      My name is ***** ****** and my husband is **** ********.
      We Purchased 4 tires from Black's Tires on 1/18/19. Carlos B***** (Manager of the store) gave us a warranty for 50,000 miles (Please see attached invoice), Due to Covid, our driving was very minimal and we did about 12,000 miles from the date of the tires purchase.

      Our vehicle failed the NC state inspection last month due to slashed tires; the inspection was done at the BMW dealer in Wilmington, NC. We immediately went to Black's Tires to resolve the issue. At first Carlos promised to honor the warranty and replace the tires. However, he said he will not charge us for the unused mileage, that is about 38,000 miles. That would have been a considerable discount. He promised to get back to us in a day or two. However, even after a week when he did not call us, my husband and I went to the store to speak to Carlos. He said since we failed to get our vehicle alignment after he installed the new tires, the warranty is now null and void. But, Carlos never mentioned alignment when he installed the new tires back in January of 2019. We consider this a breech of contract. Also we were his loyal customers for about 16 years
      Therefore, we purchased 4 tires from the BMW dealer for $1660.00 (please see attached invoice)
      We respectfully request that Black's Tires reimburse this amount.

      Black's Tire Area Manager has contacted customer directly to discuss this issue and has come to a mutually agreed upon course of action. We appreciate our customer working with us to reach this decision and to resolve this matter.

      Black's Tire Manager said that he would issue a check for $1000.00 to resolve the dispute. However, I had to spend 1491.08 for a set of 4 tires. In addition, I had to spend $169.95 for alignment.
      In view of these expenses, I respectfully request that Black's Tire reimburse me the amount of $11491.08.

      After review with management, Black's will agree to the request and refund $1333.15. Refund to be mailed to the address on file.

      Black's Tire sent me a check for $1333.15.
      While it is less than what I paid for the new tires, I am accepting their offer. I see no point in dragging this issue any longer.
