    In December of 2023 I had put a $3,600 down-payment on a metal garage to be placed on a property that I was buying. In March of 2024 the property transaction fell through due to disclosure discrepancies. It took me all most of 2024 to find another property which I've recently closed on. The new property does not allow for the size building that I'd originally put the deposit on so I'm forced to buy a smaller one. The sales person at Precision Metal Structures told me at the time of the deposit that if my plans were to change I could use the deposit on any other building. When I asked for a modified quote on a smaller building, I was told that I could only use half of my original deposit. I was also told by the sales person that I'd basically stuck them with the materials for the larger building which was not true because they explicitly said that they don't order any material until the site is ready. A manager stepped in, apologized, and offered to do a new quote which he did. The site is now prepped and ready but in the end I had to go a little smaller than the new quote. The manager adjusted the quote again which was inflated and was actually more than the larger one. In order to keep it in check, I received a quote on the building from another company. That quote was turned out to be for a 2 feet taller building, a bigger roll up door, two additional windows, double bubble vapor barrier in the ceiling, and using the same gauge and quality material for $5,000 less than the one from Precision Metal Structures. When I presented that to the manager and requested either a price match or refund on my deposit minus a reasonable processing fee, he refused and fully intends in keeping my deposit for having done nothing except give me a few quotes. At $5,000 less, I'll still save almost $2,000 by letting Precision Metal Structures keep the deposit and buy from the other company which is considerably unethical in my opinion, especially after they'd already lied to me.

After thoroughly reviewing this situation, including all emails, recorded phone calls, and the signed purchase agreement, we respectfully disagree with the claims made by the customer. Below is our detailed response:
    1. Deposit Terms: The customer placed a $3,600 deposit in December 2023 for a 30'x70'x14' building with a 12'x30'x9' lean-to. The purchase contract, which the customer signed, explicitly states that all deposits are non-refundable and that quoted prices are valid for six months. Despite this, we extended the pricing for over a year as a goodwill gesture.
    2. Deposit Usage Miscommunication: At no point in our recordsvia phone or emaildid our salesperson promise that the deposit could be applied toward any future building of the customers choosing. This claim is false and unsubstantiated. Our contract terms are clear, and we always honor them.
    3. Price Match and Competitive Quotes: The customer requested a significantly smaller building (30'x40'x12') and presented a competitors quote for comparison. However, price variations are influenced by numerous factors, including design specifications, quality of materials, and overhead costs. Comparing our quote to that of another company with different operating standards is neither equitable nor reflective of the high-quality structures we provide.
    4. Customer Remarks: The customer made disparaging remarks toward our company and operations, suggesting we sit behind a computer and do nothing. This is not only disrespectful but overlooks the substantial effort and resources required to operate our business. From purchasing raw steel materials to managing overhead costs, we work hard to deliver quality products and services.
    Resolution Offered:
    Despite being under no obligation to do so, we remain committed to assisting the customer:
    We will honor the original 30'x70'x14' building with a 12'x30'x9' lean-to at the original price from December 2023.
    Should the customer wish to move forward with a smaller building, the pricing will reflect the updated specifications and current market rates.
    The $3,600 deposit remains non-refundable as per the signed agreement. However, we are willing to work with the customer to finalize their project in line with the original order or any reasonable modifications.
    We hope this clarifies our position and demonstrates our willingness to act in good faith. Thank you for the opportunity to address this matter.

     I am rejecting this response because:  

    I just got it with your reply. They definitely told me that I could use the deposit for any other building and lied about me having "stuck them with material they can't use now." I had that documented but they've since deleted everything in that message thread regarding that conversation. My situation has changed at no fault of my own, which has changed my needs and put me in a bind. They're absolutely taking advantage of my situation, and the manner in which they've both flat-out lied to me about the deposit usage and material ordering process (then hid it), have claimed to want to help me out just to quote me a higher price for a smaller building with less options, then to have the owner to speak in manner I would never speak to a  customer (especially after the dishonestly I've experienced with his employees) is ridiculous and points to a lack of integrity. As the owner of a business I'd never handle a situation like this in the manner they have. Any potential customer of theirs should beware of their propensity to be dishonest  and take advantage of a situation if they can.



    Furthermore, the business owner and his manager spoke as if they were doing me a favor by merely holding onto my $3,600 for almost a year, which again was due to problems that other people have caused. Their sales person lied to me about my ability to use the deposit on another building and stated that I had left them stuck with material that they had gotten specifically for my order and can't use anywhere else. Their policy states that they do not order any materials for a building until the site is prepped, which the manager confirmed in a conversation that they have subsequently deleted. As far as them not doing anything specifically for my order except do a few updated quotes, that's true. There was no material ordered specifically for my building and no time or expense was put into logistics, delivery, or installation of it specifically l, so since they aren't willing to offer me the building I need at a price based on the reasonable market value, they're in turn keeping $3,600 for offering no services except a quote.
