      We contacted Bayview Fence, as a local vendor, to give us a quote on installing a fence at our new home. We have never had a fence yard before, so did not know all of the requirements to ask for, but did tell the sales person, ********, that we wanted a puppy fence and was probably going to put a pool in at a later date. He informed us that a puppy fence would not be pool compliant. So I asked him for styles that would be. He showed us some and we picked out a style, that we assumed based on our conversation with him, would be pool compliant. When a pool company came out to show us some designs for our size yard, they noted that the fence would not meet pool compliance. I called Bayview and told them that we trusted them that our fence would meet compliance, but all they said was, "the contract you signed, was delivered and we are not going to do anything to fix your issue". His only solution was to buy another fence that would just go around the pool. The yard is not big enough to accommodate that and also the *** would not approve it. As I said, this was our first encounter with putting up a fence in over seven moves, so I trusted his "word".

      When asked about if they had any plans to get a pool, I did not receive a concrete answer. If a solid answer in the affirmative had been given, I would have immediately removed the non-pool code compliant options. I explained why the three styles shown were or were not pool code compliant, (The three examples present were two non-compliant 3-rail styles and the standard 2-rail pool code style) directly referencing the lack of space between the bottom rail and mid-rail. When asked why they couldn't get puppy picket on the pool code fence I informed them it was because it was a pool fence and puppy picket would prevent it from being pool code so it was not an available option, they could however get it on the other two styles being that they were already not pool code. This discussion was done with physical examples of material on hand and the parts of the fence were pointed at during the explanations.
