I hired Justus and Sons to complete a bathroom remodel in my home. The project was quoted 7500$. I paid 3750$ via PayPal. ****** ****** the contractor came over and said that they took fees, so we agreed just to pay the rest to get the bathroom done. We were told the project would take 2-3 weeks. He started the next thurs.
He said that our washer might go better under the stairs. We agreed to pay him $500 to move the washer under the stairs. He spent Thursday and Friday framing the under stairs area. He cut a pipe that was suppose to go to my sink. He said he would be back Wednesday. Wednesday came and no communication happened. Friday I noticed my ceiling was showing signs of water damage and asked him to come over as it wasn’t like this prior to him working, he never came me over.
We reached out and was told he would be out Monday at 8am we expressed frustration with the lack of communication. He came Tuesday at 12pm. We expressed frustration as we were told 8 and he showed up at noon no communication. Showed him the ceiling and he said he only cut the sink, I told him the pipe he cut was leaking into the basement and we hadn’t dumped anything into the sink so it didn’t make sense. So I asked him to open up the wall to verify. Turns out he had cut my ac pipe which made the ac drain into my basement and thus ruined my bedroom ceiling.
As agreed that if he fixed the ceiling no harm would be done.
He asked for 4k more to deal with termites found and we agreed. He continued to show up at noon.
Thursday showed up at noon then wanted to get materials. He mentioned it might rain, I told him that he better tarp it then and he assured me he would. On the way back it poured and he informed me he did not tarp My drywall. This lead to a big disagreement as I was not going to accept wet drywall and he wasn’t going to replace it. We ended up firing him. As we have been getting more estimates we found he cut a hole in my support beam and ruined my living room floor.Business Response

I ****** ****** the Contractor put in a bid for $7500 to rip out the old tiled shower and floor and replace it. It also included mudding the shiplap to make smooth surface on the walls and to paint the bathroom. The customer was to provide all materials, I took the time to make the material list that the customer requested to be made. Then the customer refused the material list I made and went with cheaper products and created their own material list. Most of what the customer had ordered off of her own material list was the wrong products. She asked how much to open up under the stairwell and to put a washer there. As I had recommended that the cubby hole would be a better fit for the washer as she didn’t want to relocate the washer to the basement. I then quoted her $500 to open up the cubby hole, reframe the cubby hole, support the cubby hole and to add the drain and plug. She stated that she had to talk to her husband before we could proceed with opening the cubby hole. I was in the process of moving and had made clear to her. We were under agreement that we would not start any work until April 15th 2025 when her new washer arrived. That way they wouldn’t be without a washer. I told her I needed 50% of the $7500 bid up front for a deposit. They then paid $3750 through PayPal. PayPal then charged a fee of $125.00. I let the customer know this and they said they wanted to write a check for the remaining $3750 so that they knew they had the money for the fees. They called and said hey since we went ahead and paid you we want you to start earlier. I expressed to her that as mentioned in the beginning that I was moving and had other obligations but would see what I could do to start sooner. When we got there to start demo of the bathroom she declined the demoing of the bathroom she said she wanted the crawl space done first. We told her that it is best to do the bathroom as that is what we had bid and been paid for. She insisted that she wanted the crawl space done first as she was in the process of processing a child. And they could not wait for the washer to get there and wanted the cubby done ASAP. We expressed that we DO NOT remove appliances and that there would be an additional fee of $250 to move any appliances. Which we ended up moving the washer 5 times. After we had started the cubby hole I had to run to Ace hardware to get the matierals for framing and plumbing. I informed her that my bid was for labor only and she would be charged for any material pick up we had to do. After work had commenced for the washer’s new home, they then stated they wanted trim and a custom door built to hide the washer. I let them know that was not in the bid. She also stated she wanted tile where the washer was going. I informed her that her floor was unlevel and would not in the bid to do so. We worked there for 2 days and had the weekend off. As I let her know we don’t work weekends. We came back Monday and they said hey we want this bathroom torn apart. So we started removing the shower and the floor. Then she stated that she wanted all the bathroom demoed. I explained to her that the original bid did not include the entire bathroom. She said ok just do it. I informed her that any and all extra work will be added on the final invoice. As we were tearing down the shower we found the termite damage. I then expressed to her that it would be costly to repair. She the stated how long does it really cost to add and cut a few more boards. I told it would be twice the work and an additional charge to demo the walls that we were originally supposed to only mud and paint. We ended up taking 4 trailer loads of debris from the job site. My time nor gas nor fees of dump were included in the bid. As it was all added extra. I will admit that I cut the wrong pipe, I did admit this to her. However her husband capped the pipe which then caused the water damage to her ceiling. We offered to fix the area that was damaged, her husband agreed that they would pay for the materials and we would donate the free labor since both parties were at fault. She then stated no I don’t want it patched I want a brand new ceiling. I agreed to do a brand new ceiling labor free as they were providing the materials. I made 2 trips to Lincoln, 1 to pick up a shower door for their bathroom. I let them know that we charge for all pick up and delivery of materials. They stated that was fine. I then made another trip to Lincoln to get all the drywall and insulation. I informed client before going to Lincoln that the weather stated it was going to rain and she said we have to go get it now. I told her that if it did rain all I could do is tarp it but we are not responsible for material damage. I then went to Lincoln picked out the materials, load the material, tarp the material. Then the following day we went to the clients house and the husband inspected every piece of material and it was not damaged in any way. The support beam that she mentioned, I told her how I would reroute the pipe she didn’t not want to do it the way I recommended. I told her in order to do it the way she wanted and to keep pitch we would have to cut a few inches off the floor joice and by doing so we would have to sister the joice to keep it structural she said that is fine. She then stated that she did not want to pay the price at ACE and would wait until she got the materials from Home Depot. We had done more work then bid. She expects us to work for free as she was constantly changing everything. Making our 2 to 3 week deadline pushed want back due to adding more and getting wrong material. We charge $150 an hour. If you calculate the time spent working, getting rid of the debris, her calling me over to look at tile samples. The $250 times 5 to move the appliance and the additional 2 trips to Lincoln. We are actually out money. She has put in a refund request to PayPal for the $3750. We have lost quite a bit of money as well. We put in approximately 75 hours. So hourly would of been $11250. The moving of appliance fee $1250. The dump fees of $250 for the 3 trailer loads. Brings us to a total of 12750. I feel as we did everything we could to accommodate this customer however their lives changed drastically and she expected the work to be done in a fraction of the time. When I told her that wasn’t possible she decided to let us go. I do not feel as we owe her any compensation or money back. As she has slander my name and given out very personal information such as place of business, etc. I feel she has put my family in danger. She slander thus company all over social media with false facts and accusations. We had to have police involvement due to false accusations that she claimed. And we showed the police video proof that she was lying. However I feel my kids and family are in danger.Business Response

This complaint is retaliation of her not wanting to pay for the work that was done. She felt an apology was needed and nothing was done for this to happen. We have tried multiple times to resolve the issue and it’s just a back and forth situation. We did a lot of work and material loading and unloading which was never agreed on. She has done nothing but slander and threaten and honestly for the safety of my family I cannot fathom to continue going back and forth. She is upset because PayPal deemed her refund request invalid as we had proof of everything. We would like to stop all communication and correspondence with her at this time.Customer Answer

I am rejecting this response because:Paypal Rejected because of item was not received and a bathroom is not an item. This has to do with a bathroom not being finished we hired and paid you to do, you have yet to show any proof of hours or contracts that we agreed to and we have the invoice that’s paid in full. You did not complete the job in full I have texts of him showing up and leaving. This is not a I didn’t want to pay for services rendered I paid in full the whole bid and you did not do the job.
we Are more then happy to pay for the work you did but would like you to pay for damages and refund the percentage that you did not do.
