/month membership plan with ************, but Ive been incorrectly charged $33.99 every month instead. On top of that, I was also charged an additional $22.00 every month for a plan I never signed up for. These unauthorized charges have continued for nearly two years. After speaking with a location manager, they confirmed the billing errors and instructed me to reach out to customer service for a refund. Despite this, I have yet to receive reimbursement or confirmation that this matter will be *********** requesting assistance in holding the company accountable for issuing a full refund for the overcharges.

      Business Response

      Date: 05/30/2025

      Hello,

At the time of the original purchase on May 1, 2024, the $27 rate was unavailable, making the $33.99 charge accurate. On February 25, 2025, the membership fee was changed from $33.99 to $22, but it seems the initial $33.99 membership was not terminated. Consequently, a refund of $135.96 was issued for four months of double billing (February 26, March 1, April 1, and May 1, 2025) at the higher rate, and the $33.99 membership was subsequently canceled. In accordance with our Terms and Conditions, we do not automatically adjust your plan billing rate when price changes occur, nor are we obligated to notify you of such changes. You have been consistently billed for the Unlimited Plan at the rate established at sign-up. Thus, no refund is warranted for any preceding months.

The $22 membership has been actively utilized, rendering it ineligible for a refund.

Your Monthly Unlimited Memberships 74266+590876 and 74091+937557 have been deactivated and your credit card will no longer be charged for renewal, however, you can still use pass 74091+397557 through the close of business on June 24, 2025.

      Thank you,

      Customer Answer

      Date: 05/31/2025

I am rejecting this response because while Take 5 admits I enrolled at $33.99 because the $27 plan was unavailable, they continued billing me at $33.99 after the plan dropped to $27without informing me or adjusting my rate. I was never notified or given the opportunity to switch.
Worse, a second $22 membership was added to my account without my knowledge or consent. I was told I only had one account. I never authorized two plans. I paid for one service.
Despite being charged for the top-tier plan, I was only receiving the $22 service. I was double billed but not receiving what I paid for. This is deceptive. This violates multiple consumer protection laws:

T.C.A. ********* charging for services not delivered, misrepresenting service, creating confusion, and enforcing terms not allowed under law.

T.C.A. ********* requires disclosure of billing terms, consent, confirmation, and notice of material changes, which I never received.

ROSCA prohibits recurring billing without clear consent. I never agreed to two memberships.

FTC Act (15 U.S.C. 45) prohibits unfair/deceptive billing. I paid for a premium plan and got the lower-tier service.

Internal policies do not override these laws. Courts have ruled that companies cannot use fine print to excuse overbilling or misrepresentation. I have filed complaints with the **************************, ****, and ***. I am demanding a full refund of all unauthorized charges from May 2024 to February 2025. This is not a misunderstanding. It is a pattern of deception and overcharging, and I expect immediate resolution.

      Business Response

      Date: 06/09/2025

      Hello,

On May 1, 2024, when the initial purchase was made, the $27 rate was not offered, thus the charge of $33.99 was accurate.

On February 25, 2025, the membership fee was reduced from $33.99 to $22. However, the original $33.99 membership was not canceled, leading to a refund of $135.96 for four months of double chargesspecifically on February 26, March 1, April 1, and May 1, 2025at the higher rate. The $33.99 membership has since been terminated.

According to our Terms and Conditions, we do not automatically adjust billing rates when prices are modified, nor are we required to inform customers of such changes. You have been consistently charged for the Unlimited Plan at the original rate set during sign-up. Therefore, a refund for earlier months is not justified.

The $22 membership has been actively used and therefore qualifies as non-refundable.

Your Monthly Unlimited Memberships 74266+590876 and 74091+937557 have been deactivated, ensuring that your credit card will no longer incur renewal charges. Nonetheless, you may continue to utilize pass number 74091+397557 until the end of business operations on June 24, 2025.

      Thank you for your understanding.

      Customer Answer

      Date: 06/09/2025

I am rejecting this response because:
No Valid Consent to Second Membership: A $22 membership was added to my account without my knowledge or authorization. I was told by multiple attendants that I had only one membership. I never consented to multiple charges. This violates both Tennessee Code ********* and 15 U.S. Code 8402 (ROSCA), which require clear, affirmative consent for recurring billing.
Charged for ******************************** I paid $33.99 for the highest-tier plan but was routinely provided services matching the $22 plan. This is a clear violation of T.C.A. 47-18-104(b)(5), which prohibits misrepresenting the quality of services delivered.
Failure to Notify of Price Reduction: When the $33.99 plan was lowered to $27, I was never informed. Instead, I continued to be charged the higher rate. Citing Terms and Conditions does not excuse failure to disclose material changes, which violates T.C.A. ********* and FTC Act 45.
Incomplete Refund: Take 5 refunded only four months of double billing, despite these issues affecting my account from May 2024 through June 2025. The majority of overcharges remain unaddressed.
Formal Legal Action Initiated: I have already sent a certified final demand letter to Take 5 Car Wash and its parent company, *************************** I have also filed formal complaints with the **************************, ************************************, and *************************
I am demanding: Full refund of all unauthorized or misrepresented charges refund of all $22 plan fees that were never approved. Refund for all months I paid for premium but received basic service, This is no longer a disputeit is a documented legal matter. I expect full accountability and resolution without further delay.

I am responding to the customer making this complaint. We have communicated to this customer on multiple occasions informing him that we aren't responsible for the damages that he is alleging to have happened at our wash. This customer was informed on day of the incident that we are not responsible as nothing we use in our wash that would have damaged the sensors on his vehicle. After the customer was informed of this decision, he started to claim that we scratched his vehicle leaving yellow scratches on his car. This is absolutely impossible as nothing we use ever will leave a yellow scratch. Overall, this has been reoccurring with this customer as he is trying everything to get us to cover his damages.

I cancelled my monthly membership with Take 5 Car Wash on March 3rd, 2025. About a week later I finally received confirmation from their customer care team that my membership was cancelled and my card would no longer be charged. They charged me the $22 monthly fee that month. I reached back out requesting they confirm cancellation of my membership and refund me. I again received confirmation that my membership was cancelled and that I would be refunded. They charged my card in March, April and now this month May and I have not received a refund/credit for any of these transactions. I have also called the customer support numbers they have listed and after waiting for over an hour on hold, I was eventually redirected to an individual trying to sell me medical items/devices. This is scam behavior and this seems to be a common occurrence among many customers that have had memberships with them before and has been going on for a very long time. I have reached out multiple times to get this rectified and have only received confirmations that my request is granted but no action was actually taken. Please help me get my refund for the past 3 months and look into their deceptive business practices. This is completely unacceptable and disgusting for them to do to customers.

      Hi ****,

I'm so sorry to hear about what happened! It appears this was an oversight on our part, but I'm here to help fix it. I know you're asking for a $66 refund, and just wanted to let you know that $22 was already processed yesterday.

I would be happy to process a refund for the remaining amount of $44.00 and have contacted you via email to request sensitive information necessary to complete the refund.

      Thank you,

      Better Business Bureau:

I have reviewed the response made by the business in reference to my complaint, and find that this resolution is satisfactory to me, if they have in fact cancelled my membership and do actually send me a refund.

      Thank you.
