      Agreed to have Capital well put a well in for $14,000 they agreed ************************************************************************************************************* when they couldn't get water also decided they weren't going to finance the job for **************************************************************************************************************************************************** interest rate would be flexible and have options I do not believe they know what they were doing and could not find well water now somehow expect me to pay for without financing a thousand foot hole they drilled in the ground that does not produce water I did not sign any agreement saying I would pay for them drilling ***** ft hole that does nothing on my property I do not have confidence they know what they are doing or are able to find water on the property after many attempts to do so

      For nearly ******************************************************************************************* This was no different with *******. Capital well signed an estimate for a new well to be installed on his property which he agreed to as attached. It was clearly explained that the well estimate is based on well data on the ** ONE STOP data platform for his area. If we do not obtain any water at the estimated depth, we would need to continue drilling or stop and hydrofrack the well. The recommendation for either option would be dictated based on the well status. Unfortunately in this case the well was not producing any water and our project manager ( *** ******* ) was in constant contact with the status of his well all the way to 1000' with text messages we have on record for the entire process. We would never drill past the estimated depth without communicating with our customers as we did here with *** ******. 

      FINANCING: We offer financing through a third party called "GREENSKY FINANCING". *** ****** was approved initially for ***, this is correct. During the drilling process the ** explained that he would need to contact ******** to increase the amount he was approved for and that increase is between he and Greensky. If ******** will not finance him the additional then he is personally responsible to pay his balance over and above the approval. We have zero control over that due to privacy laws. This was also discussed in a text message with the customer during the ********************** process. The customer was very aware that ********************** his well deeper was costing him more money, it was communicated in his contract, and it was communicated to him by his project manager. Unfortunately, at 1000' we had only been able to obtain 1/2G**. This is not anything that we can control, the two things in 40 years that we do not guarantee is water quality, and water quantity which is also noted very clearly on our estimates / contracts. 

      *** ****** was notified a few times informing him that his Greensky Loan for the 14k that he was approved for was running out which we have copies of at which time we recommended that he sign off on the 14k and then he would need to determine how he was going to pay the balance with GreenSky of which he needs to communicate with, we as a company cannot have that dialog with the finance company, again privacy laws!  

      Its very clear and obvious that *** ****** is blaming Capital Well because we were unable to obtain adequate water supply on his property. As stated, this is not anything we have control over. The next steps to obtain water would be through hydrofracking which costs more money. Capital Well will not move forward to a next step without being paid as promised in our contract and as outlined. Our intention going forward with this account will be turned over to our company attorney as we have been more than patient waiting for him to work out payment for which he is obligated.

      The salesman I dealt with was *** *******. On multiple phone conversations he explained that financing would be available for the entire cost of the project he also explained the period of time to pay back would be flexible when I asked about 2 years. The company green sky that they use is by definition a predatory lender. Well advertising 12 months no interest they actually suspend interest for one year and then charge double interest the next year if the full balance isn't paid off in 12 months dishonest deceptive business practices defined. And lastly I will communicate ***** ********* Cavalier attitude about doubling then tripling the original ****** quote which was higher than other well quotes was unbelievable I did not agree to nearly triple the original $****** quote.  *** said the cost could be higher they did not say triple or I would not have even considered the project. He explained multiple times that the financing would be flexible and pay back would be available for multiple years talking to two local well companies and a member of the *************************************************** they said most of the ***** in that area are between 100 and 400 it makes no sense cost wise that they would have drilled to ***** ft the cost is prohibitively high to do so and unlikely they would get water at that depth the only reason I went with capital well in the first place is because they offered financing options that were interest-free for one year they did not follow through with that agreement and they said it wasn't their problem the finance company wasn't going to cover what the salesman originally agreed to I would not have considered any well job without having financing available as I do not have a way to pay for that the salesman *** knows that very clearly and it was communicated to him by text and by phone many times.
